1991/01/22 City Council Resolution (13)A RESOLUTION ACCEPTING ACCESS RIGHTS FROM CERTAIN PROPERTIES,
AND TRANSFERRING RIGHT OF WAY FOR THE
WILFRED AVENUE FREEWAY RAMPS TO THE STATE OF CALIFORNIA,
AND RESCINDING RESOLUTION NO. 90-238
WHEREAS, the State of California is planning to reconstruct the freeway
ramps at Wilfred Avenue, and
WHEREAS, the reconstruction of those ramps requires additional right of
way, including access rights thereto, which right of way and access rights
have been acquired by the City in conjunction with the Wilfred Avenue
Assessment District, and
WHEREAS, the grant deed referred to by Resolution No. 90-238 did not
explicitly include the access rights along the new freeway right of way as
required by Caltrans.
WHEREAS, the access rights from the properties in the north quadrant of
the intersection have been offered by the property owners for dedication to
the City.
NOW, THEREFORE, BE IT RESOLVED, that the City shall accept the grants of
access rights along the new right of way line from the property owners north
of the ramps.
AND, BE IT FURTHER RESOLVED, that the right of way for the Wilfred
Avenue freeway ramps, along with the access rights thereto, as described in
the attached Exhibit "A", is hereby granted to the State of California, and
the Mayor is authorized to execute the Grant Deed therefor.
AND, BE IT FURTHER RESOLVED, that Resolution No. 90-238 is hereby
rescinded.
