2001/07/24 City Council Resolution (9)RESOLUTION NO. 2001-L61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING AN AMENDMENT OF THE GENERAL PLAN LAND USE MAP FOR A 14.45 ACRE SITE LOCATED ON THE NORTHERLY SIDE OF THE FUTURE MARTIN AVENUE EXTENSION, WEST OF REDWOOD DRIVE, MORE PRECISELY KNOWN AS PORTIONS OF ASSESSOR'S PARCEL NUMBERS 143 - 040 -093, -095, AND —098 ( Costco Wholesale Corporation) WHEREAS, the applicant, Costco Wholesale Corporation, has submitted an application for a General Plan Amendment for property located on the northerly side of the future Martin Avenue Extension, west of Redwood Drive; and WHEREAS, the Planning Commission reviewed the Initial Study prepared for the project; determined the project would not have a significant effect on the environment; accordingly directed staff to prepare a Mitigated Negative Declaration; and has otherwise carried out all requirements of the California Environmental Quality Act; and WHEREAS, pursuant to California State Law, public hearing notices were transmitted to all property owners within a 300 foot radius of the subject property, and a public hearing was published for a minimum of 10 days prior to the first public hearing in the Press Democrat; and WHEREAS, on July 12, 2001, the Planning Commission held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and, WHEREAS, on July 24, 2001, the City Council held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and, WHEREAS, the City Council of the City of Rohnert Park has adopted the Mitigated Negative Declaration for the proposal; and WHEREAS, the Planning Commission and the City Council of the City of Rohnert Park have reviewed and considered the information contained in the General Plan Amendment application for the proposal; and WHEREAS, the City Council of the City of Rohnert Park makes the following findings: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The City Council, in approving Planning Application PL2001- 035GP /RZ /SR/UP (General Plan Amendment) makes the following findings; to wit: General Plan Amendment PL2001 -035GP 1. That the proposed site is appropriate for development under the General Plan Land Use Designation of Regional Commercial. The proposed Costco project would further the City's goal of seeing commercial development at this underutilized location. It is situated behind 1 commercial developments along Redwood Drive and would be a logical extension of this pattern of development. 2. That the proposed General Plan Amendment would be consistent with specific policies in the Land Use Element of the General Plan relating to regional commercial development. The Land Use Element of the City's General Plan directs that the Regional Commercial designation provide for big -box stores that attract consumers from outside the City. Development of this project would be consistent with this direction. 3. That a duly noticed public hearing has been held to receive and consider public testimony regarding the proposed amendment to the General Plan Land Use Map. Duly noticed public hearings regarding this General Plan Amendment were held by the Planning Commission on July 12, 2001, and by the City Council on July 24, 2001. NOW THEREFORE BE IT RESOLVED, that the City Council does hereby approve Application No. PL2001- 035GP /RZ /SR/UP: General Plan Amendment for 14.45 acres located on the northerly side of the Martin Avenue Extension, west of Redwood Drive (APN 143 -040- 093, -095, and -098) from Industrial and Public /Institutional to Regional Commercial, as depicted on the map attached hereto as (Exhibit "A ") and by reference thereto incorporated herein.
