2001/06/12 City Council Resolution (10)� d 11 ADOPTING THE 2001-2002 WEPARTMENT 'I FEE SCHEDULE I WHEREAS, the City of Rohnert Park, Department of Public Safety — Fire Services Division has conducted a review of the current fee schedule, the beneficiaries of those services, and the revenues produced by those fees and charges; and WHEREAS, the Department of Public Safety — Fire Services Division wishes to comply with both the letter and the spirit of Article X11113 of the California Constitution and limit the growth of taxes; and WHEREAS, the City of Rohnert Park Department of Public Safety — Fire Services Division finds that it must charge fees to cover the cost of fire prevention services which the City must provide to ensure compliance for which the City has the responsibility to enforce in accordance with all applicable ordinances codes, regulations and or laws; and WHEREAS, the Department of Public Safety — Fire Services Division desires to establish a policy of recovering the full costs reasonably borne for providing fire prevention services, such that general taxes are not diverted from general services on a broad scale; and WHEREAS, the Department of Public Safety — Fire Services Division finds that there is reasonable relationship between the amount of the fees charged and the services performed, pursuant to Health and Safety Code Section 1391(a); and WHEREAS, all plan reviews, construction inspections and code enforcement inspections required by the Uniform Fire Code, Rohnert Park City ordinance or the California Office of the State Fire Marshall may be subject to the adopted user fees; and WHEREAS, no fee on the schedule exceeds the costs reasonably borne by the Department of Public Safety in providing the service or enforcement of applicable codes or regulations for which the fee is charged. The Department of Public Safety does not include charges or fees in this schedule for any new construction or development project for the purpose of acquiring funds for the construction of public improvements or the acquisition of equipment; and WHEREAS, all requirements of California Government Code Sections 66016, 66017, 66018 and other applicable laws are hereby found to have been complied with; and WHEREAS, any modification of the existing fee schedule imposed and adopted may be modified annually by resolution from the City Council. 1 Page 2 of 2 Resolution No. 2001 -130 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: The following fee schedule titled, the Rohnert Park Department of Public Safety — Fire Services Division 2001 -2002 Fee Schedule, and any associated charges are hereby directed to be computed and applied by the Department of Public Safety — Fire Services Division for the listed fire prevention services when provided by the Department of Public Safety — Fire Services Division or its designated contractors. All fees set by this resolution are for each identified service; additional fees shall be required for each additional service that is required or requested. Should there be a conflict between two applicable fees to the same service, the lower dollar amount of the two shall be applied. If in question, this resolution may be interpreted by the Department of Public Safety — Fire Services Commander or a duly authorized representative thereof. If any portion of this resolution is held to be invalid or unconstitutional by any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions and all other portions shall re!-nain in full force and effect. The adoption of this Resolution including the fees and charges provided herein, is statutorily exempt from the California Environmental Quality Act under Public Recourses Cost Section 21080(b)(8), as the establishment and modification of charges by a public agency to meet operating expenses. BE IT FURTHER RESOLVED that the 2001 -2002 fee schedule set forth in this Resolution, shall be in full force and effective sixty (60) days from and after the adoption of this Resolution and all existing Fire Division fees for the Department of Public Safety, current or past, are hereby rescinded. (0) City of Rohnert Park Department of Public Safety 2001 -2002 Fee Schedule The following is the Department of Public Safety Fire Services Division Fee Schedule. Listed in the fee schedule are the Service to be performed, the fee associated with that service or activity and the deposit* due, if applicable. The fee schedule is broken down into 3 main parts. 1 - Plan Review and Inspection 2 — Miscellaneous Fire Prevention Fees 3 = Annual Fire Inspections *Deposits are established for applicants to secure services performed by the Fire Services Division of the Department. As work is performed on a project, data relative to staff and hours worked is compiled and the applicant is billed. Charges are billed at the rate of $50.00 per hour. This is an established rate for Fire Prevention activities, Plan review and Inspections. This rate covers one fire inspector's time and was figured to cover the inspector's hourly rate plus benefits. Applicants are billed prior to project completion for all services performed. When the project of an applicant is completed and all bills have been paid, final fire clearance will be awarded to the project. In the City of Rohnert Park, annual fire inspections conducted for life safety compliance in all existing businesses, is fee based. The rate at which an annual inspection is charged is $40.00 per year billed annually. If additional inspections or plan review is necessary due to non - compliance or excessive problems during the process, additional charges will be assessed at the minimum hourly rate. (4) Fire Alarm and Fire Sprinklerplans shall be submitted directly to the Department of Public Safety. All plans should be accompanied by a plan review application. Fees should be calculated and submitted with the plans at time of submittal. Reviewed plans will not be returned as approved until all fees are paid. (S ) If the estimated cost for improvements is less than the deposit; the actual fee is due at plan submittal. (6) The City of Rohnert Park reserves the right to, and may at any time, send plans submitted to this department for review, out to an independent plan review f rm of their choice. The cost of the review will be the responsibility of the individual who has submitted the plans.' The cost of the outside plan review will be subtracted from the balance owed at the time offinal billing. Individuals submitting plans for review will be notified at the time of submittal if plans will be reviewed by an outside firm. This charge includes one re- inspection to verb compliance if items were found to require correction on the first visit. If items remain outstanding on the re- inspection, a fee of $40.00 per.hour will be charged for follow -up visits until corrections are completed. (2) Businesses which store or use items listed in Table A may be subject to a special hazard fire services permit if it is determined by the Fire Chief that the business constitutes a high hazard to life safety and/or property. (3) If a business stores, uses or produces a hazardous material in excess of 200 cubic feet, 500 pounds, or 55 gallons they must comply with the requirements of SB2185, enforced by the Sonoma County Department of Emergency Services. If a business generates any quantity of a material listed as a hazardous waste, they must comply with the requirements of the waste program enforced by the Sonoma County Department of Emergency Services. TABLE A A business may be required to obtain a fire permit if it is determined by the Chief that the nature of the business includes one or more of the following and has been determined to constitute a high hazard. - The cost of the permit is in addition to the annual inspection fee.
