A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND
ARCHITECTURAL REVIEW FOR THE MODIFICATION OF RALEY'S MARKET
CONDITIONS OF APPROVAL TO ALLOW OUTDOOR VENDING MACHINES AT
100 RALEY'S TOWNE CENTER (APN 143-051-054)

WHEREAS, the applicant, Mark Marvelli SKW Architects, filed Planning Application
No. PLCO2014-0001 for Site Plan and Architectural Review to allow modification to the
Condition number 9 of the that prohibits outdoor vending machines for Raley's Market at 100
Towne Center Drive (APN 143-051-054), in accordance with the City of Rohnert Park
Municipal Code;
WHEREAS, Planning Application No. PLCO2014-0001 was processed in the time and
manner prescribed by State and local law;
WHEREAS, on January 22, 2015, the Planning Commission reviewed Planning
Application No. PLCO2014-0001 at which time interested persons had an opportunity to testify
either in support of or opposition to the project; and,
WHEREAS, at the January 22, 2015, Planning Commission meeting, upon considering
all testimony and arguments, if any, of all persons desiring to be heard, the Planning Commission
considered all the facts relating to Planning Application No. PLCO2014-0001;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Factors considered. The Planning Commission, in approving Planning
Application No. PLCO2014-0001, makes the following factors, to wit:
A. That the developments general appearance is compatible with existing development and
enhances the surrounding neighborhood.
Criteria Satisfied. The new facade treatment for the Raley's Market will be a substantial
improvement in the appearance of the market. The location of the two (2) proposed
vending machines will be to the side and set back from the front facade of the market.
They will not distract from the new front facade of Raley's Market.
B. That the development incorporates a variation from adjacent on-site and off-site
structures in height, bulk, and area; arrangement on the parcel; openings or breaks in
the fagade facing the street; and/or the line and pitch of the roof.
Criteria Satisfied. The two (2) vending machines will be in a location that will be
convenient to customers using the machines and will not be a distraction to the market
operation or other businesses in the vicinity.
C. That the development will be located and oriented in such a manner so as to provide
pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate,
and avoids indiscriminate location and orientation.
Criteria Satisfied. Pedestrian and bicycle access will adequate to the location of the
vending machines,
Section 3. Environmental Clearance. The project is categorically exempt from the
California Environmental Quality Act (CEQA), Article 19, Section 15301 Existing Facilities
Expansion.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PLSR2014-0009 and PLCO2014-0009 subject to the
following conditions:
The Site Plan and Architectural Review shall expire one year from the Planning
Commission approval date, unless prior to the expiration a building permit is issued
and construction is commenced and diligently pursued toward completion and the
use is initiated, or an extension is requested and approved.
2. The facility shall comply with any and all applicable provisions of the Rohnert Park
Municipal Code and any state or federal agency requirements.
3. The only vending machines permitted on the exterior of the building are an
enclosure for propane tank exchange and a vending machine that dispenses water
into the customer's container.
4. Any electrical and water connection to the vending machines shall be located
directly behind the machine to screen the connections from view.
5. Building Permits shall be obtained for any electrical or water connections to the
vending machines.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
DULY AND REGULARLY ADOPTED on this 22nd day of January, 2015 by the City
of Rohnert Park Planning Commission by the following vote:
