2001/10/09 City Council Resolution (8)RESOLUTION NO. 2001 -212 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK EXTENDING THE TERM OF THE TEMPORARY DEBRIS BOX SERVICE CONTRACT WITH INDUSTRIAL CARTING TO DECEMBER 31, 2001 WHEREAS, the City is a municipal corporation formed to provide certain services including the collection, recycling, and disposal of solid waste; and WHEREAS, the provision of temporary debris box service by private collection and disposal contractors requires the use of the public rights -of -way for the temporary placing and transportation of debris boxes; and WHEREAS, Chapter 8.12 of the Rohnert Park Municipal Code provides that the City may enter into a contract for the collection and disposal of refuse, garbage, wet garbage and rubbish including the right to maintain a temporary debris box service within the City, and that the City Council may grant such contracts upon such terms and conditions as the Council may deem as in the best public interest; and WHEREAS, the City Council entered into a Temporary Debris Box contract with Industrial Carting dated August 1, 1995, whose term ended June 30, 2001, and was extended through September 30, 2001; and WHEREAS, it is necessary to extend the existing contract through December 31, 2001, to provide staff and City Attorney time to review temporary debris box service contract issues and terms with City Council, and to draft new contract language. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rohnert Park that the Temporary Debris Box Service Contract by and between Industrial Carting and the City of Rohnert Park for the Provision of Temporary Debris Box Service within the City of Rohnert Park is hereby extended to December 31, 2001, subject to the conditions listed below, and the City Manager is authorized to execute this Agreement on behalf of the City. 1. Monthly submission of an accounting of all Temporary Debris Box gross receipts and payment of 10% franchise fee due City within 30 days after the end of each month. 2. Compliance with all terms of the existing Agreement and with all terms of the extension letter, which must be signed by the Contractor.
