1992/07/28 City Council Resolution (7)RESOLUTION NO. 92 -123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK SUPPORTING A CONSTITUTIONAL AMENDMENT TO PROTECT THE REVENUE SOURCES OF CALIFORNIA CITIES WHEREAS, the majority of California residents live within the boundaries of incorporated cities; and WHEREAS, such cities are responsible for providing basic services such as police, fire, paramedic, street maintenance, parks and recreation, storm drainage, wastewater reclamation, and a variety of comparable services to these residents; and WHEREAS, in recent years, the California Legislature and the Governor have exhibited an increasing inclination to interfere in municipal government by reducing or eliminating subventions and by diverting local revenue sources to balance the state budget; and WHEREAS, the California Legislature and the Governor have demonstrated a tendency to impose state - mandated programs upon municipal government without providing additional revenues for the implementation of such programs; and WHEREAS, the aforementioned actions have been compounded by the California Legislature's propensity to adopt and the Governor's propensity to sign legislation authorizing county governments to charge fees to city residents for services paid for from general tax revenues of the county in the unincorporated areas of the county, thereby effectively double taxing municipal residents for such services; and WHEREAS, each of these actions have threatened the financial stability of municipal governments throughout the State of California and have compromised the ability of the said governments to provide basic services to the majority of California residents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park: 1. That it does hereby support the League of California Cities proposal to enact a constitutional amendment through the initiative process to be sponsored by the League of California Cities. 2. That the said amendment shall seek to attain the following objectives: A. To constitutionally protect all municipal revenues from reduction or redistribution by action of the State of California and to restore all subventions flowing to California cities as of July 1, 1980. I Resolution No. 92 -_123 B. To constitutionally prevent the state or any county within the state from levying a fee for any purpose on any municipal government or upon any municipal resident to pay for any services provided to any resident of the state or to any resident of any county within the state through any state revenue source or through any county revenue source, it being the specific purpose of this amendment to recognize that all municipal taxpayers pay taxes to the state and to the county in which they reside and that the said taxes should, as a matter of principle, acquire the same services for municipal residents as they acquire for other residents of the state or for the residents of unincorporated areas within a county. C. To assure that the State of California shall not require local government to implement any law or any program adopted by the California Legislature and the Governor unless the said program is fully funded by the State of California and unless the revenue therefor represents additional revenues to municipalities. 3. That the League of California Cities and those cities enjoying member- ship therein support the concept of a constitutional amendment for the purposes stated herein and shall actively campaign to promote place- ment of such an amendment on the statewide ballot in November 1992 and for its subsequent adoption by the voters. 4. That upon adoption, this resolution shall be forwarded to the League of California Cities for placement before the general membership thereof at the League of California Cities Annual Meeting to be held in San Francisco in October 1992.
