2015/08/13 Planning Commission ResolutionPLANNING COMMMISSION RESOLUTION NO. 2015-11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND ARCHITECTURAL REVIEW FOR AN ADDITION TO MARY'S PIZZA SHACK (APN 160-010-024) (Cullen Williamson for Mary's Pizza Shack) WHEREAS, the applicant, Cullen Williamson for Mary's Pizza Shack, filed Planning Application No. PLSR2015-0002 for Site Plan and Architectural Review to allow construction of a new dining/event room, new back bar area, bar dining area, kitchen addition and relocation of refuse enclosure on property located at 101 Golf Course Drive (APN 160-010-024) in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PLSR2015-0002 was processed in the time and manner prescribed by State and local law; WHEREAS, on August 13, 2015, the Planning Commission reviewed Planning Application No. PLSR2015-0002 at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the August 13, 2015, Planning Commission meeting, upon considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PLSR2015-0002. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PLSR2015-0002, makes the following factors, to wit: A. That the developments general appearance is compatible with existing development and enhances the surrounding neighborhood. Criteria Satisfied. Mary's Pizza Shack is located at 101 Golf Course Drive at the northeast corner of Roberts Landing Road and Golf Course Drive.. The proposed improvements are to construct new dining/event room, new back bar area, bar dining area, kitchen addition and relocation of refuse enclosure. The exterior modifications will match the architecture and appearance of the existing building. The improvements will be compatible with other shopping improvements on the site. B. That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the fagade facing the street; and/or the line and pitch of the roof. Criteria Satisfied. The proposed modification to Mary's Pizza Shack is very minor and will not consist of major changes to the exterior of the building. C. That the development will be located and oriented in such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientation. Criteria Satisfied. Pedestrian, bicycle and vehicular access to the site will not change from the existing conditions. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act (CEQA), Article 19, Section 15301 (Existing Facilities Expansion). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLSR2015-0002 subject to the following conditions: 1. The Site Plan and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency. 3. Any landscaping damaged during construction shall be replaced. 4. A variety of shrubs and groundcover shall be planted along the west wall of the event room addition to replace the shrubs removed, details subject to staff approval. 5. Three inverted U bicycle racks shall be provided adjacent to the entrance of the building, details subject to approval of the Development Services Department. 6. The property shall be maintained in a weed free and litter free condition at all times. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
