Box 3935 . Santa Rosa; CA 95402 ® (707) 585-0511 ROHNERT PARK RESOURCE RECOVERY RESPONSES TO DISADVANTAGES 1) MIXTURE OF OLD AND NEW VEHICLES The City did not require new vehicles in the RFP. However, the City did require that vehicles last the life of the contract, with the understanding that the City did not'want to pay for additional trucks during the life of the contract. As a result, we have proposed to purchase late model vehicles that will last the life of the contract and have an already established comprehensive preventative maintenance program. If any truck needs to be replaced during the life of the contract, the R3 partners have guaranteed to the City that they will not require the City to pay for replacement trucks. 2) NEW GROUP THAT HAS NOT WORKED DIRECTLY TOGETHER The R3 partners have worked together directly for over 45 years. They currently work together in joint marketing and transportation of recyclable materials. Also, over the past 45 years they have worked together on all aspects of solid waste and recycling programs. In fact, the R3 partners worked together servicing the City of Rohnert Park before it was incorporated as a City. Further, the R3 partners have worked together beginning in the 1970's through the early 1990's. Together they serviced the unincorporated area of Sonoma County from south Santa Rosa to Bodega Bay. The services provided were residential and commercial refuse and recycling services. Additionally, the R3 partners were the initial contractors who started the Occidental Transfer Station and the Guerneville Transfer Stations where they transported compactors and transfer trailers to the Central Landfill daily. In the late 1980's the City of Santa Rosa gave the R3 partners notice that a significant number of customers were annexed to the City of Santa Rosa and therefore the R3 partners would lose this customer base within months of the annexation. As a result the R3 partners were forced to diversify into other business ventures to sustain their current operations. Consequently, one of the R3 partners, Harry Hardin moved to Humboldt County to own and operate Eel River Disposal & Resource Recovery, and became Humboldt County's leader in recycling. Curtis Michelini and Charles Hardin continued to service commercial and industrial accounts that were open to competition in Sonoma County. Industrial Carting has distinguished themselves as one of the leading recyclers in Sonoma County servicing over 80,000 recycling buy back customers annually. Page 2 Rohnert Park Resource Recovery Consequently, the combination of EelRiver Disposal and Resource Recovery and Industrial Carting gives R3 additional strength in terms of recycling markets, staffing and financial resources and equipment acquisition. 3) WOULD REQUIRE CONTRACTOR TRANSITION R3 as the new contractor for the City would require a transition period. However, R3 is experienced in going through that transition process from other projects, such as the start up of the unincorporated area of Sonoma County, the Mare Island Naval Facility operations in -Vallejo and Eel River Disposal and Resource Recovery's operations in Humboldt County. R3 has provided a detailed timetable to the City in their proposal on how R3 will accomplish this transition. A transition period would be required for any contractor other than Empire Waste Management. 4) POTENTIAL EMPLOYEE TRANSITION ISSUES R3 has committed to offering employees of the current contractor, Empire Waste Management the first opportunity to work for R3 in servicing the City of Rohnert Park's contract. 5) FACILITY NOT IN PLACE; NO SPECIFIC SITE IDENTIFIED R3 has identified two sites in the proposal that are currently in place, permitted and currently in operation. R3's primary site for recycling processing is a five -acre site less than one mile north of Rohnert Park in Santa Rosa. Also, the R3 partners own a 20 -acre site about one mile west of Rohnert Park on Taylor Road. This site is used for other salvaging and storage activities. R3 plans to expand recycling activities at the Santa Rosa site and add vermicomposting activities on the 20 -acre Taylor Road site. Although, the sorting equipment for processing recyclables needs to be added to the Santa Rosa site, the facility is in place and fully equipped with industrial balers, shredders, conveyors and buildings to accommodate the recycling operations. Pictures and site plans of the 5 -acre Santa Rosa site are provided in the proposal. R3 has contacted sorting equipment vendors and they have assured us that the equipment needed for the Rohnert Park project can be delivered in time for the July 1, 2001 startup. In addition, R3 outlined several contingency plans for processing recyclables in our proposal to assure the City that R3 would recycle everything possible that is collected from Rohnert Park, even if the sorting equipment is not in place by July 1, 2001. (See attached site plan). Page 3 Rohnert Park Resource Recovery 6) PERMANENT STAFFING NOT IN PLACE AND POTENTIAL DRIVER AND EMPLOYEE TRANSITION ISSUES The initial staffmg.and transition team is in place for this project. R3 is assigning the top management staff of the R3 companies involved to work full time on the implementation of the Rohnert Park project. In addition, R3 has committed and budgeted for a General Manager to work exclusively for the Rohnert Park project. Also, R3 has committed to hire staff, consultants and subcontractors that are experienced to perform the solid waste and recycling services as required by the City of Rohnert Park's contract. The R3 management team is committed to devoting 100 percent of their time initially to the Rohnert Park project are Ernie Carpenter, Curtis Michelin, Lisa Hardin, Charles Hardin, Harry Hardin, Harry Hardin, Jr. and Les Gaut. Further, the transition of employees would be required for any contractor other than Empire Waste Management. 7) RECYCLING PROCESSING FACILITY WOULD REQUIRE UPGRADES FOR SINGLE STREAM RECYCLING R3's recycling processing facility would require minimal upgrades for single stream recycling. R3 previously indicated in response number 5 above that there are detailed plans to accomplish the upgrades in a timely manner and contingency plans are described in the proposal for any issues which may arise. R3 will process all recyclables. collected and maximize the diversion of recyclables from the landfill. 8) NO STREET SWEEPING EXPERIENCE Eel River Disposal and Resource Recovery does have experience with street sweeping that was highlighted in the R3 proposal which identified the equipment proposed and in the R3 interview on January 8, 2001. Eel River Disposal and Resource Recovery provides limited street sweeping services to Municipal and commercial customers in Humboldt County and owns the necessary street sweeping equipment to perform the City of Rohnert Park's street sweeping services. However, as street sweeping is not one of R3's primary business activities, R3 tried to convey in the proposal that they may subcontract the street sweeping services. Attached is the'information regarding R3's preferred street sweeping subcontractor, Tauzer Street Sweeping who has 27 years of experience in the street sweeping industry. Page 4 Rohnert Park Resource Recovery 9) RELATIVELY HIGH NON -GUARANTEED RECYCLABLE REVENUES Under advantages it was noted that R3's cost is "predicated on relatively high non -guaranteed recyclable revenues." The average revenue for recyclables that R3 assumed was $70 per ton, which is the actual level of revenue R3 has obtained for the past several years. R3 is confident that this revenue projection is accurate. In addition, as R3 understands the economic structure that the City has designed, R3 absorbs the risk of market revenues. If revenues are not as high as projected R3 does not expect the City to pay R3 more, any revenue shortfall would just decrease the amount of R3's profits. As a local firm, R3 understands that risk and is prepared to assume this responsibility. Also, highlighted in the Introductory Staff Report On Proposals For Solid Waste Services of the other firms' advantages the following was noted: 1) Green Team — "No significant litigation issues" R3 also has "No significant litigation issues". 2) Green Team — " Includes textiles as additional curbside recyclable materials" R3 will also provide textiles as additional curbside recyclable materials. In addition, R3 proposed to collect the following materials through drop off and clean-up programs that were beyond the scope required by the City: • Wood Waste • Mixed Construction & Demolition (C& D) Debris • Wallboard (Sheetrock) • Used Building Materials • Used Unpainted Lumber • Pallets 0 Electronics Page 5 Rohnert Park Resource Recovery Also, R3 proposed to collect food waste and food packaging curbside as an option for a price to be negotiated. Further, R3 proposed that "if there is any waste prevention, recycling or composting opportunity to be found R3's team will find them and successfully implement programs to meet those challenges throughout the life of this contract". 3) NORCAL — "Detailed diversion plan" R3 also has a detailed diversion plan outlined in the proposal. 4) North Bay Corporation — "Sonoma County and northern California experience" R3 also has Sonoma County and northern California experience. 5) North Bay Corporation and Empire Waste Management — "Exceptions taken to the agreement" This is noted as a disadvantage for North Bay Corporation and Empire Waste Management. This should be noted as an advantage for R3 since there are NO EXCEPTIONS to the agreement by R3. 6) Empire Waste Management — "Residential food waste program option" R3 also proposed a food waste and food packaging curbside option as described above. R3 also proposed two options for commercial food waste programs to: 1) collect food waste from businesses for vermicomposting and 2) provide the service of leasing and managing on site food waste composters. Finally, the Introductory Staff Report On Proposals For Solid Waste Services reflects Curbside Christmas Tree Recycling (City Option Service) as missing. As stated in the fax message to David Langer on January 4, 2001, Janine Barnes with Boyle & Stoll, CPA explained, that R3's cost proposal Attachment 6Y was "Based on proposal assumptions, no additional expenses anticipated". The proposal by North Bay Corporation offers the following compelling advantages to the City of Rohnert Park: • 14.6% reduction in existing rates • First year savings of $535,158 • Predictable, stable rate structure e Comprehensive service package • Compliance with AB939 requirements • Seamless transition • Responsive, knowledgeable management • All required facilities in place • Reliable, efficient fleet o Proposal responsive to City contract requirements RATE REDUCTION North Bay Corporation's suggested rate structure provides for a 14.6% rate reduction in the first year (see attachment A). This results in a first year savings of $535,158. Over the life of the Agreement, ratepayers will save over $4,000,000. 1 0 Printed on Recycled Paper North Bay Corporation's rates are predicated upon realistic and conservative revenue estimates. This management approach ensures our ability to meet the assumptions set forth in our proposal. This also provides North Bay Corporation the ability to guarantee the rate structure throughout the life of the contract, as outlined in our proposal, without requiring a costly rate review process. As stated in our interview of January 8, 2001, North Bay Corporation is willing to enter into an agreement with the City of Rohnert Park which limits rate increases over the life of the agreement to 75% of increases in the Consumer Price Index plus pass-through of tipping fee increases. COMPREHENSIVE SERVICE PACKAGE/AB939 COMPLIANCE North Bay Corporation's proposal provides for the most comprehensive service package in all of Sonoma County. This proposal will enhance Rohnert Park's commitment to meet and exceed state mandated diversion of 50%. Elements include weekly automated refuse collection with choice of cart sizes 20, 32, 68, or 95 gallon, weekly automated single stream recycling, weekly automated green waste collection, weekly curbside oil and filter collection, aggressive multifamily and commercial recycling programs, annual curbside Christmas tree collection, a local processing facility for diversion of mixed construction and demolition debris and an ambitious program of public education and outreach. We are currently seeking County approval of permits to expand capacity of an existing construction debris processing facility on Todd Rd. near Stony Point. This facility will be the first of its kind in Sonoma County. Diversion of construction and demolition debris from the Rohnert Park waste stream is required for the City of Rohnert Park to meet the goals of AB939. TRANSITION Our entire team, including drivers, office staff and management, has recent, local transition experience. As the result of a similar competitive bid process in the Town of Windsor we successfully and seamlessly took over serving that town from Empire Waste Management. Within a period of four weeks we acquired and distributed new refuse and recycling containers to approximately 6,000 single-family, multi -family, mobile home park, and commercial customers. Meeting all scheduling and performance requirements, we commenced full service to all customers on January 1, 1998. This feat was accomplished in a matter of 180 days between execution of contract and commencement of service. All key personnel involved in the Windsor transition are still employed in our Company and will be assigned to the Rohnert Park transition guaranteeing success. 2 MANAGEMENT North Bay Corporation currently provides solid waste removal and recycling services to numerous communities throughout California. North Bay Corporation is a local, family owned, independent company with a proven record of providing excellent, dependable service for over 20 years. We are financially sound and will not require outside financing to secure the equipment necessary to provide service to Rohnert Park. North Bay Corporation's management participates in countywide development of solid waste and recycling policies through involvement in the Sonoma County Waste Management Agency and the AB939 Local Task Force. Our management team constantly strives to understand the local governmental, political, social and natural environment and is committed to building cooperative, results oriented relationships. ALL REQUIRED FACILITIES IN PLACE North Bay Corporation's processing facility in Santa Rosa can accommodate materials collected within Rohnert Park at the commencement of the Agreement. Additionally an upgrade of the facility will be undertaken to further enhance the efficiency of operations. North Bay Corporation has a secondary processing facility available in Petaluma to provide any required back up of processing capabilities in the event the need should arise. We currently processes over 5,000 tons of recyclables per month at our Santa Rosa plant. Recyclables are processed for all of our collection companies. We also have contracts with other non -owned hauling companies in Sonoma and Marin Counties. These contracts, which have been in place for over 5 years, provide for recyclable processing of their material. RELIABLE, EFFICIENT FLEET North Bay Corporation will utilize a fleet of vehicles, which are fully capable of collecting all solid waste and recyclables generated in Rohnert Park. All vehicles undergo a complete mechanical refurbishing and are repainted. This concept of reuse is consistent with the spirit of AB939. This represents a significant cost savings to ratepayers. Technology for alternative fuel solid waste vehicles is still in its experimental stages and is evolving rapidly. North Bay Corporation is willing to utilize alternative fuel vehicles at such time as the technology improves to the point of providing required dependability and reliability. North Bay Corporation believes it would be imprudent, at this juncture, to invest heavily in new vehicles only to have their use discontinued in, the near future. PROPOSAL IS RESPONSIVE TO CITY CONTRACT REQUIREMENTS The City of Rohnert Park is assured of its full authority to manage and control all matters relating to solid waste and recycling. Exceptions were discussed during the interview with staff and consultants. A significant issue raised by staff has been clarified in a letter to the City Attorney (see attachment B). North Bay Corporation believes that this written response eliminates stafff s concerns. Additional issues identified in the proposal from North Bay Corporation are minor. North Bay Corporation is willing to enter into the Agreement as proposed by the City. During your staffs report to the City Council Subcommittee on January 12, 2001 each proposal was set forth in a Advantages/Disadvantages format. It is hoped that the information presented above addresses both categories. STAFF PERCEIVED DISADVANTAGES For added clarity, we offer the, following specific responses and/or explanations: 1. "Would require contractor transition" By definition, a competitive bid process has this result. Transition is not a negative but an unavoidable event to achieve substantial public benefit in the form of reduced rates and enhanced service. As explained above, our experience and record in Windsor eliminate this concern. 2. "Potential employee transition issues" As in Windsor all current employees of Waste Management will be invited to apply for employment by North Bay Corporation. 3. "Old vehicles proposed" Vehicle fleet will be attractive, efficient, and mechanically sound. Consistent with the reuse philosophy set forth in AB939, North Bay Corporation achieves efficiency and cost savings through effective extension of fleet life. Vehicle age is deceiving since it really only indicates the date a vehicle was placed in service as opposed to vehicle condition. Capitalizing purchase of new vehicles locks in traditional vehicle fuel type preventing the possibility of adapting the fleet to new fuel technologies. .19 4. "Will require developing a single stream processing capability" North Bay Corporation's current recyclables processing facility will be adapted to single stream processing. This upgraded facility allows more refined separation of recyclables creating higher value. 5. "Exceptions taken to the Agreement" North Bay Corporation is prepared to enter into the Agreement as proposed by the City of Rohnert Park as stated in our January 9, 2001 letter to City Attorney Betsy Strauss (attachment B). Beyond this concern, we would reiterate our agreement that all processing charges levied by affiliated companies must be consistent with industry standards, and this determination can be readily made without analysis of financial statements. In the final analysis, it is these charges that influence rates. Other information contained in financial data is not directly pertinent to this determination. North Bay Corporation has provided the City of Rohnert Park with an excellent proposal for services at a substantial savings in comparison to existing rates and the pending increase by the City's current contractor. Under our suggested rate schedule and rate setting methodology, the number of rate reviews during the life of the contract would be limited to one. Moreover, as stated during our interview, North Bay Corporation is willing to eliminate rate reviews altogether and implement a CPI/Tip Fee escalator for the life of the contract. This latter approach would eliminate the need to review any additional financial data, bring stability and dependability to rates, and avoid costs associated with rate reviews. Please allow us to elaborate: NO CONTRACT TRANSITION Except for the addition of new containers for single stream recycling, your constituents willexperience no inconveniences in the transition to a new contract. We consider this a significant advantage that can be offered by no other proposer. The drivers servicing Rohnert Park average over 20 years experience in service to your city. Exciting new recycling services will be implemented with ease because of their extensive familiarity with the routes, their customers and any site anomalies. FACILIT_Y._IN PLACE EWM has been operating a Material Recovery Facility in this County since the 70's. It is presently being renovated to respond to single stream recycling in Rohnert Park and other jurisdictions that it serves in Sonoma County. No other proposer is at this stage of development. Please refer to Proposal Binder for copy of site plans. LOCAL, STATEWIDE and NATIONAL EXPERIENCE While EWM has an excellent reputation locally, it is the only proposer that also brings national experience. This is significant because of the recycling markets that are made available to Rohnert Park. This, in turn produces the highest revenue for recyclable materials. There are also other advantages that will add to Rohnert Park's success in reaching your recycling goals: CNG VEHICLES In a recent Rohnert Park survey, over 70% of the customers responding it was important for the City of Rohnert Park to encourage the use of clean fuel trucks. EWM is the only company to propose using Compressed Natural Gas (CNG) Vehicles for collection. We have been discussing this option with the County of Sonoma for several months. We will fuel our vehicles at their bus storage facility across the street from our Standish Avenue site. APRIL 1 SINGLE STREAM START DATE EWM has offered to begin residential single stream curbside recycling as early as April 1, 2001. This would make the City the first in Sonoma County to adopt this program that has been demonstrated to increase diversion. ONE DAY SERVICE EWM offered to provide residential services, refuse, recycle and yard waste all on the same day. This would limit the impact of truck traffic, noise, and containers on the streets in the neighborhood to only one day a week. SINGLE STREAM MID EXPERIENCE With Rohnert Park's unique Multi -Family Dwelling (MFD) population, this is a critical component of your new contract. Presently, approximately 70% of MFD's in RP are served with a recycling program provided by EWM. Single Stream will increase this volume because it is more convenient. It will also be more easily provided to the remaining sites. For several months, EWM has run an MFD pilot project at 31 sites in Santa Rosa. We know how to implement it and monitor it and the kind of on-site education that is necessary for success. ELECTRONIC SCRAP RECYCLING EWM is the only proposer to offer this new, innovative program. It will immediately make a difference and the difference can grow as our lives incorporate the increased use of electronic equipment. RESTAURANT FOOD WASTE PROGRAM While our "advantages" call out our proposal on residential food waste, it does not note that there is a very successful restaurant food waste project in Rohnert Park provided by EWM. Our experience in this pilot will allow us to continue this program. t STATE OF THE ART VEHICLE TECHNOLOGY EWM proposes to use front loaders with work buckets. There is a definite advantage to this technology as it allows the driver to observe the contents of each single stream container and immediately respond to contamination as opposed to spot audits. This is part of our education outreach process that happens daily on the route. We also note that there are a number of "advantages" that are listed for other proposers that also specifically apply to EWM as well. These are: TEXTILES EWM specifically includes curbside pick up of textiles by our local partner Goodwill Industries. Partnering was encouraged. EWM explains how the collection will occur. This program will also bolster the local economy as it provides jobs for clients of this local non-profit. DEMONSTRATE CREATIVE, INNOVATIVE SOLUTIONS EWM believes that the additional programs that it proposes such as the historical horse and cart, electronic scrap recycling, its partnering with Goodwill Enterprises on textile collection, its curbside food waste proposal are all innovative and creative ideas to assist Rohnert Park in its goals. NEW VEHICLES BEING PROPOSED EWM is proposing new vehicles in Rohnert Park. Our proposal reflects a number of new vehicles including Compressed Natural Gas Vehicles (CNG.) DIVERSION PROGRAM DESCRIPTIONS DID NOT DEMONSTRATE INSIGHT TO THE PROBLEMS of the PAST Rohnert Park's most significant issue is its MFD/Commercial recycling. We believe our proposal reflects EXACTLY what we have learned in our pilot project in Rohnert Park and Santa Rosa and the changes that need to be made in your City. Single Stream will allow us to provide recycling to the difficult service areas we have experienced in the past. SPECIFICS of EDUCATION and OUTREACH PROGRAM DO NOT SHOW HOW THIS WILL ACHIEVE 50% The education and outreach programs are specifically directed to incorporating single stream recycling in Rohnert Park's diversion program. Our company's experience in Single Stream recycling has achieved up to 65 % diversion in various service types. We have incorporated the program's necessary in achieving AB 939 diversion of 50% as set forth by the Sonoma County Waste Management Agency dated November 6, 2000. EXCEPTIONS EWM did not take exception to the minimum amount of revenues. EWM was confused and has only requested clarification. At the interview, EWM was asked if binding arbitration was a "dealbreaker, " The answer was no. EWM states that they are very willing to indemnify the City of Rohnert Park related to AB 939. Clarifications were asked regarding interpretations of AB 939. EWM believes it is to the City's advantage also to clarify these issues and does not anticipate that they will be difficult to negotiate. The City acknowledges that the Draft Agreement is "a proposed Draft Agreement only... The final agreement will be negotiated following the selection process. Any item in this Draft Agreement is subject to change. " Since the City reserves that right to further change the Agreement, it is only reasonable to anticipate that the selected proposer has the right to negotiate based on the final document. Together they serviced the unincorporated area of Sonoma County from south Santa Rosa to Bodega Bay. The services provided were residential and commercial refuse and recycling services. Additionally, the ERDRR and IC principles were the initial contractors who started services for the Occidental and Guerneville Transfer Stations. The Occidental Transfer Station contract consisted of transporting a full compactor from Occidental to the Central Landfill weekly. Further, the principals formed a joint venture in 1984 called ISCO Transportation. This joint venture specifically operated the Guerneville Transfer Station, which provided a disposal facility for residents in the Guerneville area. Once the transfer trailers were loaded by ISCO employees, the trailers were transported daily to the Central Landfill. 3) None of the parent companies have litigation issues to report. P.O. We currently service nine city and county contracts and operate the only independent transfer station in the county. The results of competition have not been easy for our competitors, but we believe our customers are very satisfied with the innovative services we offer. 6) R3's intentions are to identify and acquire late model trucks no older than five years. Please refer to the attached equipment list. 7) The completed information in Appendix 6T is attached. 8) The site plan and processing flow diagram for our corporation yard and recycling facility was attached to our Proposal as Attachment V. A new building will be added immediately to the west of our existing Hi -Grade Paper Baling and Shredding area. We will be purchasing a Rightway Model RS -900 portable commingled recycling system (attached information was also included in our Proposal) for processing the recyclable materials from the City of Rohnert Park. This Rightway commingled recycling system will be placed in this new building. The final design of this facility will be completed once the City has determined which approach it wishes to take regarding source separation. The permitting of this facility will be a top priority for us to pursue immediately upon Council award of the contract (as noted in our Implementation Plan on page 55 of our Proposal). Our Government Affairs Manager, Ernie Carpenter, will work with the City of Santa Rosa Planning Department to obtain the necessary permits. The equipment will be ordered concurrently with the permitting process, so that equipment delivery car! be made in time for operations to begin on July 1, 2001. As soon as.permits are received, we will begin paving the additional areas of our facility. Once the area is paved, the equipment will be installed. If done after July 1, 2001, the building will be constructed around the equipment, primarily during off -hours from processing of the new materials from Rohnert Park. The new building will be constructed in a style consistent with the existing buildings on site. Page 4 City of Rohnert Park Refuse, Recyclable and Compostable Material And Other Services The expanded covered recycling building at the MRF in Santa Rosa is unlikely to be fully completed by July 1, 2001. However, we plan to have the sorting line equipment operating fully and will add four employees to assimilate the recyclables generated from the City of Rohnert Park. We anticipate the recycling facility building to be completed by December 31, 2001. We have also highlighted several contingency plans for MRF processing in the event of greater difficulties than expected (see pages 37-38 of our Proposal). 9) No. The startup costs will be borne by the joint venture partners and are not included in the first year costs. Therefore, there will no impact in subsequent years. 10) R3 will expand upon the current clean-up event and train staff to source separate all recyclable and reusable materials, such as clothing, appliances, furniture and building materials. In addition, all reusable materials will be stored for community non profit groups. R3 will coordinate with the community non profit groups to deliver reusable materials or assist the groups picking up the reusable materials (see page 32 of our proposal). 11) Temporary debris box costs are higher for the comprehensive contract than the stand alone contract by $103. This difference is attributed to the overhead allocations in our cost model. 12) The basis for calculating revenues from recyclables is attributed to the actual experience of the joint venture partners. The fact that this may be higher than typically found when waste haulers operate recycling programs is a good example of the benefit of selecting R3. Because of R3's experience in collecting and sorting materials for premium markets, and because of R3's long-established relationship with markets, R3 may be able to command a higher price for commodities than others may be obtaining. 13) R3's experience for yard waste service is based upon ERD's composting of food and yard waste for vermicomposting. The pros for bi-weekly yard waste service is lower operating costs, less time onthe road and consequently, less exposure to liability, increased density of material collected, less traffic congestion and disruption in neighborhoods Page 5 City of Rohnert Park Refuse, Recyclable and Compostable Material And Other Services by numerous weekly collection trucks. They have historically achieved substantial economic advantage by acquiring late model used trucks that meet their rigid standards for reliability and safety. For the Rohnert Park contract, they will acquire vehicles such as White trucks with Heil bodies in both the automated side loader configuration and the front loader configuration. These vehicles are the standard in the Industry and have useful lives with regular maintenance of 15 years. Attached is a list of the equipment proposed for the Rohnert Park contract as well as the activity for which it will be used. R3 has proposed appropriate spare vehicles by activity. Should the need arise, the joint venture partners have additional spare. vehicle capability beyond any reasonably anticipated need located in Santa Rosa or three hours away in Fortuna. Our proposal includes the costs of the proposed spare vehicles. Should the need arise, the additional spares will promptly be made available at no additional cost to the City. Correction to form 6T, column F: Column 6F vehicles should read, one vehicle and one spare. The number of drivers is correct. Source of recycling tonnages, form 6T: R3 is mindful of the proposed AB939 Plan for Rohnert Park found on page 7 and is committed to achieving these goals. The cost proposal is responsive to the diversion levels anticipated by the Plan. Specifically, form 6T calls out residential tonnages that are consist with the Plan. The Plan calls for residential recyclables of 3,700 tons, bulky goods of 25 tons, variable can rates resulting in 90 tons, and multi -family of 850 tons. These amounts total 4,665 tons, rounded to 4,750. The commercial recycling amounts proposed by the Plan include 1,461, variable rates resulting in 29 tons, recycling plans resulting in 2,750 tons and cardboard drop-off locations of 250 tons. Please find the responses to the questions asked during the interview. 1) Customer Service During the first six months of the contract R3's business manager will work closely, with City staff to monitor and make any changes to the customer service program desired by the City. R3 will enhance their current phone system by adding three permanent phone lines dedicated to the Rohnert Park contract. The four existing incoming lines will be used for overflow calls. All incoming calls will be answered by the third ring. Further, R3 will install Pacific Bell's Call Transfer Disconnect service which will enable R3 to transfer calls to City staff (see Attachment W of proposal for Call Transfer Disconnect information). R3 will implement a self monitoring system to ensure wait times are no longer than two minutes and busy signals are minimal. The self monitoring will occur daily for the first six months of the contract. Any deficiencies will be corrected promptly to ensure customer satisfaction. R3 has budgeted for three full time customer service representatives to service the Rohnert Park contract. R3's existing six full time customer service representatives will act as backup staff for overflow calls. Customer response times will occur no later than the end of the following workday. However, the customer will be contacted with a status report by the end of the business day. P.O. This communication will occur prior to the driver returning to R3's facility. The optimum solution is for the driver to pickup the missed customer before returning to the R3 facility. R3 requires all drivers to check in with dispatch by two-way radio prior to returning to the R3 facility at the end of the day. Should the communication of the missed pickup occur after the driver has returned to the R3 facility, the driver will be dispatched to service the missed pickup by the end of the following workday. R3 customer service representatives will complete a change form when customers call to change their service type. The change form will be entered in the City's accounts receivable system for billing purposes and on the route management system for the generation of route books and reports. Service changes will occur within one week of the service change. R3 is committed to delivering the highest quality of customer service and recognizes personal contact with its customers offers greater customer satisfaction. As noted on page 58 of our proposal, the R3 employee who first responds to a customer's request will track each customer through the system to minimize the "runaround". R3 will establish a web site to communicate with customers 24/7. Further, R3's current office hours Monday to Friday 7 AM — 5 PM and Saturday 8 AM — 5 PM provide customers with flexibility and convenience. 2) Street Sweeping R3 is prepared to provide weekly street "sweeping services of all streets, island gutter, noses and bi-weekly sweeping of all City bike paths and public parking lots. R3 has budgeted one employee working approximately 40 hours per week to complete the proposed street sweeping services. In the event, R3 requires additional assistance; a subcontractor will be used to continue the contracted services. R3 will maintain overall responsibility for the subcontractor. R3's preferred subcontractor for street sweeping is Tauzer Street Sweeping, a locally owned commercial street sweeper with 27 years of experience. Tauzer Street Sweeping has street sweeping contracts in the City of Rohnert Park and is very familiar with the street sweeping requirements. Page 3 City of Rohnert Park RFP Tauzer Street Sweeping's capabilities as a professional street sweeper encompass numerous projects such as sweeping for various businesses and government agencies throughout Northern California. Tauzer Street Sweeping has responded to emergency clean ups such as the 1995 floods in Napa and the Russian River area, the Oakland Hills fire, the Cypress Freeway collapse during the1989 Loma Prietta earthquake, and the Richmond Refinery fires. Tauzer Street Sweeping's background and current service history prove to support their capabilities as a street sweeping contractor. Furthermore, Tauzer Street Sweeping is more than qualified to meet the street sweeping needs for the City of Rohnert Park. During the interview R3 noted committee concerns and finds it important to reiterate their intentions. First, the concern regarding R3 requesting additional rate adjustments from the City. The rates proposed are the rates for the services R3 will provide. R3 is prepared to stand by the rates for services proposed once the City approves them. R3 will not request rate increases from the City beyond the rate adjustment process provided for in the Draft Agreement. Second, R3 companies currently have about the same number of residential and business accounts throughout their service areas as are located in the City of Rohnert Park. However, those accounts are provided under contracts with a large number of local governments. As a result, R3 believes the City of Rohnert Park contract will be of comparable size to the current combined operations, but with far fewer reporting relationships for R3 to manage. Therefore, R3 believes this is an excellent match between the City of Rohnert Park's needs and R3's capabilities. Third, R3' must emphasize that the joint venture partners have provided recycling, refuse and debris box services in Sonoma County for over 50 years. The joint venture partners have dedicated their entire careers to the recycling and refuse industry and are committed to continuing in their innovative efforts in developing and implementing recycling programs to meet AB939 goals and the community needs. Further, R3 proposes to negotiate with the City on a reasonable price for providing residential and commercial food waste services should the City choose to offer this additional recycling service in the future. Box 3935 a Santa Rosa; CA 95402 9 (707) 585-0511 ROHNERT PARK RESOURCE RECOVERY RESPONSES TO DISADVANTAGES 1) MIXTURE OF OLD AND NEW VEHICLES The City did not require new vehicles in the RFP. However, the City did require that vehicles last the life of the contract, with the understanding that the City did not want to pay for additional trucks during the life of the contract. As a result, we have proposed to purchase late model vehicles that will last the life of the contract and have an already established comprehensive preventative maintenance program. If any truck needs to be replaced during the life of the contract, the R3 partners have guaranteed to the City that they will not require the City to pay for replacement trucks. 2) 'NEW GROUP THAT HAS NOT WORKED DIRECTLY TOGETHER The R3 partners have worked together directly for over 45 years. They currently work together in joint marketing and transportation of recyclable materials. Also, over the past 45 years they have worked together on all aspects of solid waste and recycling programs. In fact, the R3 partners worked together servicing the City of Rohnert Park before it was incorporated as a City. Further, the R3 partners have worked together beginning in the 1970's through the early 1990's. Together they serviced the unincorporated area of Sonoma County from south Santa Rosa to Bodega Bay. The services provided were residential and commercial refuse and recycling services. Additionally, the R3 partners were the initial contractors who started the Occidental Transfer Station and the Guerneville Transfer Stations where they transported compactors and transfer trailers to the Central Landfill daily. In the late 1980's the City of Santa Rosa gave the R3 partners notice that a significant number of customers were annexed to the City of Santa Rosa and therefore the R3 partners would lose this customer base within months of the annexation. As a result the R3_ partners were forced to diversify into other business ventures to sustain their current operations. Consequently, one of the R3 partners, Harry Hardin moved to Humboldt County to own and operate Eel River Disposal & Resource Recovery, and became Humboldt County's leader in recycling. Curtis Michelini and Charles Hardin continued to service commercial and industrial accounts that were open to competition in Sonoma County. Industrial Carting has distinguished themselves as one of the leading recyclers in Sonoma County servicing over 80,000 recycling buy back customers annually. Page 2 Rohnert Park Resource Recovery Consequently, the combination of Eel River Disposal and Resource Recovery and Industrial Carting gives R3 additional strength in terms of recycling markets, staffing and financial resources and equipment acquisition_ 3) WOULD REQUIRE CONTRACTOR TRANSITION R3 as the new contractor for the City would require a transition period. However, R3 is experienced in going through that transition process from other projects, such as the start up of the unincorporated area of Sonoma County, the Mare Island Naval Facility operations in Vallejo and Eel River Disposal and Resource Recovery's 'operations in Humboldt County. R3 has provided a detailed timetable to the City in their proposal on how R3 will accomplish this transition. A transition period would be required for any contractor other than Empire Waste Management. 4) POTENTIAL EMPLOYEE TRANSITION ISSUES R3 has committed to offering employees of the current contractor, Empire Waste Management the first opportunity to work for R3 in servicing the City of Rohnert Park's contract. 5) FACILITY NOT IN PLACE; NO SPECIFIC SITE IDENTIFIED R3 has identified two sites in the proposal that are currently in place, permitted and currently in operation. R3's primary site for recycling processing is a five -acre site less than one mile north of Rohnert Park in Santa Rosa. Also, the R3 partners own a 20 -acre site about one mile west of Rohnert Park on Taylor Road. This site is used for other salvaging and storage activities. R3 plans to expand recycling activities at the Santa Rosa site and add vermicomposting activities on the 20 -acre Taylor Road site. Although, the sorting equipment for processing recyclables needs to be added to the Santa Rosa site, the facility is in place and fully equipped with industrial balers, shredders, conveyors and buildings to accommodate the recycling operations. Pictures and site plans of the 5 -acre Santa Rosa site are provided in the proposal. R3 has contacted sorting equipment vendors and they have assured us that the equipment needed for the Rohnert Park project can be delivered in time for the July 1, 2001 startup. In addition, R3 outlined several contingency plans for processing recyclables in our proposal to assure the City that R3 would recycle everything possible that is collected from Rohnert Park, even if the sorting equipment is not in place by July 1, 2001. (See attached site plan). Page 3 Rohnert Park Resource Recovery 6) PERMANENT STAFFING NOT IN PLACE AND POTENTIAL DRIVER AND EMPLOYEE TRANSITION ISSUES The initial staffing and transition team is in place for this project. R3 is assigning the top management staff ofthe R3 companies involved to work full time on the implementation of the Rohnert Park project. In addition, R3 has committed and budgeted for a General Manager to work exclusively for the Rohnert Park project. Also, R3 has committed to hire staff, consultants and subcontractors that are experienced to perform the solid waste and recycling services as required by the City of Rohnert Park's contract. The R3 management team is committed to devoting 100 percent of their time initially to the Rohnert Park project are Ernie Carpenter, Curtis Michelini, Lisa Hardin, Charles Hardin, Harry Hardin, Harry Hardin, Jr. and Les Gaut. Further, the transition of employees would be required for any contractor other than Empire Waste Management. 7) RECYCLING PROCESSING FACILITY WOULD REQUIRE UPGRADES FOR SINGLE STREAM RECYCLING R3's recycling processing facility would require minimal upgrades for single stream recycling. R3 previously indicated in response number 5 above that there are detailed plans to accomplish the upgrades in a timely manner and contingency plans are described in the proposal for any issues which may arise. R3 will process all recyclables collected and maximize the diversion of recyclables from the landfill. 8) NO STREET SWEEPING EXPERIENCE Eel River Disposal and Resource Recovery does have experience with street sweeping that was highlighted in the R3 proposal which identified the equipment proposed and in the R3 interview on January 8, 2001. Eel River Disposal and Resource Recovery provides limited street sweeping services to municipal and commercial customers in Humboldt County and owns the necessary street sweeping equipment to perform the City of Rohnert Park's street sweeping services. However, as street sweeping is not one. of R3's primary business activities, R3 tried to convey in the proposal that they may subcontract the street sweeping services. Attached is the information regarding R3's preferred street sweeping subcontractor, Tauzer Street Sweeping who has 27 years of experience in the street sweeping industry. Page 4 Rohnert Park Resource Recovery 9) RELATIVELY HIGH NON -GUARANTEED RECYCLABLE REVENUES Under advantages it was noted that R3's cost is "predicated on relatively high non -guaranteed recyclable revenues." The average revenue for recyclables that R3 assumed was $70 per ton, which is the actual level of revenue R3 has obtained for the past several years. R3 is confident that this revenue projection is accurate. In addition, as R3 `understands the economic structure that the City has designed, R3 absorbs the risk of market revenues. If revenues are not as high as projected R3 does not expect the City to pay R3 more, any revenue shortfall would just decrease the amount of R3's profits. As a local firm, R3 understands that risk and is prepared to assume this responsibility. Also, highlighted in the Introductory Staff Report On Proposals For Solid Waste Services of the other firms' advantages the following was noted: 1) Green Team — "No significant litigation issues" R3 also has "No significant litigation issues". 2) Green Team — " Includes textiles as additional curbside recyclable materials" R3 will also provide textiles as additional curbside recyclable materials. This should be noted as an advantage for R3 since there are NO EXCEPTIONS to the agreement by R3. 6) Empire Waste Management — "Residential food waste program option" R3 also proposed a food waste and. food packaging curbside option as described above.
