1991/07/09 City Council Resolution (3)RESOLUTION NO' 91- 138 A RESOLUTION APPROVING SALE OF PROPERTY AND AUTHORIZING EXECUTION OF A GRANT DEED TO COTATI-ROHNERT PARK UNIFIED SCHOOL DISTRICT /Sale of City-Owned Land in "M" Section for "M" School 9.0 acres` portion of Assessor's Parcel 047-121-23\ WHEREAS, the City has acquired certain parcels of land in the "M" section for use as a community park; and WHEREAS, the Cotati-Rohnnrt Park Unified School District was in need of a parcel of land for o school in the "M" section; and WHEREAS, through a joint effort by the City of Rnhnort Park, C0Ddiotti Enterprises, and the Cotati-ROhnert Park Unified School District, certain agreements were made to allow for the [ntati-"Aohnnrt Park Unified School District t0 purchase approximately nine (9) acres for said school site and for the City of Rohnert Park to purchase additional land from Condiotti Enterprises to allow for enough acreage for "M" Section Park; and WHEREAS, by Resolution No. 90-95 the City entered into a lenso agreement with the Cotot1-Rohnert Park Unified School District leasing approximately nine (9) acres for the "M" section school site located at the corner of Magnolia Avenue and Mitchell Drive; and WHEREAS, one of the terms in said lease agreement provided for the Cotati- RohRert Park Unified School District to purchase said site at the then market appraised value at the time of sale under the existing zoning; and WHEREAS, an appraisal of said site was completed by Harding Appraisal Co., Inc' on March 21, 1989` of which said site was appraised at $2,115,000; and WHEREAS, the City authorized an updated appraisal by the appraisal companies of Harding Appraisal and Vice Appraisal Company; and WHEREAS, Vice Appraisal Company has submitted an updated appraisal dated April 16, 1991, which the City has accepted, valuing the nine (9) acres at $2,450,000; and WHEREAS, this appraisal report has been submitted to the Cntat1-Rohnert Park Unified School District, which has accepted said appraisal. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Rnhnert Park that it does hereby accept Vice Appraisal Company's appraisal of the nine (9) acre portion of Assessor's parcel No. 047-121-23 valued at $2,450,000. I Resolution N0, 91-138 BE IT FURTHER RESOLVED that the Council of the City of Rohnert Park does hereby accept the offer from the Cotati-Rohnert Park Unified School District to purchase the nine /9\ acres (a portion of Assessor's Parcel NU. 047-121-23) at the appraised value of $2,450,000. BE IT FURTHER RESOLVED by the Council of the City of Rohnert Park that that certain Grant Deed from the City of Rohnert Park, m municipal corporation, to the [ntati-Rohnert Park Unified School District, a political subdivision of the State of California, for the "M" section school site be, and the same is hereby approved, and the Mayor is authorized and directed to execute same for and on behalf of the City of Rohnert Park. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to handle all the details and execute all documents necessary to complete the sale of the property to the Cototi-Rohnert Park Unified School District.
