1990/03/12 City Council Resolution (2)WHEREAS, by Resolution No. 91-38, a public hearing was called for
Tuesday, March 12, 1991, at the hour of 7:00 P.M., in the Council
Chambers in the City Offices, 6750 Commerce Boulevard, Rohnert Park,
California, to ascertain whether 'the public necessity, health, safety, or
welfare requires the removal of poles, overhead wires and associated
overhead structures, and the underground installation of wires and
facilities for supplying electric, communication, or similar associated
service, within that certain area of the City described as follows:
Rohnert Park Expressway, Seed Farm Drive, and the Civic Center
site in the area shown on the attached Exhibit "A".
WHEREAS, notice of such hearing has been given to all affected
property owners as shown on the last equalized assessment roll and
utilities concerned in the manner and for the time required by law, and
WHEREAS, such hearing has been duly and regularly held, and all
persons interested have been given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Chapter 12.12 of the
Rohnert Park Municipal Code, the above-described area is hereby declared
an Underground Utility District, and is designated as Rohnert Park
Underground Utility District No. 7. Attached hereto, marked Exhibit "A",
and hereby incorporated as a part of this resolution, is a map
delineating the boundaries of said district.
BE IT FURTHER RESOLVED, that the Council does hereby fix August 1,
1991 as the date on which affected property owners must be ready to
receive underground service, and does hereby order the removal of all
poles, overhead wires, and associated overhead structures and the
underground installation of wires and facilities for supplying electric,
communication, or similar associated service within Rohnert Park
Underground Utility District No. 7 on or before August 1, 1991.
BE IT FURTHER RESOLVED, that the utility companies shall also be
responsible for the conversion of overhead utility services up to a
maximum of 100 feet on private property with the cost of such conversion
to be paid entirely from the Underground Utility District No. 7, Rule 20A
funds.
