We hope the City Council will take appropriate action to include the Grove under its Mobile Home Ordinance. We understand the City Attorney's position is that this will require a hearing before the city's Mobile Home board and then approval by 4/5ths vote of the City Council.\ While we do not agree that the current ordinance excludes Sonoma Grove, we appreciate that the Council may prefer to rely on the advice of its own counsel. The residents of the 180 unis in the park face imminent very large rent increases, The new owner has notified residents that on 2/1/06 the rents will be $495 per month for spaces over 30 feet long, $450 per month for spaces 20 to 30 feet long, and $395 per month for spaces up to 20 feet long. These increases do not include utiliity costs, which typically run $50 to $100 per month or more. I am enclosing the staff report for the rent freeze imposed by the city of Heakisburg a year.ago (after the new owner had already sent out notices of increases). We don't think there would be any exposure whatsoever to liability if Rohnert Park took the same step tonight. Most of the rent increase notices which have been served on residents are legally defective for various reasons. Foremost among these reasons: residents who have lived in the park more than 9 months, regardless of the size of -their trailers, have the'same rights as mobile home owners. Civil Code 798.30 requires at least 90 days written notice to the coach owner of any rent increase. These rent increases were only noticed 60 days ago. While the rent increases are not legally effective, many of the elderly and disabled residents of the park fear that they will be evicted if they don't agree to pay the new rent. That is why it is so urgent that the Council take action to freeze the rents. The City Attorney has also opined that even with the increases, the rents will still be affordable to most of the 1/31/2006 P Vel Page 2 of 2 park's residents. This is not correct. Many of the residents are living on fixed household incomes of less than $1,000 per month. They cannot afford to pay $450 or $495 per month rent plus another $100 or more for utilities. That leaves little or nothing for a all the other essentials of life - food, medical care, transportation, laundry, etc. We do not question either the owner's right to a fair return on investment, or the city's right to enforce its housing codes in the park. We believe with time that solutions can be found, including enforcing the City's Mobile Home ordinance'with respect to the park. Element Review Miscellaneous Communications A enda 3 06 to: Cy,, to: Staff has been asked to provide a brief presentation on the General Plan Housing Element and other planning matters as they relate to Sonoma Grove. The following presents the key points that will be presented: What is the Housing Element? The Housing Element is the City's blueprint for meeting. the City's housing needs for a given period, which typically corresponds to the five-year housing needs process schedule set by the State. It contains: 1. an assessment of housing needs; 2. the identification of constraints that'may affect the City's ability to meet those needs; 3. an inventory of means to meet those needs; . 4. statements of the goals, objectives and policies related to meeting the needs; and 5. a schedule of the actions the City intends to take to achieve the goals and policies stated. Two Important Elements: 1. Regional Housing Need Determination: This is based on existing housing need, potential loss of housing, and projected regional growth rates (e.g. population, jobs, households:) ABAG provides this and it is what the Housing Element's goals are based on. It does not just say how many affordable units need to be produced, but also the number of market rate ones as well. 2. Quantified Objectives: This section is used to measure the City's success in achieving, its Housing Elements goals. It presents the number of units intended to be built to satisfy the housing need determination, as well as the units to be rehabbed, and the units to. be conserved. Report on Sonoma Grove — Housing Element Review Page 1 Housing Element References to Sonoma Grove Sonoma Grove is specifically mentioned in the Housing Element two times: Page 9-6, in the "Housing Conditions" section, where it is noted that "[t]he 152 travel trailers located in the Sonoma Grove Travel Trailer Park provide a form of very low-cost housing. Because maintenance of the park is regulated and enforced by the State of California; the trailers were not inspected during the housing conditions survey. Although travel trailers are not designed for use as permanent housing, the park's trailers are occupied as such. This is the only violation of state housing codes that exists, according to the state park inspector." 2. GOAL: PRESERVATION AND IMPROVEMENT OF HOUSING STOCK HO -G Preserve and improve the City's existing housing stock. POLICIES: PRESERVATION AND IMPROVEMENT OF HOUSING STOCK HO -20 Maintain the Sonoma Grove Trailer Park as a form of shelter for very -low income students and households that, in nearly every case, could not afford other housing available in Rohnert Park (Note: This was carried over from the 1995 Housing Element, essentially verbatim.) Program 21.1 Consider requests by the trailer park owner for the funding of appropriate projects that would maintain the park. Responsibility: CDCRP Funding Source: Redevelopment Fund Schedule: July 26, 2000 — June 30, 2006 (extended by HCD to 2008, due to ABAG extension request) It should be understood that the Housing Element is intended to produce and maintain affordable units, but not to subsidize substandard. housing and trailers as permanent housing. The next policy presented in the Housing Element (HO -22) seeks to minimize the extent of potential earthquake damage to housing, so this reflects the goal of addressing the physical condition of units, not their affordability per se (i.e. "appropriate projects that would maintain the park.") Report on Sonoma Grove — Housing Element Review Page 2 Other_ General References in the General Plan that Would Include Sonoma Grove Sonoma Grove. is included in the housing inventory shown in Table 9.1-1 (Page 9-4), under "Mobile homes/travel trailers (of which there were estimated to be 1,467 in the year 2000.) The units are shown as 150 travel trailers; not as mobile homes. Sonoma Grove is shown within the boundaries of the Redevelopment Agency Project Area (Page 9-65), which would allow the City to use redevelopment funds to assist the property owner with needed physical improvements if requested (as indicated in Program 21.1 of the General Plan Housing Element.) Pages 9-12 to 9-13 give the information on what household income limits are and. affordable monthly housing costs for a 1 to 6 person household, as of March 2000. The following lists the 2000 maximum monthly rents presented in the Housing Element (based on 30% of income going to rent) and contrasts these with the 2005 maximums (as of 2-11-05): Very Low (50% of AMI): Low (80% of AMI): Median (100 of AMI): Moderate (120 of AMI): 2000 $509-843 $814-1,348 $1;01.8-1,685 $1,221-2,022 ;QQ5 $653-1,081 $1,006-1,668 $1,305-2,164 $1,566-2,595 If the Sonoma Grove rents exceed this, then we would have to find replacement very -low income units elsewhere, and these would likely be more standard units such as those developed by non- profits. As for a potential sale of the property to a non-profit, it should be understood that we have worked with non -profits to purchase properties in the past, -but it is not a quick process.. It should also be noted that any non-profit would have the same concerns as the City regarding a potential substandard housing situation and the maintenance of the facility. Municipal Code Definitions of Mobile Homes vs. Trailers 17.04. 030 Definitions of words and terms. "Manufactured home" _means .a complete single family home deliverable in one or more transportable sections... that is attached to a permanent foundation. A manufactured home is also commonly referred to as. a "mobile home" or "modular home." A manufactured- home is not the same as a recreational vehicle, commercial coach, or factory -built home, which may look similar from the exterior. "Recreational Vehicle" means any vehicle or trailer designed or modified for use as a camp car, camper, motor home, house car, trailer, trailer coach, boat, boat trailer, snowmobile, snowmobile trailer, camping trailer or for any similar purpose. "Trailer" means a vehicle without motor power, designed so that it can be drawn by a motor vehicle, to be used for human habitation or for the transporting of personal property. Report on Sonoma Grove — Housing Element.Review Page 3 17.23:020 (Mobile Home Park Conversions): "Mobile home" means a structure designed for human habitation or for being moved on a street or highway with a permit pursuant to Section 35790 of the Vehicle Code. Mobile home includes a manufactured home, as defined in Section 18007 of the Health and Safety Code, and a mobile home as defined in Section 18008 of the Health and Safety Code, but does not include a recreational vehicle, as defined in Civil Code Section 799.24, or a commercial coach, as defined herein and in Section 18001.8 of the Health and Safety Code. Existing Use Permit The existing use permit for Sonoma Grove was approved by the City Council in May, 1972. This use permit identifies Sonoma Grove. specifically as a "travel trailer park" and includes a number of project conditions that are no longer enforceable, such as a restriction on the number of units that may house children (15 percent) and its exclusivity to "Sonoma State College affiliated persons." The use permit also notes that the park is to be "developed as a Travel Trailer Park under State Code" and shall comply with all appropriate state laws. Also, the original use permit was granted for a period of five years with annual reviews thereafter to determine if the development "is incompatible with surrounding development." The annual review requirement was intended to allow the City to terminate the use permit if the use were ever found incompatible with surrounding uses. This condition would be difficult to defend, as case law holds that the grant of a CUP with subsequent reliance on the permit by the permit holder creates a fundamental vested property right that subjects a CUP revocation to judicial review. In Legal Staff's opinion, the City would not prevail if it were to attempt to terminate the use permit at this juncture. (Malibu Mountains Recreation, Inc. v County of Los Angeles, 67 Cal. AppAth 359, 367 (1998).) Lastly, .there is a condition that the use permit only applies to the original owner, Octagon Company. Again, the CUP runs with the land so the provision attempting .to condition the permit on nontransferability cannot be enforced. This may be where one of the statements in the Bohemian article originated, which is the erroneous belief that the City had to approve the sale of the property to the present owner. This is not true and such a restriction would be illegal, similar to trying to tell anyone that they cannot sell their property without the City approving the sale. Prouerty Zoning The City has a Mobile Home Overlay District applied to it, and this overlay was placed upon the Sonoma Grove property in 2003, when the Zoning Map was revised. In Subsection 17.06.460.B of the Municipal Code it states that the intent of the overlay is to "[p]rovide appropriate areas for residential mobile home park development that are consistent with the general plan and with standards of the public health and safety as established by state or city code." The overlay allows the potential conversion of Sonoma Grove to a mobile home park in the future, and the base density would also allow the potential redevelopment of the site with a higher -density type of development. It was not intended to define the present Sonoma Grove development as a mobile home park, ,however, and it should be noted that "trailer parks' are not permitted within Report on Sonoma Grove — Housing Element Review Page 4 a, the Mobile Home Overlay District, or within any other City zoning district, since these types of development typically occur in County areas, generally close to recreational opportunities. Furthermore, in Subsection 17.06.490.I, the M -H Overlay District provisions speak to the storage of trailers on a mobile home park property but do not mention their occupancy, as follows: 1. All pleasure boats, trailers, campers and motor coaches shall be stored in an approved area set aside for such storage. 2. Said areas shall be screened from view and shall provide a minimum of one boat or trailer space for every five mobile home sites. 3. Such storage shall not be allowed on any street or individual mobile home space. This means that Sonoma Grove represents a nonconforming use. As defined in Section 17.04.030 of the Code: "Nonconforming use" means a use of a structure or land which is lawfully established and maintained prior to the adoption of this ordinance but which does not conform with the use regulations of the district in which it is located. Uses not legally established, which fail to conform to the provisions of this ordinance, shall be deemed to be illegal uses. Sections 17.25.081 through 17.25.083 govern nonconforming uses (i.e. the use is permitted to remain in existence and be maintained but it is not allowed to expand or be otherwise developed unless in conformance with the zoning district.) Tree Removal Ordinance The only regulations that govern tree removal are in Section 12.24.050 of the Municipal Code (Tree planting, alteration, removal, relocation.) This Section directs that "[a]ny person desiring to plant, engage in tree maintenance, alter, remove, or relocate any street tree or any tree located on public places shall apply in writing to the director of public works to do so. The application shall state the number and identify the location of each tree sought to be planted, maintained, altered, removed, or relocated; shall contain a statement of the reason(s) the permit is requested; and shall contain._such other pertinent information as the director of public works may require. The application may also include documentation of any type, including written recommendations from a certified arborist concerning the health, quality and desirability of alternatives to the tree or trees in question." It does not govern tree removal on private property, such as Sonoma Grove. The Senior Planner is now working on developing a Tree Ordinance which will address the removal of trees and protections for those that are of a certain size and/or type. WITNESSETH: ' WHEREAS, COMMISSION entered into an Agreement with CORPORATION on May 13, 2003 to provide Homeless Prevention Services to households at risk_ of becoming homeless (hereinafter referred to as "AGREEMENT"); and WHEREAS, COMMISSION entered into the first Amendment to the Agreement with CORPORATION on July 13, 2004, extending the terms to June 30, 2005; and WHEREAS, COMMISSION entered into Amendment No. Two on June 30, 2005, providing additional funds and extending the terms of the Agreement to June 30, 2006; and WHEREAS, it has since come to the attention of the COMMISSION that Sonoma Grove Trailer Park, which consists of 152 Recreational Vehicle spaces, has recently sold and transferred ownership and the residents have been noticed of a rent increase as of February 1, 2006 which may pose a hardship on some of the residents -and, could putt tFem at risk of becoming homeless; and WHEREAS, it is the desire of the Commission that none of the residents at Sonoma Grove.
