2016/11/08 City Council Resolution 2016-106RESOLUTION NO. 2016-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING THE WATER TANK #8 PROJECT AND AMENDMENTS TO THE FISCAL YEAR 2016-17 CAPITAL IMPROVEMENT PROGRAM TO ADD THE WATER TANK #8 PROJECT AND RELATED BUDGET AND APPROPRIATIONS WHEREAS, on October 25, 2016, the City Council of the City of Rohnert Park (City) adopted Ordinance Number 900 approving a second amendment to the Development Agreement between the City, University District LLC and Vast Oaks L.P. (collectively "Developer"); and WHEREAS, the second amendment to the Development Agreement requires the Developer to fund and the City to construct a water tank (Water Tank #8) to benefit the University District Specific Plan Area; and WHEREAS, on November 8, 2016, the City Council approved Resolution 2016-105 approving the University District Specific Plan CEQA Addendum — Evaluation of the Water Tank #8 Project (2016 Addendum), which includes mitigation measures from the 2006 Program Environmental Impact Report that are applicable to construction of the water tank; and WHEREAS, the Developer has provided the first deposit of $2,500,000 to the City towards construction of the Water Tank #8; and WHEREAS, Water Tank #8 is a facility that may be eligible for credit under the City's Per Acre Fee program and a Water Capacity Charge program being contemplated by the City; and WHEREAS, the City's adopted Capital Improvement Program for Fiscal Year 2016-17 does not include the Water Tank #8 project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve the Water Tank #8 Project with a budget of $5,000,000. BE IT FURTHER RESOLVED that the City Manager and Finance Director are hereby authorized and directed to amend the Fiscal Year 2016-2017 Capital Improvement Program to include the Water Tank #8 Project with a budget of $5,000,000. BE IT FURTHER RESOLVED that the Finance Director is hereby authorized and directed to receive funding deposits from the Developer and appropriate these funding deposits to the Water Tank #8 Project. BE IT FURTHER RESOLVED that the Finance Director and Development Services Director are hereby authorized and directed to review the funding deposits from the Developer with respect to the City's water system impact fees including the Per Acre Fee and a proposed Water Capacity Charge and provide the Developer with credit as appropriate under these impact fee programs.
