1990/07/24 City Council Resolution (13)RESOLUTION NO. 90 -165 DATED: July 24, 1990 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SONOMA TO CREATE THE SONOMA COUNTY TRANSPORTATION AUTHORITY; APPROVING THE MEMBERSHIP OF THE GOVERNING BODY OF THE AUTHORITY; APPOINTING A REPRESENTATIVE TO THE GOVERNING BODY OF THE AUTHORITY; APPROVING THE SONOMA COUNTY TRANSPORTATION AUTHORITY EXPENDITURE PLAN; DESIGNATING THE SONOMA COUNTY TRANSPORTATION AUTHORITY AS THE RESPONSIBLE AGENCY FOR THE PREPARATION AND ADOPTION OF A CONGESTION MANAGEMENT PROGRAM; AND APPROVING AN ANNUAL APPROPRIATIONS LIMIT WHEREAS, the Sonoma County Transportation Committee consisting of representatives of the cities, the Board of Supervisors and private industry has recommended the creation of a county transportation authority to finance certain street, highway and public transit improvements; and WHEREAS, the board of directors of the proposed authority (sitting as a committee pending the creation of the authority) has adopted a proposed expenditure plan; and WHEREAS, the Local Transportation Authority and Improvement Act and Government Code §65089 require the concurrence of a majority of the cities having a majority of the incorporated population within the County for the creation of an authority and an entity to prepare and adopt a congestion management plan; NOW, THEREFORE, BE IT RESOLVED that this City Council hereby finds, determines, declares and orders as follows: 1. That it is in the best interests of the City of Rohnert Park and it is hereby requested that the Sonoma County Board of Supervisors create the Sonoma County Transportation Authority pursuant to the Local Transportation Authority and Improvements Act (Public Utilities Code § §180000 and following). 2. That this City Council concurs in the recommendation of the Sonoma County Transportation Committee that the governing body of the Sonoma County Transportation Authority shall consist of 11 members composed as follows: one city councilmember from each incorporated city and three members of the Sonoma County Board of Supervisors. That Councilmember Charlie Cochran is hereby appointed to serve, at the will and pleasure of this Council, as the City's representative on the Board of Directors of the Sonoma County Transportation Authority and that Councilmember Warren K. Hopkins shall serve as an alternate. 4. That the Sonoma County Transportation Expenditure Plan, as approved by the Sonoma County Transportation Authority (sitting as a committee) at its meeting of July 23, 1990, is approved and recommended to the Authority for. adoption. 5. That the Sonoma County Board of Supervisors is requested to call a special election for November 6, 1990 for voter approval of: (a) a countywide retail transaction and use tax to be levied at a maximum rate of 0.75 percent, (b) a maximum bonding authorization of $200 million, and (c) an annual appropriations limit for the authority sufficient to accommodate projected revenue from the proposed countywide retail transactions and use tax. 6. That the actions authorized by this resolution are exempt from the requirements of the California Environmental Quality Act by virtue of exemptions for transportation improvement programs and projects that are submitted to a vote of the electorate (Public Resources Code §21080(b)(14), California Administrative Code §§15276 and 15378). 7. That pursuant to the requirements of Government Code §65089, the Sonoma County Transportation Authority shall prepare, adopt and administer a congestion management program for Sonoma County that meets the requirements of law. 8. The City Clerk shall forthwith deliver a certified copy of this Resolution to the Clerk of the Sonoma County Board of Supervisors. DULY AND REGULARLY ADOPTED this 24th day of July, 1990.
