2017/06/27 City Council Resolution 2017-079RESOLUTION NO. 2017-079 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AFFIRMING COMPLIANCE WITH THE STATE SURPLUS LAND ACT WHEREAS, the City Council of the City of Rohnert Park, is a municipal corporation and general law city duly organized and existing under and pursuant to the Constitution and laws of the State of California ("City"); and WHEREAS, the San Francisco region has the highest housing costs in the United States; WHEREAS, the Bay Area produced less than 30% of the need for low- and moderate - income housing units from 2007-2014; and WHEREAS, there are limited funding sources available to secure land for the construction of low- and moderate -income housing; and WHEREAS, public lands can play a critical role in increasing the supply of land for affordable housing; and WHEREAS, the Surplus Land Act, Government Code Section 54220, et seq., provides in part that prior to disposing of surplus land, a local agency, such as the City of Rohnert Park, shall send a written offer to sell or lease the land to certain entities, including local agencies in whose jurisdiction the property is located, and housing sponsors, as defined in Health and Safety Code Section 50074, for the purpose of developing low and moderate income housing on such property; and WHEREAS, by providing such written offers, the City assists in making land available for the construction of affordable housing; and WHEREAS, the Metropolitan Transportation Commission (MTC) adopted a resolution, outlining the programming policy and project selection criteria for the One Bay Area Grant Program (OBAG 2), including the requirement that a local agency that applies for grant funding under the OBAG 2 program adopt a resolution demonstrating that it will comply with the Surplus Land Act; and WHEREAS, the City of Rohnert Park is a general law city and complies with the general laws of the State of California, including the Surplus Land Act; and WHEREAS, the City is currently applying for a MTC OBAG 2 grant and in the future may apply for additional OBAG program funds and wishes to certify that any disposition surplus land undertaken by the City of Rohnert Park has and will continue to comply with the State Surplus Land Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK RESOLVES that the City of Rohnert Park affirms that it complies and shall comply with the terms of the California Surplus Land Act (California Government Code § 54220, et seq.), as it now exists or as it may be amended in the future.
