RESOLUTION OUTLINING POLICY CONCERNING USE OF FEES
DEPOSITED IN CAPITAL OUTLAY FUND
WHEREAS, Chapter 15.40 of the Rohnert Park Municipal Code, as
amended by Ordinance No. 501, adopted on March 8, 1988 provides for the
payment of a fee by those constructing or installing dwelling units or
industrial or commercial buildings in the City of Rohnert Park; and
WHEREAS, the Municipal Code provides for deposit of the fees in
the Capital Outlay Fund; and
WHEREAS, the Municipal Code provides that the sums deposited in
the Capital Outlay Fund shall be used for the acquisition, improvement,
and expansion of public parks, playgrounds, open space, recreation
facilities, and community facilities, including but not limited to fire
stations, libraries, civic auditoriums, civic centers, and sports
stadiums; and
WHEREAS, the amount of fees outlined in the Municipal Code were
increased by Ordinance No., adopted on July 23,.1991; and
WHEREAS, the City Council desired to update its policy as
contained in Resolution No. 83 -71 concerning the allocation of said
funds realizing that said allocation can be changed at the Council;s
discretion.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Rohnert Park that the fees collected under Chapter 15.40 of the
Municipal Code as amended by Ordinance No. from construction or
installation of dwelling units shall be appropriated as follows:
1. $380.00 will be earmarked for use in the development of
community facilities, including but not limited to fire stations, civic
auditoriums and civic centers.
2. $210.00 will be earmarked for acquisition of open space on the
City's periphery to create an open space buffer around the city.
3. The balance of the fees collected from new dwelling units
shall be used for public parks, playgrounds, open space improvements,
and recreation facilities in the general neighborhood from which the
fees are derived, or at a location for recreational facilities which,
in the opinion of the City Council, provides benefits to all the
neighborhoods.
BE IT FURTHER RESOLVED that it is Council policy that fees
collected under Chapter 15.40 of the Municipal Code, as amended from
those constructing or installing industrial or commercial buildings
shall be used for the acquisition and development of community
facilities, including but not limited to fire stations, libraries,
civic auditoriums, civic centers, and the like.
BE IT FURTHER RESOLVED that the City staff is directed to handle
the collection, accounting, and expenditure of fees collected under
Chapter 15.40 of the Municipal Code, as amended, in accordance with
this Council policy statement until, and unless, said policy is amended
by the Council at some future date.
BE IT FURTHER RESOLVED that Resolution 88 -71 is rescinded and
replaced by this resolution, effective with the effective date of
Ordinance No.
