Sonoma County Professional Baseball, Inc., also known as the Sonoma County Crushers, wishes to voluntarily terminate its lease of Rohnert Park stadium effective immediately, or at the latest, December 31, 2002. We attempted to contact the city to discuss this decision but. messages left with Armando Flores and Joe Netter's Assistant before December 23rd were not returned. When we went to City Hall December 23rd, we discovered the City offices were closed for the remainder of 2002. We have two years remaining on the lease. We would like until January 31, 2003 to physically vacate the premises. We need a letter from the City agreeing to this termination in 2002 in order to be able to close our books. We stand ready to finalize the terms of our departure...we have a $1.000 refundable deposit due back from the city and we owe the City for our last utility bill. The City would get the use of the Stadium and property.two years earlier than planned, plus some assets at the park that we would discuss. We have formally withdrawn from the Western Baseball League because 'it was no longer viable We did everything possible to attract another team to Sonoma County and the Stadium, but the refusal of the City to extend the lease was the show -stopper. This is a very difficult decision we have reached, but we had no choice; we will take a financial loss because of it. We hope our good relationship will extend to expediting this transaction. The emergency listing was reviewed by the California State Department of Fish and Game who considered the emergency listing inappropriate due to a lack of proper information and sufficient scientific support, 2) It is most difficult to describe potential impacts because of the lack of clarity in definitions, but it appears that the action may have a very significant negative impact to our ability to continue a successful and environmentally -friendly recycled water reuse program. 3) Sonoma County and, more specifically, the Santa Rosa Plain are special areas where very positive steps have been taken by local govemment, in cooperation with State and Federal govemments, to address delicate habitat. JAN -03-2003 12=25 CITY MGR'S OFC 707 543 3030 P.08i08 We have in place a Vemal Pool Plan. • The County has adopted a funding mechanism (quarter cent sales tax) to protect open space and habitat. • Each of the municipalities has voter -approved urban growth boundaries and community separators. 4) The City of Santa Rosa stands ready to make available existing data along with access to property it owns within the identified habitat area for research. We want to work closely with the Department of the Interior to make sure that any decision is based on current science and that any Recovery Plan that may be adopted takes advantage of the many positive actions already undertaken by regional agencies. Activities by theSubregional Water Reclamation System, the Utilities Department and other City agencies will be significantly constrained by the emergency and proposed listing of the California tiger salamander as endangered. Otherwise normal operations such as driving the dirt roads through the City.farms in winter may require approval from the USFWS. The'Subregional System (which provides sewage treatment and disposal for Cotati, Rohnert Park, Sebastopol, and Santa Rosa) and other City operations are in the center of the designated range of the salamander. The City is a primary landowner in the region and currently operates the Laguna Reclamation Facility and its recycled water irrigation program on 6,500 acres within the range of the species (see Figure 1). This puts the City in a major stakeholder position.. If the listing should render the existing irrigation system unusable, the cost of providing alternative recycled water :reuse and disposal capacity would range from $150-350 million. In addition; the Subregional System is undertaking the Incremental Recycled Water Program (IRWP). to ensure continued compliance with recent water quality regulatory changes, namely the Federal California Toxics Rule (and to meet planned, population. growth in the service area)., The IRWP:EIR-is examining several alternatives, which rely upon additional pipelines and storage reservoirs in the Santa Rosa Plain within the potential range of the California tiger salamander as currently indicated by the IJSFWS. Attached please find a map of the City of Santa Rosa's existing agricultural reuse areas and potential. IRWP storage reservoir area superimposed over the-USFWS's potential range of the Sonoma County California tiger salamander .(Figure 1), The USFWS is charged with recovery of the California tiger salamander. Therefore,• key to any successful recovery effort will be a mutually cooperative relationship between the City and the USFWS. In light of the above, the City is responding to the proposed listing to minimize impacts to on-going activities and future capital improvement projects as JAN -03-2003 12:22 CITY MGR'S OFC 707 543 3030 P.03/08 well as offer information and our reliable partnership in the strategic recovery of the species. Our comments are organized into three subject areas: identification of City activities likely to result in take, regional conservation planning efforts, and the basis for the range map and proposed listing. IDENTIFICATION OP CITY ACTIVITIES LIKELY TO RESULT IN TAKE The City appreciates the USFWS policy to identify activities that are likely and not likely to result in take. However, in the proposed rule USFWS has only repeated the requirements of the law, which is of little assistance to regulated landowners such as the City of Santa Rosa and does not meet the intent or spirit of the ,adopted policy. The proposed rule simply identifies "uplands" as the type of habitat that may be associated with California tiger salamander. " 13pland" is a very broad term that encompasses everything from clearly suitable habitat such as grassland and oak savanna, clearly unsuitable habitat such as intensively cultivated cropland and dense urban development, and a number of intermediate habitat types. To alleviate the vagueness of these definitions, we request that USFWS address the City's existing recycled water reuse system and the IRWP, specifically relative to existing irrigated lands and future improvements to be built on existing irrigated lands. We request that USFWS explain its view on whether on-going activities on these lands would likely result in take. Similarly, the proposed rule contains a very broad list of activities that may result in take, such as "recreation" and "excessive cattle grazing." The City also requests that USFWS specifically address these terms relative to on-going City activities. REGIONAL CONSERVATION PLANNING EFFORTS The City is concerned that the proposed rule gives no recognition to regional conservation efforts. As USFWS is aware, a major effort undertaken in the late 1990's culminated in preparation of the Final Santa .Rosa Plain Vernal Pool .8cosystem Preservation Plan (the Vernal Pool Plan), dated June 30, 1995. This plan addressed the vernal pool/grassland/savanna habitat that supports California tiger salamander, and specifically addressed the habitat needs of California tiger salamander. The City believes that USFWS should include a full analysis of the Vernal Pool Plan in its assessment of the threats to California tiger salamander. Specifically, we believe that the existence of the Vernal Pool Plan indicates that the status of California tiger salamander in Sonoma County is potentially much less vulnerable than suggested in USFWS's proposed rule, which does not acknowledge the existence of the Vernal Pool Plan. The City provides vital infrastructure services to the citizens of central Sonoma County under the strict regulation of several resource agencies, such as the North Coast Regional Water Quality Control Board. The City and others have based their planning on the ` JAN -03-2003 12:23 CITY MGR'S OFC assumption that conservation measures similar to those in adequate to conserve all_ the, plant- and animal species found These measures would allow imminently needed projects, constructed on City -owned land so long as mitigation in the preservation is provided. 707 543 3030 P.04i08 the Vernal Pool Plan are in the Santa Rosa Plain, such as the IRWP, to be form of strategic off-site If USFWS believes that the Vernal Pool Plan is in fact not adequate to. ensure the continued existence of the Sonoma County distinct population segment of California tiger salamander, then we request that the USFWS explain why that is the case. We also request that the USFWS explain its approach to mitigation and off-site mitigation, if the proposed listing is approved. Such an explanation is essential to allow the City to plan how it will meet future needs of the citizens of central Sonoma County, BASIS FOR RANGE MAP AND PROPOSED FINAL LISTING The City is concerned about apparently inconsistent treatment of scientific information. In its listing rule, the USFWS mentions that only seven California tiger salamander breeding locations exist, and these are in, the southwestern. Santa Rosa area in the vicinity of the old airfield. However, the USFWS has taken three actions, which presume that California tiger salamanders are much more widely distributed than the seven locations identified in the proposed rule and a presumption that many,additional ponds and pond complexes support the species: • The USFWS issued a map entitled Potential Range of Sonoma County California Tiger Salamander (dated Septernber 16, 2002) encompassing the entire Santa Rosa Vernal Pool Plain along with lands to the south as far as Pepper Road and lands to the east extending into Bennett Valley., • Along with this map, USFWS advised local government entities to avoid liability for Endangered Species Act violations by not issuing permits for ground disturbing activities, within this area pending completion of surveys demonstrating the species' absence from the project area. • USFWS has also issued the .Draft Standard Protocols for Site Assessment and Field Surveys for Determining Presence or Absence of the Sonoma Distinct Population Segment of the California Tiger Salamander (dated November 8, 2002). This document specifies a methodology for determining presence or absence of California tiger salamander within this potential range and states that the USFWS will not accept a conclusion that the species is absent until completion of the required surveys. if the USFWS indeed believes the best available scientific information indicates that only seven California tiger salamander breeding locations exist, it must consider and possibly mortify the potential range map, advice to local government, and survey protocols consistent with the seven known locations. Altematively, if USFWS believes the best available scientific information indicates that substantial numbers of additional California tiger salamander locations exist throughout the area delineated as `potential range," it must acknowledge that fact as the basis for its listing decision. To act decisively would be to reduce salaries by 10%, thus saving about $1,560,000, or to say it another way, reduce the budget deficit by 78%. This assumes thc- quotes from city hall that salaries account for 60% percent of the city's $26,000,000 budget ars, correct. NETTER agrees to apply, when he is eligible, for benefits under Medicare so as to minimize the costs to CITY of providing health benefits to NETTER and/or his spouse. Section Two. Separation Effective Date. NETTER' S last day of employment in his position as City Manager of the City of Rohnert Park shall be April 15, 2003, which shall be the final day that NETTER is employed by the City of Rohnert Park. Section Three. Payments. CITY shall make the following payments: A. During the Period of Administrative Leave. CITti a nary 200 . hro g rA l` 1all continue to compensate TER the same amount and in the same manner as immediately preceding CITY'S Action on January 3, 2003 pursuant to the Agreement. B. Severance Settlement Cash Payment. a) Upon execution of this Amendment by both parties and as required in Section Three B (b), CITY shall pay NETTER the amount of $322,922.63 less three months salary and benefits in the liquidated sum of $41,827.38 paid as required by Section Three A above for the net total of $281,095.25 which is comprised of: (1) The cash value of accrued industrial and non- industrial sick leave; (2) The cash value of vacation accrued prior to April 1, 1998 calculated to be $21,720.58 ("Banked Vacation"); (3) The cash value of vacation accrued after April 1, 1998 calculated to be $29,029.07 ("Accrued Vacation"); (4) The cash value of three months severance pay calculated in the same manner and amount as immediately preceding the CITY's Action on January 3, 2003; (5) The cash value of 120 hours of administrative leave, calculated to be $8,1.96.44. b) CITY shall pay NETTER the sum of $281,095.25 (sum referenced in B. a) above) as follows: (1) (a) The payment by CITY for NETTER accrued vacation (425 hours), banked vacation (3 18 hours), administrative leave (hours), totaling 863 hours convert to the net sum of $58,946.09, which will be payable to NETTER as a salary continuation payable semi-monthly on the 15th and last day of each month commencing April 16, 2003 and continuing through September 15, 2003. CITY shall continue PERS contributions during the period of NETTER' S salary continuation for each payment to insure NETTER receives PERS retirement credit. (b) In the event NETTER secures employment as an employee with another public entity which is a member of PERS and that entity provides PERS benefits to its employees, NETTER agrees CITY shall discontinue the salary continuation payments, at the date agreed to by NETTER, and CITY shall timely pay NETTER any unpaid balance of all remaining unpaid hours under Section Three B. b) (1)(a) upon NETTER'S request within ten (10) business days. In no event shall CITY be obligated to continue PERS contributions to insure NETTER receives PERS retirement credits after the first day NETTER is an employee of another public entity which is obligated to make PERS contributions for NETTER as an employee.i (2) The balance of the $281,095.25 severance settlement cash payment in the sum of $222,149.16 shall be payable by CITY to NETTER at NETTER' S option, either in full upon execution of this Agreement by both parties or in the alternative one-half payable upon execution of this Agreement by both parties with the remaining one-half balance to be paid on January 2, 2004 and not sooner. C. Dental, Health, Life Insurance, Vision, Other Medical Insurance and Other Benefits. Since NETTER had completed in excess of ten (10) years of CITY service prior to 1993, upon separation from the CITY, NETTER shall receive lifetime benefits of health, medical, vision, dental, life insurance and other benefits without the requirement of age or retirement in the Public Employees Retirement System (PERS), as provided other retired CITY management employees in accordance with Section 6.20 (a) and Section 8 of the Memorandum of Understanding with nonrepresented employees, July 1997-1998, and Resolution 90-267 for former retired City Manager. - 2. NETTER agrees to apply, when he is eligible, for benefits under Medicare so as to minimize the cost to CITY of providing health benefits to NETTER and/or his spouse. CITY shall to timely reimburse NETTER for any enrollment costs, fees, or premiums imposed by Medicare or such other similar program which may replace it upon written request. 3. Deferred Compensation. NETTER shall retain his rights, entitlements, ownership, and interest in the deferred income accounts in his name which the CITY has with the ICMA Retirement Corporation or any successor Trustee or Administrator. Section Four. Other Benefits. A. NETTER shall have the option to purchase t �e Cherokee SUV automobile now used by NETTER. In the event NETTER does not exercise his option to purchase the 1999 Jeep Cherokee SUV in accordance with this paragraph on or before 5: 00 PM on April 15, 2003, NETTER shall return the vehicle in a condition that is substantially similar to the vehicle's condition as existing on January 3, 2003. B. NETTER and his eligible dependents, as provided in the CITY Management Outline (at page 12), shall have the right to use of the open gym, weight room, and locker room facility at the City Sports Center and to participate in the lap swim program at no cost. Section Five. CITY'S Cooperation. CITY agrees; A. City council members may provide letters of reference and/or recommendations to assist NETTER in obtaining comparable employment and salary/benefits package to that which he was provided under the Agreement as of January 3, 2003. CITY will in no way directly or indirectly interfere with, undermine or change NETTER' S rights and entitlements under the terms of the Agreement as amended by this Amendment. ED] Section Six. Indemnification. In accordance with the state and local law to include the Government Torts Claims Act, CITY shall pay, defend, save harmless, and indemnify NETTER against any tort, professional liability claim or demand or other legal action, whether groundless or otherwise, arising out of any alleged act or omission occurring in the performance of NETTER' S duties as City Manager though and including April 15, 2003. CITY will compromise and settle any such claim or suit and pay the amount of any settlement or judgment rendered thereon. This section is not intended to modify, expand, or diminish the obligations of CITY under the Government Tort Claims A Section Seven. Employment Agreement For Services As A City Manager. A. Notwithstanding any other provision herein to the contrary, if the provisions of this Amendment or the Agreement differ or are in conflict with CITY'S personnel rules and regulations, the CITY Code or other rules, then the provisions of the Agreement as amended by this Amendment shall prevail. The provisions of this Amendment and its executory provisions shall survive termination of the Agreement and shall continue beyond April 15, 2003. B. Section Eight. Attorney Fees. Except as otherwise agreed herein, in the event of a dispute or claimed breach of any term or condition this Amendment and if litigation should result, the prevailing party shall be entitled to reasonable attorney's fees and costs as may be awarded by the Court. Section Nine. Miscellaneous. A. 'Should any provision of this Amendment be invalid or unenforceable, the remaining provisions shall remain in full force and effect. B. The phrase "execution of this Agreement by both parties" shall include and require a resolution of a majority vote of CITY'S Council approving the provisions of this Amendment.
