2001/04/10 City Council Resolution (13)RESOLUTION NO. 2001 -87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND ARCHITECTURAL REVIEW FOR A REBUILD OF AN EXISTING FAST FOOD RESTAURANT SITE AT 6600 COMMERCE BOULEVARD (RHL Design Group) WHEREAS, the applicant, RHL Design Group, has submitted an application for Site Plan and Architectural Review Approval for the property located at 6600 Commerce Boulevard in accordance with the City of Rohnert Park Municipal Code; WHEREAS, on March 8, 2001, the Planning Commission held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and, WHEREAS, on April 10, 2001, the City Council held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and, WHEREAS, the Planning Commission and the City Council of the City of Rohnert Park have reviewed and considered the information contained in the Site Plan and Architectural Review application for the proposal; and WHEREAS, the City Council of the City of Rohnert Park makes the following findings: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY, OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The City Council, in approving Planning Application No. PL2001- 006SR: makes the following findings, to wit; Site Plan and Architectural Review Approval That the development's general appearance is compatible with existing development and enhances the cityscape. The proposed restaurant will be a marked improvement over the existing store, which was constructed in the 1970's. The adjacent shopping center is of a different design and the new restaurant building would be a model for any future redevelopment of this center. 2. That the development incorporates a variation from adjacent structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the facade facing the street; and/or the line and pitch of the roof. The project will incorporate a varied roofline and building setbacks to provide visual interest. A tower element will provide additional relief from the horizontal nature of the building form. City of Rohnert Park Resolution No. 2001 -87 (Page 2 of 4) That the development incorporates a variation in materials from directly adjacent structures. The facility will use the same basic colors as adjacent "Commerce Plaza" shopping center, which is appropriate. The new design will incorporate tile and standing seam metal elements that are not used in the center. That the development will be located and oriented in such a manner so as to provide consistent relationships and avoid the chaos which results front indiscriminate location and orientation. The proposed arrangement of the facility and its access will adequately allow trucks, cars, and people to move freely through the site. The new drive - through arrangement will be a substantial improvement over the existing one. Section 3. Environmental Clearance. The project is categorically exempt fi-om the California Environmental Quality Act, pursuant to Public Resources Code Section 15302 (Class 2 — Replacement and Reconstruction). NOW THEREFORE BE IT RESOLVED, that the City Council does hereby approve Planning Application No. PL2001- 006SR: Site Plan and Architectural Review, subject to the following conditions: 1. Expiration of Approval — Pursuant to the City of Rohnert Park Municipal Code, the Site Plan and Architectural Review approval shall expire one year from the City Council approval date, unless an extension is requested and approved. 2. Conformance with Municipal Code and Other Agency Plans — All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies. 3. The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building and Public Safety Departments prior to commencement of the operation at this location, as well as from all agencies that have approval over restaurant facilities. Site Plan and Building Elevations a. All improvements shall be in substantial conformance with approved Site Plan and Elevations for the project, except as modified herein. b. The sidewalk along Commerce Boulevard shall be replaced per City standards and tie smoothly into the Enterprise Drive sidewalk, or as otherwise approved by the City Engineer. C. The developer shall install a handicapped pedestrian curb cut at the street corner adjacent to the site (i.e. the southeasterly corner of Commerce Boulevard and Enterprise Drive.) If additional right -of- way is required to accomplish this, the developer shall dedicate same to the City by deed. d. The two parking spaces shown in front of the trash enclosure shall be removed.. A replacement space shall be provided by shifting the parking spaces east of the enclosure farther east, into the landscape finger. e. The entrance to the drive - through lane shall be a minimum of 15 feet in width. f. The red proposed for the standing seam metal elements shall be substituted with a rust color, subject to Staff review and approval. g. Trellis elements shall be added to the north elevation, as approved by Staff. City of Rohnert Park Resolution No. 2001 -87 (Page 3 of 4) h. The central white tile band on the wainscot shall be colored the same red as the two adjacent bands, or in a color complementary to the standing seam metal elements, as approved by Staff. i. Handicapped parking shall be provided in accordance with the latest ADA requirements. j Adequate space and racks for bicycle parking shall be provided. k. The building shall utilize illuminated address signs that can be clearly read from the adjacent rights -of -way. 1. The trash enclosure shall be finished to match the building and provided with a decorative trim cap. The enclosure shall be designed so that it is large enough to accommodate recycling bins. m. A minimum of four (4) outdoor trash receptacles shall be provided for customer use, with the final locations to be shown on the site plan. n. All mechanical equipment shall be screened from public view, including roof - mounted units. o. The tile elements on the vertical corner elements at the east elevation entrance and on the south elevation between the "PLAYPLACE" and the entrance shall be removed. Landscape Plan a. Prior to the issuance of any building permits, final landscape and irrigation plans shall be submitted to and approved by the Director of Planning and Community Development and the City Engineer. Such plans shall be in substantial conformance with the plan submitted as a part of this application, with the following modifications: b. A combination of shrub plantings and decorative masonry walls shall be installed beyond the outside curb of the drive - through lane so as to screen the lane from public view. C. All trees within five feet of the public right -of -way shall have root barriers that are approved by the Director of Planning and Community Development. d. A permanent automatic sprinkler shall be installed to maintain all landscape materials and areas. Liightin a. Prior to the issuance of any building permits, final lighting plans shall be submitted to and approved by the Director of Planning and Community Development. b. All exterior lighting shall be designed so as to prevent any spillover lighting to adjacent properties and rights -of -way. C. Roof - mounted lights are prohibited on the building if they are placed so as to silhouette the building and roof. 7. Signs a. All signs shall be submitted to the Planning and Community Development Department for final review and approval. b. The existing monument sign will be refinished /repainted as necessary. C. All signage lighting shall be of the minimum intensity required to provide effective illumination of the signage. City of Rohnert Park Resolution No. 2001 -87 (Page 4 of 4) Site Improvements a. All double -check valves provided for domestic water and fire sprinkler systems shall be concealed from any public streets and parking lots with decorative walls, landscaping, and mounding. Plans shall be submitted to the Planning and Community Development Department and City Engineer for review and approval. b. All utilities shall be placed underground. C. The project developer shall upgrade the site improvements to current City standards, including, but not limited to, all of the water services to the site and with a screen wall around the backflow assemblies. d. Water and sewer service shall not be provided unless the City Engineer advises that the City has ample capacity to serve the development. e. All parking areas, driveways, and open storage areas shall be paved with asphalt surfacing. All site work, including curbs, gutters, sidewalks and berms separating landscape areas shall be concrete. All plans shall be prepared in accordance with City standards and submitted to and approved by the City Engineer. f The on -site drainage system shall be designed in accordance with Sonoma County Water Agency's design standards. g. The developer shall submit a current soils report to the Chief Building Official for review and approval prior to issuance of building permits. Construction Miti ag tion a. The developer shall. ensure that a water truck is on site during construction and grading to suppress the dust to an acceptable level. b. The developer shall ensure that the heavy construction equipment has adequate mufflers to lessen the noise impact. C. The developer shall comply with construction hours pursuant to Municipal Code Section 9.44.120.
