1968/04/01 City Council Resolution (4)WJML: J'S: amf 3 -19 3 lOC RESOLUTION NO. 68 -33 A RESOLUTION REQUESTING CONSENT OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SONOMA TO THE EXERCISE OF EXTRA - TERRITORIAL JURISDICTION TO UNDERTAKE PROCEEDINGS FOR THE ACQUISITION AND CONSTRUCTION OF PUBLIC IMPROVEMENTS AND TO PROVIDE THAT THE COSTS SHALL BE ASSESSED UPON THE DISTRICT BENEFITED, UNDER APPROPRIATE SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS PROJECT 1968 -1 RESOLVED, by the City Council of the City of California, that WHEREAS, it is the intention of this Council appropriate special assessment and assessment bond the acquisition and construction of the acquisitio hereinafter described; WHEREAS, this Council proposes to assess the Rohne rt Park, to undertake proceedings for ns and improvements costs of the acqui- sitions and improvements and the expenses incidental thereto upon a district benefited thereby, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area shown on a map thereof on file in the office of the City Clerk to which reference is hereby made for further particulars; WHEREAS, a portion of said acquisitions and improvements to be made are within the unincorporated territory of the County of Sonoma; however, no assessments will be levied against the lands in unincor- porated territory within said County; WHEREAS, said acquisitions and improvements to be made are of such a character that they will directly and peculiarly affect property not only within the boundaries of the City of Rohnert Park, but also the unincorporated territory within the County of Sonoma, and the purposes sought to be accomplished can best be accomplished by a single comprehensive scheme of work; WHEREAS, there has been filed with the Council a form of Resolu- tion of Intention to be used in said proceedings; WHEREAS, the public interest, convenience and necessity will be served by the making of said acquisitions and improvements and the levying of said assessments; WHEREAS, the acquisitions and improvements are described as follows: (a.) The acquisition of property necessary for the opening of the )utherly extension of Frontage Road from a point 3500 feet, more or less, )utherly of Wilfred Avenue, running thence southwesterly., southerly and )utheasterly to a point on Frontage Road 3500 feet, more or less, north- ,ly of Helman Lane and for the opening of the westerly extension of )hnert Park Expressway from a point on said Frontage Road, to be opened =rein, 5800 feet, more or less, southerly, southwesterly and southerly. f Wilfred Avenue at its intersection with the northwesterly prolongation f Rohnert Park Expressway, running thence northwesterly., westerly and orthwesterly 8200 feet, more or less, crossing Himebaugh Creek at a oint 900 feet, more or less, northeasterly of Laguna De Santa Rosa tianne" and. the Belleview-Wilfred Ditch at a point 1100 feet, more or ess., northerly of Laguna De Santa Rosa Channel to Stony Point Road at point 3000 feet, more or less, southerly of Wilfred Avenue and the mprovement thereof by clearing, grubbing, grading, removal of existing reel, shrubs and structures and the construction therein of base,, pave- .ent., curbs, gutters, berms, tree planting, monuments, traffic striping,. .nderground serviced street lighting facilities, the lowering of existing tilities where required � o meet the new grade, drainage ditches, culverts . t, ,nd surface and subsurface storm drainage facilities, where required, 'and 'he construction of vehicular bridges, where required. (b) The construction of a sanitary sewer trunk main, manholes with ianhole frames and covers together with all appurtenances thereto in an 9asement to be acquired from the existing. Rohnert Park Sewer Plant renerally located 3100 feet, more or less, southerly of Wilfred Avenue ind. 750 feet, more or less, westerly of U. S. Highway 101 running 'hence 4200 feet, more or less, southerly and generally parallel to said J. S. Highway 101 to a point on the southerly boundary of Rohnert Park annexation No. 4, 750 feet, more or less, westerly of U. S. Highway 101. (c) The construction of streamline electrical facilities, under- :7round, telephone facilities and natural gas facilities necessary to serve the properties of Santa Rosa Enterprises. (d) The construction of a water supply and pump station, including pumps., pump house, pressure tank and all appurtenances thereto on prop- erty to 'be acquired and generally located 3000 feet, more or less, west- erly of w: S. Highway 101 and 800 feet, more or less, northerly of the southerly 'boundary of Rohnert Park Annexation No. 4, and the construction of water mains, valves and. hydrants, together with all appurtenances thereto in an easement to be acquired from said water supply and pump station site, running thence easterly 2700 feet, more or less, to Front- age Road, to be opened herein., at a point 6600 feet_, more or less, southerly of Wilfred Avenue. (e) The acquisition of capacity rights and a right of service and use in sewage treatment and disposal facilities of the City of Rohnert Park on 'behalf of properties within the proposed. assessment district, includ- ing the right to discharge sewage from said district into and through main trunk interceptor and outfall sewers and appurtenances of said City, and the right to have said. sewage discharged from the area of the assess- ment district treated and disposed of in and through the disposal plant of said. City and the acquisition of disposal capacity rights in said sewerage facilities and. plant, together with the acquisition of capacity rights and a right of service and. use in water supply, treatment and storage facilities lities of the City of Rohnert Park on behalf of properties within the proposed assessment district. (f) The acquisition of all lands and easements and the performing of all work auxiliary to any of the above nece-scary to complete the same. ON, NOW, THEREFORE; IT IS ORDERED, as follows 1. That request be, and the same is hereby, made of the .Board of Supervisors of the County of Sonoma, it being the legis- lative body having jurisdiction over the unincorporated territory in which a portion of said acquisitions and improvements are to be had and made grant to this Council its consent, expressed by resolution, to the ordering of said acquisitions and improvements, to the formation of the assessment district, and to make such changes and modifications as may be proper or advisable in the manner provided by law, and the assumption of jurisdiction thereover for the purposes aforesaid. 2. That request be, and the same is hereby, made that consent be granted to open all such public streets as are required for the installation of said improvements. All work pertaining to said project shall be done under the direction and to the satisfaction of the Engineer of Work of said City and in conformity with good engineering practice. Said Engineer of Work shall require of the contractor that all of the provisions of the specifications are complied with by the contractor to the end that no greater amount of ditches are open at any time than is necessary, that they shall be adequately lighted and barricaded, and that they shall be promptly backfilled. 3. That request be, and the same is hereby, made that the form of Resolution of Intention to be adopted be approved. 4. That the City Clerk of this City is hereby directed to file with the County Clerk of the County of Sonoma a certified copy of this Resolution, together with a copy of said Resolution of Intention.
