COOPERATIVE AGREEMENT BETWEEN THE COUNTY OF SONOMA
AND THE CITY OF ROHNERT PARK
RELATING TO PLANNING ASSISTANCE
This agreement made and entered into by and between the County of
Sonoma hereinafter (COUNTY) and the City of Rohnert Park (hereinafter
CITY).
WHEREAS, the County has a professional planning staff involved
in comprehensive planning for the County, which staff is available on a
regular part -time basis in the Aid --to -Small Cities program, and
WHEREAS, the City does not have a planning staff to serve the
Planning Commission, and
WHEREAS, the City Planning Commission and Council desires to
improve its planning process by obtaining staff assistance on a part -
time basis at Planning Commission meetings and at other times,
MOW, THEREFORE, BE IT MUTUALLY AGREED THAT:
1. The County, in cooperation with the City, shall provide
planning advice and staff services to the City based on the
maximum amount of time or services and fees as specified in
this agreement.
2. The services to be provided by the County Planning Department
staff member assigned by the Planning Director, under this
agreement will include, but not be limited to:
a. Attendance at Planning Commission meetings to be available
for consultation on planning matters.
b. Attendance at other meetings as necessary and as time may
permit.
c. Preparation of maps, ordinances,and /or reports on agenda
items of the City Planning Commission as the time limits
of this agreement permit.
d. Advise and assist the Planning Commission and City staff
in matters of planning before the City.
3. Specific assignments of the County staff member involved shall
be guided by the City Manager or his designate who will work
cooperatively with the County Planning Director in coordinating
the consultant service program.
4. Any additional staff service necessary beyond the maximum
time as provided by this agreement may be allowed, but must
first be authorized by the County Planning Director.
S. The City shall receive up to a maximum of fifty percent (500)
of the planner's time, for which they shall pay a fee
annually in the amount of nine thousand two hundred dollars
($9,200.00). Payment may be made quarterly in arrears,
or other convenient schedule.
6. The schedule of fees will be based on the cost of a
professional planner's salary, employee benefits, and over-
head for his services, at an approximate annual amount of
$18,000.00 for 100% of his time (working a forty hour week).
7. If the City desires additional services or staff time beyond
that specified in this agreement for major planning projects
or specific jobs beyond the month-to-month service covered
by this agreement, the City may negotiate for these services
for a fee based on an hourly rate for the planner involved
or a fixed fee agreed upon by the City and County. The
availability of staff time will also be a factor.
8. Either party can terminate this agreement with thirty (30)
days notice after six (6) months from the date of its
execution, and in any event this agreement is terminated
upon the failure of either party to include the necessary
funding in its 1972 -1973 budget or succeeding budgets.
9. The City and County may from time to time request changes,
including any increase or decrease in the amount of the
County's compensation, which are mutually agreed upon by
and between the City and the County, and which shall be
incorporated in written amendments to this agreement.
10. The City shall have the right to comment on the performance
of the staff member assigned to City by the County Planning
Director and to request a change in the staff member if
City feels a change is desirable for City's benefit. County
will be given a reasonable length in which to change staff
assignments in order to accede to a request from City
for a staff assignment change.
11. This agreement shall become operative on the lst day of July,
1972, or in the event the same is not executed by the Board
of Supervisors prior to said date, it shall become operative
when executed by such Board of Supervisors.
