A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT
PARK AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF
UNDERSTANDING WITH COUNTY OF SONOMA FOR MITIGATION OF FIRE AND
EMERGENCY SERVICES IMPACTS ASSOCIATED WITH THE GRATON CASINO
FOR FISCAL YEARS 2016-17 THROUGH 2019-20
WHEREAS, the Federated Indians of the Graton Rancheria operate a casino outside of the
City of Rohnert Park area; and
WHEREAS, in October 2012, the County of Sonoma approved an Intergovernmental
Agreement with the Federated Indians of the Graton Rancheria which includes provisions for
recurring payments to mitigate the casino's impacts on fire and emergency services; and
WHEREAS, County of Sonoma's Intergovernmental Agreement mitigation payments are
administered through the County Department of Fire Services; and
WHEREAS, on December 6, 2016, County of Sonoma authorized its Fire and Emergency
Services Director to execute a four-year agreement with the City of Rohnert Park to distribute
Sonoma County's Graton Mitigation Fund fire monies for Fiscal Years 2016-2017 through 2019-
2020.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert
Park that it does hereby accept the County of Sonoma's Graton Mitigation Fund distribution for
Fiscal Years 2016-2017 through 2019-2020;
BE IT FURTHER RESOLVED that the City Council of the City of Rohnert Park hereby
approves the Memorandum of Understanding between the City of Rohnert Park and the County of
Sonoma, attached hereto as Exhibit A, and authorizes the City Manager to execute the
Memorandum of Understanding and related documents on behalf of the City; and
BE IT FURTHER RESOLVED that the Director of Finance is authorized to make any
budgetary adjustments necessary to process the distribution.

MEMORANDUM OF UNDERSTANDING
MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF SONOMA AND THE CITY OF ROHNERT
PARK FOR MITIGATION OF FIRE AND EMERGENCY SERVICES IMPACTS ASSOCIATED WITH THE GRATON
CASINO FOR THE FISCAL YEARS 2016-17 through 2019-2020.
WHEREAS, the County of Sonoma ("County") and the City of Rohnert Park ("City") have a mutual interest
in effective fire and emergency services to serve the citizens of Sonoma County and the visitors to
Sonoma County; and
WHEREAS, the County has reached an intergovernmental agreement ("Agreement") with the Federated
Indians of the Graton Rancheria ("Tribe"), the owners of the Graton Casino, to mitigate, among other
things, the impacts of the casino on fire and emergency services borne in part by the City; and
WHEREAS, the Agreement names the affected fire and emergency service providers as Central Fire
Authority of Sonoma County, Rancho Adobe Fire Protection District of Sonoma County, the City of
Rohnert Park Department of Public Safety, and the County fire services; and
WHEREAS, the County has conferred with representatives of the City and other fire and emergency
services providers named in the Agreement for the purposes of best mitigating the impacts from the
casino on all the fire and emergency services providers named in the Agreement; and
THE PARTIES TO THIS MEMORANDUM OF UNDERSTANDING HEREBY AGREE:
1. For Fiscal Year 2016-17, the County will distribute a total of Fifty Thousand Dollars ($50,000), to
the City. The County will use reasonable efforts to pay each installment within 10 days of
receipt of the relevant quarterly payment to the County under its Agreement with the Tribe.
2. For each subsequent fiscal year, the amount will be adjusted in accordance with the Consumer
Price Index, as determined in the Agreement.
3. While the City has complete authority to expend these funds to best mitigate the casino's
impacts on fire and emergency services borne by the City, the total of $50,000 was mutually
determined based on the following amounts identified for the following purposes:
a. $50,000 to be set aside for equipment replacement.
4. The City will cooperate with the County to provide information on how the monies provided to
the City under this memorandum of understanding are spent in the event that the County is
asked to provide information on the uses of these funds.
