RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK
ORDERING THE ANNEXATION TO THE CITY OF ROHNERT PARK
(REORGANIZATION NO. 12) AND THE DETACHMENT FROM
THE BELLEVUE FIRE PROTECTION DISTRICT
WHEREAS, preliminary proceedings for annexation of certain
territories described in Exhibit "A ", involving annexation to the
City of Rohnert Park was initiated by the filing of a petition
with the Sonoma County Local Agency Formation Commission, pursu-
ant to the requirements of the District Reorganization Act of
1965; and
WHEREAS, appropriate proceedings have been conducted by the
Sonoma County Local Agency Formation Commission and approved by
Resolution No. 2102; and
WHEREAS, the Local Agency Formation Commission, in approving
this proposal, authorized the Rohnert Park City Council to con-
duct the proceedings; and
WHEREAS, the City Council has certified the Environmental
Impact Report for the Home Depot Project by Resolution No. 91 -157
making certain findings regarding mitigation and monitoring;
WHEREAS, the Council finds and determines that this annexa-
tion is consistent with the General Plan Land Use Element, for
the reasons set forth in Resolution No. 91 -158 and that this area
is prezoned CS:PD (Special Service Commercial /Planned Unit Devel-
opment) District and the territory is not inhabited and that no
written protests have been filed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Rohnert Park and ordered as follows:
(a) The territory previously described in Exhibit "A" and
hereby is ordered annexed.
(b) This territory is hereby ordered annexed without an
election, pursuant to Section 57055 of the Government Code.
(c) This territory shall be taxed for existing bonded
indebtedness or contractual obligations.
(d) The City Council orders detachment from the Bellevue
Fire Protection District.
(e) The Bellevue Fire Protection District shall retain
the base property tax.
(f) The City Clerk is hereby directed to certify to the
passage of this resolution and make the filings required by
Section 57200 of the Government Code.
