1991/03/12 City Council Resolution (4)RESOLUTION NO. 91-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK ABANDONING AND VACATING A SECTION OF A 40 FOOT WIDE PUBLIC ROAD RIGHT -OF -WAY REFERRED TO AS WILLIS AVENUE LOCATED ON THE WEST SIDE OF REDWOOD AND EXTENDING FROM WILFRED AVENUE ON THE NORTH SOUTHERLY FOR A DISTANCE OF 696 ±, BETWEEN ASSESSOR'S PARCEL NO. 45- 075 -02, 03 AND 08 ON THE WEST AND ASSESSOR'S PARCEL NO. 45- 082 -40 AND 42 ON THE EAST WHEREAS, Government Code 65402 provides that the advisory agency of a city review and recommend to the elected public body whether certain public easements or rights -of -way should be vacated and /or abandoned; and WHEREAS, the City of Rohnert Park Department of Public Works has requested that a portion of a public road right -of -way being 40 foot wide by 696 ± foot long section of Willis Avenue be abandoned, described as follows: Subject road right-of-way is a 40 ft. wide by 696 ± foot long parcel section of Willis Avenue belonging to the City of Rohnert Park located southerly of Wilfred Avenue; between AP No. 45- 075 -02, 03 and 08 on the west and AP No. 45- 082 -40 and 42 on the east (as shown on attached Exhibit "A""). WHEREAS, the Planning Commission did hold a public hearing regarding this matter of the 28th day of February, 1991; and WHEREAS, the Planning Commission's recommendation was that the aforesaid road right -of -way be abandoned. WHEREAS, after considering the matter, the City Council has determined that the aforesaid public right -of -way should be abandoned based upon the following findings: 1. That the portion of road right -of -way referred to as Willis Avenue is not needed as a public roadway. 2. That alternate road -way will be constructed to serve the adjacent property owners and general public. 3. That the road right -of -way is not necessary and it would be in the best interest: of the public health, safety and welfare to abandon the aforesaid public road: NOW, THEREFORE, BE IT HEREBY RESOLVED by the Rohnert Park City Council that the above mentioned section of Willis Avenue; being a road right -of -way 40 ft. wide by 696 + feet in length be abandoned, subject to the following conditions: 1. The abandonment is contingent upon the City consummating the purchase of the right -of -way for the realignment of Willis Avenue through AP 45- 082 -40 and 42. 2. That Mr. Ken 44a4kt w or the owners' of Assessor's Parcel No's. 45- 082 -40 and 42 will construct a 25 ft. wide gravel driveway to the requirements of the City Engineer from the new terminus of Willis Avenue to the residence located on Roberts' property, Assessor's Parcel No. 45- 075 -08. 3. That the City shall reserve appropriate easements for all existing utilities within Willis Avenue. 4. That the City shall reserve two private 12' wide storm drain easements from the existing storm drain in Willis Avenue to serve Roberts' property, .Assessor Parcel No. 45- 075 -08. 5. That the City shall reserve appropriate private utility easements across Hartsough frontage, AP No. 45- 075 -03 to serve Roberts' property AP No. 45- 075 -08 in consideration of Roberts relinquishing all of Roberts' access rights in the abandoned portion of Willis Avenue not owned by Roberts.
