1991/01/22 City Council ResolutionRESOLUTION NO. 91-25 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK SETTING GARBAGE AND RUBBISH OR REFUSE COLLECTION RATES WHEREAS, Ordinance No. 366 adopted in August 1979 provided that the City may make an annual adjustment in the rates then established for garbage, rubbish and trash collection service to adjust said rates for any change in the cost of living index or such other standard as may be selected by the City Council, and that such adjustments in the rates must be approved by the City Council by resolution; and WHEREAS, Empire Waste Management, Inc., a wholly owned subsidiary of Waste Management, Inc., the contract agent for this city service, has submitted financial information and data to support its request for an adjustment in the rates; and WHEREAS, the last adjustment of rates charged to city customers for this service occurred either on August 1, 1989 or September 1, 1989, depending on the type of user; and WHEREAS, members of the city staff have met with representatives of the contract agent and staff has carefully reviewed the data submitted to explain the increase in the operating expenses of the contract agent, including an increase in dumping fees charged by the County of Sonoma, fuel costs, and costs associated with the automated service and curbside recycling programs initiated in the fall of 1989, and have recommended to the Rohnert Park City Council an adjustment in the collection rates hereinafter set forth; and WHEREAS, a subcommittee of the City Council, to wit, Mayor Eck and Councilman Hopkins, have reviewed staff's recommendation for a rate adjustment and find it in order; and WHEREAS, the City Council is cognizant of the fact that even with the adjustment in the rates that will be approved by this resolution that the rates for service in Rohnert Park are comparable or lower than the rates charged for the same service in many other cities in the Marin, Sonoma and Napa County areas. NOW, THEREFORE, THE COUNCIL OF THE CITY OF ROHNERT PARK DOES RESOLVE AS FOLLOWS: Any persons from whom garbage, wet garbage, rubbish or refuse is collected under the provisions of this article shall pay to the City through the Finance Department the following fee for such services: A. Single Family Residences, Duplex, Triplex, and Fourplex. For the 90 gallon container service a monthly charge of eight dollars ($8.00) which shall include all garbage, wet garbage, rubbish and refuse which has been placed within the receptacles with the receptacles placed at the curb for pick up. A monthly charge of four dollars and fifty cents ($4.50) for a second 90 gallon container. B. Commercial Establishments and Apartment Houses. These rates are based on the total number of apartments, or mobile homes whether occupied or vacant, subject to the following provisions: (1) If the entire premises is unoccupied, no charge is made. (2) Where thirty (30) gallon cans are used for collection purposes by the apartment house, the rate shall be eight dollars ($8.00) per month for each apartment unit. (3) Where thirty (30) gallon cans are used for collection purposes by any commercial establishment, the rate shall be eight dollars ($8.00) per month for the first two cans and the same amount per month for each additional can. (4) The City Sanitation Officer may require the use of bins, furnished by the Contract Agent, for any commercial establishment or apartment house. Where a type of bin service is provided for which no rate is provided by this resolution, a comparable rate may be established by the Contract Agent with the written consent of the City Manager. (5) All business conducted in a residence must pay the business rate for all garbage and refuse handled. (6) The Contract Agent shall make available bins for collecting of garbage, wet garbage, rubbish and refuse to all business establishments and apartment houses, when requested by the owners or required by the City Sanitation Officer. (7) The City Sanitation Officer shall have the right to require that apartment houses, fourplexes, condominiums, planned developments and other multi- family residential units utilize bins for the collection of garbage, rubbish and refuse. C. Mobile Home Parks. The owners of all mobile home parks shall pay a charges as follows: (1) For each "adults only" mobile home park, a charge of five dollars and ten cents ($5.10) for each occupied unit. (2) For each mobile home park which is not restricted to "adults ", a charge of six dollars and seventy cents ($6.70) for each occupied unit. D. Special Collections. For a special collection of rubbish or refuse, there shall be a charge of eight dollars and seventy five cents ($8.75) for each cubic yard or fraction thereof. A special collection of rubbish shall consist of any collection not included within the established monthly rate and shall include any bulky items which cannot be placed within the regularly used collection receptacle. E. Commercial Compactor. Large Industrial or Commercial: for compacted garbage from commercial compactors the charge for refuse collection shall be: (1) For pick -ups and collection not more than one time per week, an amount not to exceed sixteen dollars and fifty cents ($16.50) per cubic yard. (2) For pick -ups and collection more than one time per week, rates shall be negotiated between the business and Empire Waste Management subject to the written approval of the City Manager of his designee. F. Free Service to City. The Contract Agent shall provide free service to all city owned facilities and bus stops. The rates outlined in above section A for Single Family residences shall become effective March 1, 1991. The rates outlined in above sections B, C, D, and E shall be effective February 1, 1991.
