1987/05/26 Community Development Agency Resolution (3)RONO0002-13/0029R/kf 05/20/87 RESOLUTION NO. 87-08 RESOLUTION OF THE COMMUNITY DEVELOPMENT AGENCY OF THE CITY OF ROHNERT PARK, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS REGARDING THE LACK OF NECESSITY TO FORM A PROJECT AREA COMMITTEE IN CONNECTION WITH THE ADOPTION OF THE REDEVELOPMENT PLAN FOR THE ROHNERT PARK COMMUNITY DEVELOPMENT PROJECT AND MAKING CERTAIN RECOMMENDATIONS REGARDING THE USE OF AGENCY REVENUES FOR AFFORDABLE HOUSING OUTSIDE OF THE PROJECT AREA WHEREAS, the Planning Commission of the City of Rohnert Park (the "Planning Commission") has selected the redevelopment project area boundaries for the Redevelopment Plan for the Rohnert Park Community Development Project (the "Redevelopment Plan"); and WHEREAS, a project area committee may be formed in connection with the preparation of the Redevelopment Plan pursuant to Health and Safety Cade Sections 33385 and 33385.5, or, if the Redevelopment Plan will not displace a substantial number of low - and moderate -income families, the Rohnert Park Community Development Agency (the "Agency") may find and determine that there is a lack of need to form such a project area committee and the Agency shall thereafter consult with, and obtain the advice of, residents and community organizations in connection with the preparation of the Redevelopment Plan; and WHEREAS, the Agency Staff has determined that the redevelopment project area boundaries as selected by the Planning Commission consist of land devoted to commercial, industrial and residential uses; and WHEREAS, there are currently no redevelopment plans affecting the proposed Project Area for which redevelopment assistance has been requested from the Agency which will require the displacement of any dwelling units; and WHEREAS, the Redevelopment Plan as under consideration is not reasonably anticipated to result in the future displacement of a substantial number of low and moderate income households currently located within the Project Area; and WHEREAS, the Agency deems it appropriate at this time to make certain findings and determinations as to the lack of necessity to form a Project Area Committee for the consideration of the Redevelopment Plan, and to propose such recommendations to the City Council; and - 1 - WHEREAS, the Agency Staff has prepared a certain report dated May, 1987, for the Agency which recommends that the Agency be authorized to make available for use either inside or outside the Project Area certain tax increment revenues for affordable housing. NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE COMMUNITY DEVELOPMENT AGENCY OF THE CITY OF ROHNERT PARK AS FOLLOWS: section I. The Agency hereby finds and determines that: (a) the proposed Project Area contains a large number of residential dwelling units of which only a small proportion are low and moderate income dwelling units and which low and moderate income dwelling units, if any, will be subject to relocation and the Redevelopment Plan under consideration is focused upon the provision of certain public improvements and enhancing the long-term development potential of the community; (b) the draft of the Redevelopment Plan as on file with the Agency does not contemplate any specific development projects which may require any residential relocation or displacement as a result of community development; (c) the established land uses within the proposed Project Area are industrial, commercial and residential and the anticipated uses in the proposed Project -Area shall conform with said designation of established uses; (d) the lands included within the proposed Project Area are blighted and characterized by severe underutilization attributable to such blight, and as a consequence, many owners of land within said area have not been able to devote their land to commercially practical uses; (e) the Agency Staff has made and will continue to make a substantial effort to disseminate information and respond to questions from the community regarding the proposed Redevelopment Plan. These Agency Staff efforts concerning the proposed Redevelopment Plan have included, and will include, contacts with property owners and their representatives. The policy matters which affect the owners of' property, residents and businesses located within the proposed Project Area have been fully disclosed, or will be fully disclosed, through the foregoing contacts within the community; and (f) for the foregoing reasons, the Agency recommends that it is unnecessary for the City Council to call upon residents and existing community organizations to form a project area committee in connection with the consideration of the adoption of the Redevelopment Plan as provided for in Health and Safety Code Sections 33385 and 33385.5. - 2 - Section 2. The Agency further finds and determines that, for the reasons set forth in Section 1 hereof, no state policy as found in the Community Redevelopment Law will be contravened by the failure to form a project area committee by virtue of the nature of the proposed Redevelopment Plan and the scope of public improvement projects contemplated therein. Section 3. The Agency hereby recommends that the City Council dispense with the formation of a project area committee and, in lieu thereof, the Agency together with Agency Staff shall continue to consult with, and obtain the advice of residents and community organizations in the City regarding the Redevelopment Plan in accordance with the procedures as generally otherwise provided for project area committees in Health and Safety Code Sections 33385 and 33386, and shall provide such persons and organizations with the proposed Redevelopment Plan prior to submitting it to the City Council for adoption. Section 4. The Agency hereby accepts the recommendations of the Agency Staff as contained in that certain memorandum dated May, 1987, as prepared by the Agency Staff for the Agency regarding the use of certain Agency revenues for affordable housing either inside or outside the Project Area. The City Council is hereby requested to concur with such recommendations and to authorize the use of such Agency revenues either inside or outside the Project Area. Section 5. The Secretary of the Agency is hereby authorized and directed to transmit a copy of this Resolution to the City Council of the City of Rohnert Park for appropriate action. STAFF REPORT The above -referenced resolution pertains to findings and determinations to be made by the Agency in connection with the adoption of the Redevelopment Plan. Specifically, pursuant to Health and Safety Code Section 33385, et seq., the legislative body must determine whether or not a Project Area Committee should be formed. Such a committee should be formed when it is anticipated that a Redevelopment Plan will cause the relocation of a substantial number of low and moderate income families. Under the Redevelopment Plan for the Rohnert Park Community Development Project, it is not anticipated that there will be any dislocation or relocation of a substantial number of low and moderate income families. Therefore, the Agency may dispense with the formation of a Project Area Committee if the Agency takes certain action to disseminate information regarding the Plan to various community groups and residents. The above referenced Resolution authorizes such action. In addition, the above referenced Resolution makes findings that tax increment revenues may be used outside of the Project Area for the provision of low and moderate income housing. STAFF RECOMMENDATION Staff recommends adoption of the attached Resolution. /0029R
