1972/07/03 City Council ResolutionWJ,M&L:PDA,.K:zw 6/23/72 10 RESOLUTION NO. 72- 96 A RESOLUTION DETERMINING UNPAID ASSESSMENT AND PROVIDING FOR ISSUAI\'CE OF BOND COUNTRY MANOR ASSESSMENT DISTRICT NO. 1972-1 RESOLVED, by the Council of the City of Rohnert Park, California, that; WHEREAS, this Council did, on April 3, 1972, pass and adopt its Resolution of Intention No. 72-423 under and pursuant to the provisions of the Municipal Improvement Act of 1913, and did therein provide that bonds would be issued pursuant to the provisions of the Improvement Act of 1911, reference to said Resolution of Intention and the proceedings had subsequent thereto hereby being expressly made for further particulars; WHEREAS, notice of the recordation of the assessment and of the time within which assessments may be paid has been given in the manner provided by law, and the time so provided for receiving payment of assessments has expired, and the City Clerk has filed with the City Treasurer a list of all assessments which now remain unpaid; NOW,, THEREFORE, IT IS HEREBY ORDERED, as follows: 1. That the assessment remaining unpaid,, and its amount., is as shown on said list and on Exhibit "A" hereto attached and by this reference made a part hereof. 2. That for a particular description of the lots or parcels of land bearing the assessment number set forth in said list, reference is hereby made to the assessment and to the diagram recorded in the office of the Superintendent of Streets of this City after confirma- tion by this Council. 3. The unpaid list is in the amount of $30,,135.005 and a bond shall be issued upon the security of the unpaid assessment shown thereon in accordance with the provisions of the Improvement Act of 1911 and said Resolution of Intention and the proceedings thereunder duly had and taken. Said bond shall be dated July 10, 1972, shall be designated Series 1972 -15 shall be in the amount of the unpaid assessment on the particular lot or parcel of land described therein, and the principal thereof shall mature in fifteen (15) even annual amounts, represented by coupons payable on January 2 in each of the years, 1973 to 1987 inclusive. Said bond shall bear interest from its date on the unmatured principal amount at five and one -half (5 -1/2 %) per annum, represented by coupons payable on January 2 and July 2 in each year, commencing on January 2, 1973. The redemption provisions of said bond shall provide for a premium of five percent (5 %) of the unmatured principal thereof on call, and the bond and coupons thereof shall be made payable to bearer at the office of the Treasurer of Sonoma County, fiscal agent of the City and of its Treasurer. 4. Said bond shall be manually signed by the City Treasurer and the coupons attached thereto shall have said Treasurer's facsimile signature engraved, printed or lithographed thereon, and such signing shall constitute and be a sufficient and binding execution of said bond and the coupons thereof, respectively. Said bond and coupons shall be substantially in the form provided in said Improvement Act of 1911, except the words "after the acceptance of said work" shall be deleted from the first sentence of the second paragraph of the bond form. The City Treasurer is hereby authorized and directed to sign said bond and coupons as aforesaid. 5. The City Treasurer shall deliver said bond to the purchaser thereof upon receipt of the purchase price therefor, as provided in Resolution No. 72 -67 Awarding Sale of Bonds, adopted by this Council on May 15, 1972. 6.
