2001/06/12 City Council Resolution (7)RESOLUTION NO. 2001 -128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, CALIFORNIA, AMENDING CERTAIN PLANNING, ZONING, AND ENGINEERING FEES WHEREAS, the City of Rohnert Park Planning and Community Development and Engineering Departments have conducted a review of the current fee schedule, the beneficiaries of those services, and the revenues produced by those fees and charges. WHEREAS, the City of Rohnert Park finds that it must charge fees to cover the cost of planning, zoning and engineering services which the City must provide to ensure compliance with applicable ordinances, codes, and regulations. WHEREAS, as documented in the May 31, 2001 memorandum from the Planning and Community Development Director to the City Manager, no fee on the amended fee schedule shown in Exhibit A, Planning, Zoning and Engineering Fee Schedule, exceeds the costs reasonably borne by the Planning and Community Development and Engineering Departments in providing the service or enforcement of applicable ordinances, codes and regulations for which the fee is charged. WHEREAS, no fees are included in this amended fee schedule for the purpose of acquiring funds for the construction of public improvements or the acquisition of equipment. WHEREAS, the amended fee schedule was processed in the time and manner prescribed by State and local law. WHEREAS, on June 12, 2001, the City Council of the City of Rohnert Park reviewed the amended fee scheduled and supporting data during a scheduled public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposed fees. WHEREAS, at the June 12, 2001 City Council meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Council considered all the facts relating to the amended fee schedule. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Environmental Clearance. The adoption of this Resolution including the fees and charges provided herein, is statutorily exempt from. the California Environmental Quality Act under Public Resources Code Section 21080(b)(8), as the establishment and modification of charges by a public agency to meet operating expenses.. Page 2 of 2 .solution No. 2001 — 128 NOW THEREFORE BE IT RESOLVED, that the City Council approves the Planning, Zoning, and Engineering Fee Schedule set forth in Exhibit A, attached to and incorporated herein, and that the Fee Schedule set forth in Exhibit A shall be in full force and effective sixty (60) days after its adoption.
