Call to Order, Pledge of Allegiance: Chair Merrick called the regular meeting of the Mobile Home Parks Rent Appeals Board to order at 7:00 p.m. and led the Pledge of Allegiance. II. Roll Call: Present: (5) Chair Merrick, Vice Chair Reymond and Board Members Carlson, Engelhart and Utter were in attendance. Staff Present: Linda Babonis, Housing and Redevelopment Manager III. Approval of Meeting Minutes for the August 4, 2011 Regular Meeting It was moved by Board Member Carlson, seconded by Board Member Utter, and carried unanimously to approve the August 4, 2011, Regular Meeting Minutes. IV. Clerk's Acknowledgement regarding Posting of the Agenda Housing and Redevelopment Manager Babonis confirmed that the agenda had been posted in accordance with the Brown Act. V. Adding Non -Agenda Items for Information Only None. VI. Public Appearances: None. VII. Communications: None VIII. Financial Report: Consideration and Acceptance of 2011 Year to Date Budget Detail Report • Board Discussion /Action Housing and Redevelopment Manager Babonis did not include 2011 Year to Date Budget Detail Report in the Mobile Home Parks Rent Appeals Board Agenda Packet for discussion at the August 4, 2011, Regular Meeting. Proposed Calendar Year 2012 Annual General Adjustment and Budget • Staff report • Public Comment Resolution 2011-01: Review of Proposed Calendar Year 2012 Annual General Adjustment Consideration of the Results of the National Bureau of Labor Statistics in August 2011 as compared to August 2010 • Board Discussion /Action Housing and Redevelopment Manager Babonis provided an overview of the October 6, 2011, Annual General Adjustment and Proposed Calendar Year 2012 RAB Budget Staff Report and Exhibits A through F. This item was moved by Board Member Engelhart, seconded by Chair Merrick, and carried unanimously to approve Resolution 2011-01. Following a brief discussion among Board Members, staff was directed to look into whether the Board has the authority to change the index used to calculate the Annual General Adjustment and if so, to perform research and provide a short report concerning options for the Board's consideration such as the use of an alternative index, a combination of several indexes or an averaging of several months of the National Consumer Price Index ("CPI"), Urban Wage Earners and Clerical Workers, U.S. City Average. 2. Resolution 2011-02: Proposed Calendar -Year 2012 Budget and Annual Revistration Fees Consideration of the Total Estimated Number of Rent Control Spaces Reported by Park Managers and Proposed 2012 Budget Options • Board Discussion /Action This item was moved by Board Member Engelhart, seconded by Board Member Utter, and carried unanimously to approve Resolution 2011-02. X. Matters for/from the Board A. Update regarding status of Tenant Petition 2009-01 (Valley Village Mobile Estates) and scheduling of future Board action. Housing and Redevelopment Manager Babonis provided an update regarding the status of Tenant Petition 2009-01. Babonis asked for Board direction on three items; 1) Authorization to expend funds for City Attorney assistance in drafting a Resolution for Board action on Tenant Petition 2009-01; 2) Direction regarding scheduling of the next meeting; and 3) Direction regarding the desirability of a member of the City's Legal Counsel to be present at a new hearing for Tenant Petition 2009-01. The Board established January 5, 2012, as its next Regularly Scheduled Meeting date. The Board expressed a desire to have Legal Counsel present at a new hearing for Tenant Petition 2009-01. The date for a new hearing has not been determined. XI. Other Public Appearances None. XII. Next Regularly Scheduled Meeting: January 5, 2012, XIII.
