A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF ROHNERT PARK
APPROVING THE FIRST AMENDMENT TO THE AGREEMENT WITH HILTON
FARNKOPF & HOBSON TO PROVIDE SOLID WASTE CONSULTING SERVICES AND
AUTHORIZING THE CITY MANAGER TO SIGN THE AMENDMENT
WHEREAS, on February 22, 2000, the City and Hilton Farnkopf & Hobson, LLC
(Contract Agent) entered into an Agreement, approved by City Council, for the provision of
consulting services for program design and the procurement of a new solid waste service contract
for the City; and
WHEREAS, the Agreement provided for a limited scope of services to be provided on a
time and materials basis for a basic solid waste services procurement process, including specified
tasks with designated time budgets, in a total amount for all services not to exceed $55,000; and
WHEREAS, the City subsequently requested that the Contract Agent attend extra Council
meetings, perform a number of additional new consulting tasks not included in the original scope
of services, and City Council added several new alternatives and options to the Request for
Proposals (RFP) and Draft Agreement during the process requiring development of more complex
cost sheets, extensive analysis of proposal costs and rate impacts, and numerous document
revisions; and
WHEREAS, the additional tasks, alternatives and options requested by City Council
materially increase the amount of time and costs required by Contract Agent to complete the
project, necessitating revision of the scope of services and compensation to Contract Agent for
services rendered; and
WHEREAS, Contract Agent and City have prepared a First Amendment to the Agreement
revising scope of services to reflect additional tasks and costs, and revising the total cost for all
services to be time and materials in an amount not exceed $92,975.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of
Rohnert Park that the First Amendment to the Agreement between Hilton Farnkopf & Hobson
and the City of Rohnert Park is hereby approved; and
BE IT FURTHER RESOLVED, by the City Council of the City of Rohnert Park that the Rohnert
Park City Manager is hereby authorized to sign the First Amendment.
