A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
AMENDING RESOLUTION NO. 99 -212 RELATING TO CLAIMS FOR FIRE
ASSESSMENT REFUNDS FOR FISCAL YEARS 97 -98 AND 98 -99
WIIEREAS, the City Council of the City of Rohnert Park, by its Resolution No. 99 -212,
determined to offer refunds of the City of Rohnert Park Fire Suppression Benefit
Assessment District assessment for fiscal years 1997 -1998 and 1998 -1999 ( "Assessment
Period "); and
WHEREAS, the refunds authorized by Resolution No. 99 -212 were to be made to the
current owners of the property benefited by the assessment; and
WHEREAS, in some circumstances the current owner of the property benefited by the
assessment did not own the property during the Assessment Period;
WHEREAS, certain property owners who paid the assessment but no longer live on the
property have submitted claims for refunds of the benefit assessment
( "Former Property Owners "); and
WHEREAS, the City Council wishes to establish a policy regarding the payment of the
claims of Former Property Owners.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rohnert
Park that the following policy is hereby established regarding the payment of the claims
of Former Property Owners:
The claim for a refund of the City of Rohnert Park Fire Suppression Benefit
Assessment District assessment for Assessment Period submitted by a Former
Property Owner shall be approved and paid upon verification that (a) the Former
Property Owner owned the property on which the assessment was imposed during the
Assessment Period; and (b) a refund has not been made to the current owner of the
property on which the assessment was imposed during the Assessment Period.
2. If a claim for a refund submitted by a Former Property Owner is disapproved because
the current owner of the Property has been sent a refund, the City Manager (a) shall
send a letter to the Former Property Owner providing him/her with the name of the
current property owner and the date on which the refund was paid; and (b) shall send
a letter to the current owner of the Property requesting repayment of the refund based
upon the City's information that the current owner of the Property did not actually pay
the assessment during the Assessment Period and therefore, is not owed a refund .

3. The City Manager shall be authorized to pay the claims of Former Property Owners
consistent with the terms of this resolution.
4. The City Manager shall provide a report to the City Council on or about June 15,
2000 and on or about November 15, 2000 summarizing the claims of Former Property
Owners that have been submitted, approved, and disapproved.
