NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve the terms and conditions contained in the attached Summary of Terms and Conditions of the Total Tentative Agreement with the RPPSOA to implement employment, wage and benefit changes. BE IT FURTHER RESOLVED that the City Council directs staff to prepare the Memorandum of Agreement in accordance with the terms and conditions. ATTEST: City Clerk CITY OF ROHNERT PARK Mayor Summary of Terms and Conditions of Agreement1 Rohnert Park Public Safety Officers Association Term: Two years, through.June 2011 PERS Retirement: 2% at 55 for Miscellaneous (Dispatchers, CSO) effective July 2011 No change for Safety Furloughs 2: 120 hours in FY 2009-10; 120 hours in FY 2010-11 (Safety) 160 hours over term of agreement (Dispatchers, CSOs) PERS Contribution: No change Miscellaneous: Ongoing Structural Issues Discussions: Use the Labor/Management Committee to discuss concerns and develop ideas to address pension contribution and pension formula. Personal Leave: 3 -day annual leave bank, used only when no overtime created Patrol Vehicle Take Home: Tighter criteria for use — official business only; if City finds results in additional pay (e.g. "commute time") use to be discontinued; increase from four to eight mile radius Professional Training Reimbursement: $10,000 bank/year, subject to Chief approval, for work-related training. $750/max annually per individual Acting Lieutenant/Sergeant Pay: Develop policy; no intent to change status quo. Overtime/Union Work: Review practices; clarify bargaining work to be performed by members of the unit. Department retains°right to retain consultants for limited duration to conduct training and other services that cannot be performed by members of the unit. Off -Duty employment: Evaluate other agency programs; prior to implementation, must reach agreement on a release/hold harmless/indemnification agreement signed by outside employer in favor of City. Bilingual Program: Adopt Santa Rosa testing procedures; no change in compensation. Training/Travel Time Compensation: Incorporate existing sideletters; no changes in current practices, costs. Speciality Position Reinstatement: Option for employee removed due to position elimination to reinstate when a position is reestablished. Fire Engineer/Captain CalPERS Adjustment/Training: Modify existing language to correspond with practices. No additional compensation. 1 The purpose of the summary of terms and conditions is to provide an outline of the amendments to enable timely implementation of salary and benefit changes. The City does not intend this language to be final or to be used for purposes of clarifying management -labor issues. Final language of these terms and conditions will be incorporated in Memoranda of Agreement with the consent and agreement of employee bargaining units. z Implementation of the furloughs for FLSA-exempt employees will differ from the implementation for non-exempt employees. The City shall meet and confer with RPPSOA about the implementation of the furloughs for this category of employees. Shift Schedule Changes: Increase notice requirement from three to seven days for assignments that extend over 30 days. Three day notice for changes of less than 30 days (current practice). Meet and confer if future layoffs: City to make good faith effort to avoid future layoffs, but if are considered, Association will be notified and will have 30 days to submit alternatives, adjustments or concessions for consideration by the City. Grievance Procedure: Language to streamline the procedure to reduce costs for both parties and facilitate direct response between City and Association. Association Release Time: Provide for 640 hours over two years for all Union business, including events, bargaining, grievance hearings and disciplinary actions. "Me, too" language: Provides for public safety management to take similar reductions as other safety members; Dispatchers comparable to SEIU, RPEA. The City shall consider recent bargaining history with PSOA as well as other bargaining Units. Page 2 of 6 Michael Rodriguez is_a 17 -year-old from Santa Rosa who was picked for the program. "I really had nothing to do for my summer," Rodriguez said, " And then when I heard about this KTVU U Channel -2 News program, I was just relieved, just happy... glad I have something to do now." At 5 Some of the participants are low income, at risk, or foster children. Others are young workers who are having a tough time finding a job in this recession. "It's incredibly hard to find a decent job right now," said Jay Masonek, a 20 -year-old from Sebastapol, who is a member of the Ecology Corps. "You need experience now to get a job," Rodriguez said, "So this is giving a lot of people... experience. And that s what we need right now." Each young worker gets eight dollars an hour. They work in teams on ecological projects throughout Sonoma County. The work includes maintaining'streams, helping with flood control, building trails and restoring native plant and animal habitats. County officials say the Ecology Corps is doing work that otherwise wouldn't be done, due to limited staffing. "We just don't have the crews to do it" said Marc Bautista of the Sonoma County Water Agency. "These crews, they actually supplement doing the things we'd like to get to, but just don't have the resources to do at this time," Bautista said. Many of the young workers say they'll use their earnings to pay for school. Juan Gonzalez is an 18 -year-old student from Sonoma. He attends junior college in Santa Rosa and says he wants to continue his education. Pm a volunteer firefighter," Gonzalez said, "I'm going to get my EMT and go to the EMS academy in Windsor." Sonoma County Supervisor Efren Carrillo says the program is a win-win situation. "We get to work on environmental restoration, we get to put our youth to work, and we get to encourage community service and involvement," Carrillo said. County officials say they already are working to develop more federal funding or local funding sources so they can offer the Youth Ecology Corps summer jobs program again next year. Sales Tax Trends -Interim City Manager Schwarz reviewed the two reports prepared by the City's Sales Tax Consultant, Jerry Peeler of MuniServices, for Sales Tax Trends for Rohnert Park regarding (1) Historical Amounts by Quarter and (2) Historical Amounts by Benchmark Year. Mr. Schwarz and Director of Administrative Services Lipitz responded to Council questions on these reports. . 3. 'Housing Element — Planning Manager Ponton reported on the recent approval of Rohnert Park's Draft Housing Element by HCD (Housing Community Development of the State of California). She commended this feat in today's market place, noting" that Rohnert Park is one of 5 cities of 110 that has reached approval by HCD. She reviewed the next steps of the process toward getting the final certification letter and confirmed this is for a 7 year program. 4. SWAT FIRE EMS — Director of Public Safety Masterson reviewed two publications distributed at the Council meeting entitled SWAT FIRE EMS/Urban Shield Goes International: (1) Year Book 2009 & (2) Final Exercise. 5. Redwood Empire Municipal Insurance Fund (REMIF) Board Meeting — Council Member Callinan advised he attended the recent REMIF Board Meeting and reported the City will receive $52,300 from excess of funds on liability insurance. There is an excess of $2.1 million eligible to members and there will be a breakdown provided on this by mid-December. . b. Meeting Industry Ladies Invitational (MILI) — Mayor:Breeze advised that she and Council Member Callinan attended a welcome for MILI on Sunday at the Foxtail Golf Club. She shared that MILI is a group of ladies that are charged with finding areas where business meetings can be held and to find places in hotels to stay. They will be touring around Sonoma County and their schedule included a tournament today at Fox Tail and dinner tonight at the DoubleTree. Interim City Manager Schwarz responded to Mayor Breeze's request for it report on when the banners will be up, that the order has been placed and the banners will go up as soon as possible when received. . 12. In order to continue our success and meet contractual obligations the City must undertake changes to how it provides water conservation. This report discusses the City's water conservation obligations and options to meet those requirements. Background: The water conservation and water use efficiency improvements by Rohnert Park customers over the last 11 years are truly remarkable. In 1997, potable water use 'in Rohnert Park was 179 gallons per person per day (gpcd). In 2008, it was just 107 gallons per person—a 40% reduction. The California statewide average for urban water use is 194 gpcd. In a 2005 independent study of signatories to the California Urban Water Conservation Council Memorandum of Understanding, Rohnert Park was one of only 2 jurisdictions out of over 250 in the state implementing all 14 Best Management Practices without using alternate methods. The City, using direct install and rebate programs has replaced over 10,000 toilets with low flow and high -efficiency toilets. The City's contract for Russian River water supply with the Sonoma County Water Agency (Agency) includes certain water conservation requirements: 1.12 Water Conservation Requirements (a) The Regular Customers of the Agency, and the Agency, shall (1) become members of the California Urban Water Conservation Council (CUWCC) within six months of the effective date of this Agreement and remain as members in good standing; (2) sign the Memorandum of Understanding Regarding Urban Water Conservation in California (MOU) maintained by the CUWCC and implement the Best Management Practices (BMPs) of water conservation as are promulgated by CUWCC from time to time, or implement alternative water conservation measures that secure at least the same level of water savings, and shall complete and file the annual CUWCC report form; and (3) implement or use their best efforts to secure the implementation of any water conservation requirements that may be added as terms or conditions of the Agency's appropriative water rights permits or licenses, or with which the Agency must comply under compulsion of regulation or law. (b) Should the Water Advisory Committee determine and so notify any Water Contractor that its efforts to achieve compliance with the water conservation practices required by this Section 1.12 are unsatisfactory, then such Water Contractor shall bring its water conservation program into compliance within six months after such notice, or within such additional time as may be granted by the Water Advisory Committee. Should such Water Contractor's noncompliance as determined by the Water Advisory Committee continue for six months after such notice of noncompliance, or beyond such additional time as may be granted by the Water Advisory Committee, then the Water Contractor shall thereafter pay a surcharge on all water delivered by the Agency pursuant to this Agreement equal to ten percent of the Operation and Maintenance Charge until the Water Advisory Committee determines that such Water Contractor is in compliance. The proceeds of any surcharge paid pursuant to this section shall be deposited and paid out in the same manner as the proceeds of the Water Conservation Fund. If the City does not comply with the requirements above, it is subject to a 10% surcharge on wholesale water purchases. For Rohnert Park, the surcharge would be about $250,000 per year. It is far less expensive to comply with the requirements—budgeted at $160,000. Therefore, staff recommends that we continue to remain in good standing with the CUWCC by fully implementing the 14 BMPs. In 2008, the Agency's Prime Contractors approved a Sonoma -Marin Saving Water Partnership Memorandum of Understanding. The Partnership MOU includes the following obligations: 1. Remain a member in good standing of the California Urban Water Conservation Council (CUWCC) 2. Implement the Best Management Practices of the CUWCC 3. Use best efforts to implement conservation measures that are conditions of the Agency's permits 4. Implement New Construction Water Conservation Measures as appropriate 5. Designate a responsible staff member for supporting conservation activities 6. Provide support and financial data for Agency staff administering regional support 7. Fund a minimum of $120,100 per year for local water conservation programs for the next 10 years (amount will be readjusted in 2012 based on contractor water sales). While there is a funding minimum in the Partnership MOU, contractors are expected to exceed the minimum in order to*implement the aspects of the agreement. The City has complied with its obligations in the past using the Agency (directed by City staff) to implement its water conservation programs. In June, the Agency unilaterally terminated its agreement to provide water conservation. Thus, the City can no longer use the Agency to implement water conservation. Funding: The City's water conservation program has been funded by a combination of fees from new development and service charges from existing customers. No general fund money is used to fund water conservation programs. For the last several years Rohnert Park has budgeted $160,000 for water conservation programs including all labor, rebates, and supplies. Options: There are three options to replace water conservation program services provided by the Agency. The City could contract with another agency, hire a consultant, or hire staff. Another Agency City staff first attempted to utilize another agency which would essentially replace the Agency. Santa Rosa's overall performance in water conservation is nearly as good as Rohnert Park's and in some areas they are ahead of Rohnert Park. City staff negotiated for four months with the City of Santa Rosa. Santa Rosa does not currently provide services to any other jurisdictions. Santa 2 U. Rosa proposed dedicating one staff person to Rohnert Park at a cost of $150,000 per year. While City staff sought a lower level of effort and cost, Santa Rosa was reluctant to provide alternative levels of service. At $150,000 just for staffing, there would be, nothing left to implement rebates, purchase supplies, or pay for mailing program information. Thus, utilizing Santa Rosa to replace the Agency effort is not feasible within the current $160,000 budget. In the immediate area,, Cotati, Windsor and Petaluma• are well behind Rohnert Park in terms of water conservation performance. None of those agencies provide services to other jurisdictions and staff does not recommend using one of those agencies. Consultant - Water conservation consultants are more expensive than staff. It sometimes makes sense to use a consultant for complex project work that can be completed in a finite period of time. Water conservation is an on-going program that is never complete. Because water conservation programs, temporary state orders, Agency requirements, and grant programs are constantly changing and evolving, any consultant would require a significant level of oversight and decision making by City staff. Finally, consultants typically bill at a rate that is higher than staff costs. Thus, hiring a consultant on a permanent basis is not recommended. In-house Santa Rosa, Windsor, Cotati, Petaluma, North Marin Water District, Marin Municipal Water District all use in-house staff for conservation programs. The success of these in house programs varies widely from agency to agency. Santa Rosa, four times the size of Rohnert Park, has seven fulltime staffers and a number of seasonal interns. Santa Rosa also has an active and effective program. Windsor, half the size of Rohnert Park, has one fulltime staff member and seasonal help with a less impressive conservation record. Using Santa Rosa and Windsor as a comparison, they serve 23,000 to 26,000 people per fulltime staff member in conservation. If Rohnert Park were staffed similarly, it would have 1.9 fulltime staff members in conservation. However, in most general government areas Rohnert Park is not as heavily staffed as other cities in Sonoma County. Keeping with that model staff recommends attempting to manage the water conservation program using only one fulltime staff member and seasonal help as necessary. This will allow more of the budgeted funds to go toward rebates for our customers. This may mean a lower level of service than experienced in Santa Rosa but at a lower cost. Staff recommends the addition of an Administrative Assistant for water conservation. Some of the essential job functions of the Administrative Assistant position are listed below. The essential job functions are consistent with the work required to implement the water conservation program. The Administrative Assistant position salary is virtually identical to the Water Conservation Technician position with the City of Santa Rosa. Administrative Assistant Essential Job Functions: • Prepares a wide variety of reports, letters, memoranda, statistical charts, and other materials related to responsibilities assigned • Responds to requests for information and complaints on regulations, procedures, systems, and precedents relating to responsibilities assigned • Interprets City policies, rules, regulations and refers inquiries as appropriate 3 i • Prepares City Council reports, resolutions, and ordinances; coordinates public hearings and files legal notices • Works with other City departments and outside agencies and consultants to ensure the timely processing of permits, applications, and other items • Reviews documents such as contracts, agreements, and permits for completeness and consistency with City policies, rules, regulations; insurance requirements, • Collects and assembles data and background materials • Answers phones; serves customers at public counter 0 May make presentations or give tours to groups of employees and the public; drive a City vehigle to deliver documents; assist in the training of new or temporary staff In addition to the basic Administrative Assistant job description,'a "Position Statement" will add clarification for the water conservation specific elements of the assignment. The Position Statement is as follows: Administrative Assistant, Water Conservation Under general direction, this position:will.be responsible for assisting in the development, planning, and implementation of the City's Water Conservation programs. This position will be responsible for public outreach and education, reviewing and implementing State, County and City regulations, researching and reporting on Best Management Practices (BMPs) governed,by California Urban Water Conservation Council (CUWCC), coordinating public and private service providers who supply water conserving hardware and services to the community, analyzing customer water consumption and,making recommendations for reducing water use, maintaining a positive and proactive presence within the community, and performing other duties as assigned. The Administrative Assistant will be in the Utility Billing group of the Finance Department. The Utility Billing group is the point of contact for nearly every customer -city interaction regarding water. Integrating the water conservation programs with Utility Billing will provide excellent flow of information to and from the customers regarding our water conservation programs and services. The Public Works Department and City Engineer will provide technical support regarding operational and regional issues. Recommendation: The City of Rohnert Park needs to meet its contractual obligations regarding water conservation. The most cost effective way to meet the obligations is to manage the water conservation program in-house. The minimum staffing level is one Administrative Assistant. The position will best serve the public in the Utility Billing group of the Finance Department. It was a sweet little grocery store in "B" section. I wonder what happened to it .... maybe there was too much competition from the big stores? I have lived in R.P. for 30 years and I would love to see an affordable grocery store. I live on the west side in a mobile home park, and although there is a relatively affordable store on this side, the quality of their fresh produce is very questionable and I see their prices rise weekly. I shop at four different stores just to get the biggest bang for my buck. One being Walmart where I buy as many food items as I can, and of course, Costco, which is very affordable. I have talked to many people, co-workers, family members and friends and they all think a Super Walmart is a great idea. I have also talked to people who have no intention of shopping there. The other stores won't lose their loyal customers. And it will bring in revenue, while people are shopping for their groceries they will also pick up their personal care items, gifts, diapers, paper products, etc. It will also bring jobs, first in construction then to fill positions within the new store. A Super Walmart would be a blessing to those of us living paycheck to paycheck. Summary: The CDC has contracted with the SCCDC to administer the Program since July of 1999. The SCCDC has been successful in implementing the Program on behalf of the CDC. Staff recommends the CDC approve the Tenth Amendment to the Agreement between the CDC and the SCCDC for the administration and implementation of the Program. A complete set of the program guidelines is available at the City of Rohnert Park Housing and Redevelopment office. Background: The purpose of the Program is to provide loans to low-income households to maintain owner -occupied residential properties located within Rohnert Park. The primary objective of the Program is to provide decent, safe and sanitary housing for low-income residents of the City through the correction of actual or potential health and safety problems in existing structures. The secondary objectives of the Program are to preserve the City's affordable housing stock and to assist in the process of neighborhood revitalization. The term of the loans is 20 years with 3% simple interest. The loans are either amortized of deferred payment loans based on the households' ability to afford the monthly payments. Nearly all of the loans are deferred payment loans with no payments required prior to the twentieth anniversary of the loan. These deferred payment loans become due and payable in full prior to 20 years should one or more of the following occur: 1) the borrower dies; 2) the property or any interest therein is .sold, conveyed or transferred; 3) the borrower no longer occupies the property as his or her principal residence for reasons other than medical treatment, disability, education, family matters or similar situations which the CDC k Director or his/her designee approves in writing and which require a temporary alternate' residence; and 4) the borrower is in default on any other loan condition. The maximum amount of the loans is $50,000 for a single-family house or mobile home on owned land and $24,000 for a mobile home on a rented space. Exceptions may be made in cases where hazard mitigation is required as a condition for the rehabilitation work. Eligible improvements must be of a ,permanently fixed nature and are prioritized.. Examples of these improvements are the correction of health and safety hazards, repairs to correct cited code violations, repairs to correct other code items and repairs to correct incipient code items. The SCCDC staff exercises sound underwriting practices in all 'loan transactions. All loan applications are subject to normal commercial underwriting criteria by the SCCDC. Such".criteria may include, but are not limited to credit reports, appraisals, title reports, cash-flow analyses, etc. Once a loan is approved the SCCDC staff prepares loan documents including the Fair Lending Notice, Promissory Note, Deed of Trust and/or Mobile Home Security Agreement, Truth -in -Lending Disclosure, Notice of Right of Rescission and Request(s) for Notice of Default and Sale. After these documents are executed SCCDC staff coordinates a competitive bidding process to obtain fixed-price bids from qualified, licensed contractors. These contractors are pre-screened to ensure that the contractor is qualified. The property owner may select any responsible contractor whose bid does not exceed 110% of the SCCDC staff's in- house cost estimate. Once the home -owner selects a contractor, the SCCDC staff assists the homeowner to manage the construction contract(s), inspects the work and approves payments after the homeowner has accepted the work. Completed loan files are submitted to CDC staff to provide the loan servicing throughout the term of the loan. NUMBER TEN TO THE SERVICE AGREEMENT ("AGREEMENT") BY AND BETWEEN THE SONOMA COUNTY COMMUNITY DEVELOPMENT COMMISSION ("SCCDC") AND THE CDC FOR THE ADMINISTRATION OF THE CDC HOUSING REHABILITATION PROGRAM WHEREAS, the CDC has adopted Ordinance No. 01,, establishing a low and moderate income housing fund; and; WHEREAS, the CDC has issued tax increment funds which provide funding for the programs of the CDC; and WHEREAS, the CDC must utilize twenty percent (20%) of its tax increment revenues to improve and expand housing affordable to low -to -moderate income households; and WHEREAS, the CDC approved the Housing Rehabilitation Program (the "Program") for very -low, low- and median -income homeowners and the Owner -Occupied Housing Rehabilitation Program Design in July 1999; and WHEREAS, in July 1999 the CDC entered into the Agreement with the SCCDC to administer the Program on CDC's behalf which, among other things, allows the CDC to remain a parry to any agreement or contract pertaining to CDC Housing Rehabilitation assistance; and WHEREAS, the SCCDC employs individuals qualified and experienced in conducting a housing and mobile home rehabilitation program and has successfully administered the Program in the City of Rohnert Park; and WHEREAS, on September 13, 2005, the City adopted. Resolution No. 2005-288 and the CDC adopted Resolution No. 2005-12, finding that the Use of Low and Moderate Income Housing Funds outside the Project Area is of benefit to the Project Area in Accordance with* Section 33334.2 of the Health and Safety Code; and WHEREAS, the CDC wishes to continue the Agreement with the SCCDC to implement the Program in the City of Rohnert Park. NOW THEREFORE BE IT RESOLVED, by the . Community Development Commission of the City of Rohnert Park that the Tenth Amendment to the Service Agreement by and between the Sonoma County Community Development Commission -and the Community Development .Commission of the City of Rohnert Park for the implementation and administration of the Program is hereby approved. COMMUNITY DEVELOPMENT COMMISSION` Chairperson ATTEST: Secretary R !t TENTH AMENDMENT TO AGREEMENT BETWEEN THE SONOMA COUNTY COMMUNITY DEVELOPMENT COMMISSION AND THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF ROHNERT PARK WHEREAS, the Sonoma County Community Development Commission (the "SCCDC") and the Community Development Commission of the City of Rohnert Park (the "CDC") have previously entered into that certain Agreement to implement the CDC approved Owner - Occupied Housing Rehabilitation Program (the "Program"), dated July 1, 1999; and WHEREAS, SCCDC Resolution No. 00-0200 dated February 29, 2000, authorized the SCCDC's Executive Director to execute the Agreement and subsequent amendments to the Agreement; and WHEREAS, CDC Resolution No. 99-14 dated October 12, 1999 authorized the CDC's Executive Director to execute the Agreement and subsequent amendments to the Agreement; and WHEREAS, beginning Fiscal Year 2008/2009, CDC allocated a total of $100,000 for housing rehabilitation assistance and program delivery expenses. NOW THEREFORE BE IT RESOLVED, that the SCCDC and the CDC, in consideration of their mutual promises contained in the Agreement, do agree and covenant to amend the Agreement by and between them as follows with all other provisions of the Agreement to remain in effect: ■ Total Housing Rehabilitation Assistance Fiscal Year 2009/10: $70,000 Total administration and program delivery Fiscal Year 2009/10: $30,000 ■ This Amendment shall be retroactive to the effective date of October 31, 2009 ■ The term of the Agreement is extended to June 30, 2010.
