2000/06/27 City Council Resolution (7)RESOLUTION NO. 2000- 136 A RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES' STATEMENTS WHEREAS, the governing body of any local agency is required to adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs of the candidate's statement. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Rohnert Park does hereby resolve, declare, determine and order as follows: r 1. Each candidate for elective office may prepare a candidate's statement on an appropriate form provided by the City Clerk. 2. The candidate's statement may include the name, age (optional), and occupation of the candidate and a brief description of no more than 200 words describing the candidate's education and qualifications, expressed by the candidate himself or herself. 3. The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. 4. The candidate IshdW [shall not] be required to pay for the cost of printing the candidate's statement in English. 5. The candidate [shall] r tj be required to pay for the cost of translating the candidate's statement into any oreign language as specified pursuant to State and/or Federal law. 6. The candidate s[ hall] be required to pay for the cost of printing the candidate's statement in a foreign language. 7. The City Clerk shall provide each candidate a copy of this Resolution at the time nomination petitions are issued. 8. The resolution includes policy relating to who will pay for the printing of the candidates' statements on the ballot and the ballot pamphlet. As discussed on June 13, 2000, since three members of the City Council will be candidates, and since the resolution will have a "personal financial effect" on each of these council members, each of the council members is disqualified from participating in the decision on the resolution.' The Political Reform Act does not prevent a city council member from participating in a decision to the extent his /her participation is legally required for the action or decision to be made.' At the meeting on June 27, the City Council should choose one of the otherwise disqualified council members to be in the quorum of the City Council that will consider the resolution. Then, prior to consideration of the resolution, the chosen city council member discloses the following: 1. The existence of a financial interest in the decision to adopt the resolution. 2. A description financial interest : cost of the candidate's statement. 3. The reason that there is no alternative source of decision - making: state law requires adoption of the resolution; a quorum must be present before the resolution can be considered. Council members Flores, Reilly and the chosen council member consider the resolution. The chosen council member abstains from the vote. Thank you for your attention.
