2018/02/22 Planning Commission MinutesROHNERT PARK PLANNING COMMISSION MINUTES February 22, 2018 The Planning Commission of the City of Rohnert Park met this date in a regular session commencing at 6:00 p.m. in the City Hall Council Chambers, 130 Avram Avenue, with Chairperson Adams presiding. Call To Order Chairperson Adams called the meeting of the regular session to order at approximately 6:00 p.m. with Chairperson Adams leading the pledge. Roll Call Present: (3) Commissioners: Commissioner Adams, Commissioner Borba, Commissioner Giudice were present. Commissioner Blanquie and Commissioner Haydon were excused. Planning Manager, Jeff Beiswenger, Planner III, Zachary Tusinger and Recording Secretary, Suzie Azevedo were present. Declaration of None. Abstention Acknowledgement of Chairperson Adams acknowledged the posting of the Agenda of this meeting in Public Noticing three (3) public places, per the requirements of the Brown Act. Approval of Minutes ACTION: Moved/seconded (Giudice/Borba) to approve the minutes of the November 1, 2017 regular Planning Commission meeting as presented. Motion carried by the following unanimous 3-0-0 vote: AYES: Adams, Borba, Giudice; NOES: None; ABSTAIN: None; ABSENT: Blanquie, Haydon Unscheduled Public None. The project will be readvertised as appropriate for a future meeting. ACTION: Item tabled until further notice. Planning Commission Minutes February 22, 2018 CONT/ONAL USE PERMIT File No. PLUP17-0005 Carlos Ortiz/Luduka's Cafe CONSIDERATION OF RESOLUTION NO. 2018-17 DENYING THE CONDITIONAL USE PERMIT FOR LIVE ENTERTAINMENT AT LUDUKA'S CAFE, 7285 SNYDER LANE, SUITE A Planner III, Zachary Tusinger, presented the staff report. Mr. Tusinger reviewed the operational details of the proposed karaoke use and noted the following: • Cafe opened Spring 2017 • Code/Public Safety Compliance issues • Public Safety Calls: October, November, December • CUP application filed November 27, 2017 • Emails and letters from neighbors related to noise and nuisance December, January, February Mr. Tusinger outlined considerations as follows: • Operating in violation of zoning ordinance (without permit) • Noise impacts have generated complaints from surrounding residences, demonstrating incompatibility: siting, timing, orientation, intensity, management RECOMMENDED ACTION(S): Conduct a public hearing, consider all testimony, adopt Resolution No. 2018-17 denying a Conditional Use Permit to allow a live entertainment (karaoke) at Luduka's Cafe. Chairperson Adams opened the public hearing. Public Comment: The applicant, Carlos Ortiz, was recognized and spoke briefly to the Commission and apologized for the non-compliance issues that currently exist. Code Compliance Officer, Jette Selberg, was introduced and responded to questions from the Commission. The following residents spoke in opposition of the proposal: Richard Crawford, 7237 Roxanne Lane Peter Imbs, 7241 Roxanne Lane Donna Leslie, 7253 Roxanne Lane Chairperson Adams closed the public hearing. ACTION: Moved/seconded (Borba/Giudice) to adopt Planning Commission Resolution No. 2018-17 denying a Conditional Use Permit to allow live entertainment (karaoke) at Luduka's Cafe. Motion carried by the following unanimous 3-0 vote: AYES: Adams, Borba, Giudice; NOES: None; ABSTAINS: None; ABSENT: Blanquie, Haydon Oral Item will be presented at the next regularly scheduled Planning Commission Presentation/Discussion meeting when all Commissioners are present.
