CALL TO ORDER. Chair Engelhart called the meeting to order at 6:00 P.M. 2. PLEDGE OF ALLEGIANCE. Chair Engelhart led the Pledge of Allegiance. 3. ROLL CALL. Present (5): Chair Engelhart, Vice Chair Broadhead and Board Members Carlson, Reymond and Waterman. Staff in attendance included: Alexandra Barnhill, Assistant City Attorney and Jeffrey Beiswenger, Planner III. 4. ACKNOWLEDGEMENT OF POSTING OF AGENDA. Mr. Beiswenger confirmed that the Agenda had been posted in a minimum of three public places: Community Center, Public Safety Building and City Hall (also Senior Center and Rohnert Park Library) in accordance with the Brown Act. 5. PUBLIC COMMENT (ITEMS NOT ON AGENDA). 6. CONSENT CALENDAR. It was moved by Board Member Carlson with a second by Vice Chair Broadhead and carried 5-0 to approve the consent calendar. The consent calendar included the approval of Minutes from October 2, 2014. 7. AGENDA ITEMS 7.1 Consider adoption of a Resolution to Accept the Hearing Examiner’s Final Decision for the Rancho Verde, Capital Improvement Pass-Through Petition (CIPT 2014-01). Mr. Casparian spoke as a representative of the Rancho Verde property owner and petitioner for the capital improvement pass-through. He testified that Exhibit AA- 1 to the Hearing Examiner decision included a cover letter from David C. Spangenberg from April 14 (the first submittal of application materials). Mr. Casparian points out that this exhibit did not include all of the material submitted along with that letter. Mr. Casparian testified that the April 14 letter essentially included the full petition and the materials should be added to this exhibit. Mr. Casparian stated on objection to the phrase in the Resolution that identifies May 27, 2014 as the date of a completed petition and argues that petition was Minutes, Thursday, December 4, 2014 completed in late April. Mr. Casparian points out that the CIPT cannot be implemented on February 1 as suggested by the Resolution, regardless of any appeals. The State requires a 90-day notice period prior to any rent increase. Other than those inaccuracies in the resolution, Mr. Casparian agrees with the determination that the hearing examiner decision should be accepted. Ms. Kirby of 505 Corte Naranja testified that Phase 1 was not completed in a timely matter and that no loan documents were provided and that the Hearing Examiner was correct in taking those factors into consideration in the decision. She pointed out that Mr. Bates was paid a significant sum of money for only two weeks of work and that should have been taken into account. Ms. Kirby also testified that she felt that the petitioners had some misleading information in the application. Ms. Hernandez of 314 Corte Rayado said that a rent increase would be a hardship on her household budget and pointed out that it would be on top up the annual increases in rent. The roads were in relatively good condition and the improvements were not really needed – especially the second part of the work. Mr. Trujillo of 509 Corte Naranja testified that the road improvements were already cracking in some places. Mr. Trujillo submitted photos to Mr. Beiswenger that had been taken by a neighbor. Motion by Reymond with a second by Broadhead to adopt Resolution 2014- 07. Chair Engelhart open up the item for Board discussion. Board member Carlson commented on the proceedings relating to the Capital Improvement Pass-through and emphasized how important it is to follow the proper procedures for these types of applications. Chair Engelhart call for a vote and Resolution 2014-07 was adopted 5-0. 8. ITEMS FROM THE BOARD 9. ITEMS FROM THE STAFF 10. SECOND PUBLIC COMMENT PERIOD (ITEMS NOT ON AGENDA). None. 11. NEXT REGULARLY SCHEDULED MEETING. Mr. Beiswenger pointed out that next regularly scheduled meeting would fall on Thursday, January 1, 2015 - New Year’s Day and suggested that this meeting could be cancelled. The next meeting would then fall on Thursday, February 5. Any appeal of the Rancho Verde, Hearing Examiner decision would occur on this date. Motion by Carlson with a second by Reymond to cancel the January 1, 2015 meeting and carried 5-0 to hold the next Board meeting on February 5, 2015 12. ADJOURNMENT. Chair Engelhart adjourned the meeting at 6:45 P.M.
