RESOLUTION AUTHORIZING ACCEPTANCE OF DEEDS
FOR PURCHASE OF PROPERTIES REQUIRED FOR
WILLIS AVENUE RELOCATION RIGHT -OF -WAY AND
REDWOOD DRIVE RIGHT -OF -WAY AND
APPROVING PAYMENT OF SAME
WHEREAS, Resolution No. 91 - 56 provided for the abandoning
and vacating of a portion of Willis Avenue located south of
Wilfred Avenue subject to the abandonment being contingent upon
the City consummating the purchase of the right -of -way for the
realignment of Willis Avenue through Assessor Parcel No. 45- 082 -40
and 42; and
WHEREAS, Resolution No. 91 -132 made changes and modifications
to the Wilfred Avenue Interchange Area Assessment District Project
No. 1987 -10 which provides for the additional acquisition and or
construction for the Willis Avenue Relocation right -of -way and
Redwood Drive right -of -way as referenced in Resolution No. 91 -106
Resolution of Intention to make changes and modifications to said
assessment district; and
WHEREAS, negotiations for the acquisition of the Willis
Avenue Relocation right -of -way and Redwood Drive right -of -way have
been completed by the City Manager and Mr. Ken Porter,
representative of the owners, V.& C. Bb Enterprises, Inc., a
California Corporation of the subject property and which
negotiations have concluded with a recommendation by staff that
the property owners be compensated $165,529 for the 19,474 sq.
ft. of Willis Avenue Relocation right -of -way and $14,471 for the
3,631 sq. ft. of Redwood Drive right -of -way for a total
compensation amount of $180,000 and additionally the City would
pay off the current assessments on the Willis Avenue Relocation
right -of -way and the Redwood Drive right -of -way estimated to be
$61,228; therefore, total payments by the City is estimated to be
$241,288; and
WHEREAS, the City Council has been kept apprised of the City
staff's negotiations with the property owners relative to the
acquisition of the right -of -way; and
WHEREAS, staff recommends funding for the acquisition of the
Willis Avenue relocation right -of -way and Redwood Drive right -of-
way which amount to $180,000 plus the payoff of current
assessments estimated to be $61,228 all from the Wilfred Avenue
Interchange Area Assessment District Project No. 1987 -10; and
WHEREAS, the City staff solicits Council authorization to
accept deeds for those right -of -ways so that the deeds can be
recorded as soon as possible.

NOW, THEREFORE BE IT RESOLVED by the Council of the City of
Rohnert Park as follows:
1. That the City Council authorizes and approves the
acceptance of grant deeds for the right -of -way required for the
Willis Avenue Relocation right -of -way and for the Redwood Drive
right -of -way and authorizes and directs the Mayor to execute the
required Certificate of Acceptance for each such deeds.
2. That the City Manager is hereby authorized and approved
to make payment to V.& C. Bb Enterprises, Inc. for the acquisition
of the Willis Avenue Relocation right -of -way and for the Redwood
Drive right -of -way in the amount of $180,000.
3. That the City Manager is hereby authorized and approved
to pay off the current assessments on the Willis Avenue Relocation
right -of -way and the Redwood Drive right -of -way estimated to be
$61,228.
4. That funding for these payments be provided from the
Wilfred Avenue Interchange Area Assessment District Project No.
1987 -10.
BE IT FURTHER RESOLVED, that the Mayor, City Manager, and the
City Attorney are authorized to take necessary action to implement
this Resolution.
