A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK, CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT FOR TO ALLOW AN ADULT DAY CARE FACILITY IN AN EXISTING
MULTI TENANT SPACE LOCATED AT 5420 STATE FARM DRIVE
(APN 143-021-046)
WHEREAS, the applicant, Maribeth Lucero, Amani Day Service, filed Planning
Application No. PLUP 18-0001 for a Conditional Use Permit to allow an adult day care facility at
5420 State Farm Drive (APN143-021-046, in accordance with the City of Rohnert Park
Municipal Code;
WHEREAS, Planning Application No. PLUP 18-0001 was processed in the time and
manner prescribed by State and local law;
WHEREAS, on March 8, 2018, the Planning Commission reviewed Planning
Application No. PLUP 18-0001 during a scheduled and duly noticed public hearing at which time
interested persons had an opportunity to testify either in support of or opposition to the project;
and
WHEREAS, at the March 8, 2018, Planning Commission meeting, upon hearing and
considering all testimony and arguments, if any, of all persons desiring to be heard, the
Commission considered all the facts relating to Planning Application No. PLUP 18-0001;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Findings. The Planning Commission, in approving Planning Application No.
PLUP 18-000 makes the following findings, as required by Municipal Code section 17.25.014
(finding for conditional use permits), to wit:
A. That the proposed location of the conditional use is consistent with the objectives of the
zoning ordinance and the purpose of the district in which the site is located.
Criteria Satisfied. The, I -L/C -R overlay zoning designation supports a broad range of
commercial activity, including commercial uses that provides goods and services that
serve the community and outlying areas within an eight to twenty mile radius. The day
care facility proposal is consistent with this designation in that it will provide a
convenient and needed service to families residing or working in this area that desire a
personal enrichment service for special needs adults.
B. That the proposed location of the conditional use and the conditions under which it
would be operated or maintained will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the vicinity, and that the
operation and maintenance of the conditional use will be compatible with the
surrounding uses.
Criteria Satisfied. The project will be limited in nature and will not have a negative
effect on the public health, safety, or welfare or be materially injurious to properties or
improvements in the vicinity. The proposed adult day care center would occupy tenant
space within an existing building and does not propose expansion of floor area or new
construction of structures. The adult day program also provides a pick-up and drop-off
transportation service for all clients participating in the program which will ensure that
the on-site parking supply is more than adequate for this use. Sufficient staffing is also
available to monitor all day to day program activity.
C. The proposed conditional use will comply with each of the applicable provisions of this
title.
Criteria Satisfied. The day care facility will adhere to any and all conditions of approval.
Section 4. Environmental Clearance. The project is categorically exempt from the California
Environmental Quality Act, pursuant to Public Resources Code Section 15301 (Class 1 —
Existing Facilities).
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PLUP17-0003 subject to the following conditions:

I . Expiration of Approval - Pursuant to the City of Rohnert Park Municipal Code, this
approval shall expire one year from the Planning Commission approval date, unless prior
to the expiration a building permit is issued for any tenant improvements and
construction is commenced and diligently pursued toward completion AND/OR the use is
initiated, or an extension is requested and approved.
2. Conformance with Municipal Code and Other Agency Plans — All improvements shall
comply with all applicable sections of the City of Rohnert Park Municipal Code and any
other applicable relevant plans of affected agencies including the State Department of
Social Services/Community Care licensing.
The applicant shall obtain all necessary permits and clearances from the Rohnert Park
Building and Public Safety Departments for any modifications to the interior or exterior
of the building.
4. All activities associated with the day care use shall be conducted indoors.
5. The handicap accessible parking stall at the rear of the property shall be used for
daytime/overnight parking and when the transport van is not in use for drop off or pick
up.
6. The use shall be operated in a manner that does not create a public or private nuisance.
Any such nuisance must be abated immediately upon notice by the City.
7. The site and surrounding area shall be maintained free of litter, refuse, and debris.
Building, Engineering, and Public Safety
8. Prior to occupancy, the fire sprinklers require a current 5 year certification by a licensed
servicing contractor.
9. All work shall comply with all codes, ordinances or standards, whether shown on the
plans or not.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
DULY AND REGULARLY ADOPTED on this 8th day of March, 2018 by the City of
Rohnert Park Planning Commission by the following vote:
