2015/12/10 Planning Commission ResolutionPLANNING COMMMISSION RESOLUTION NO. 2015-18 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND ARCHITECTURAL REVIEW FOR REMODEL OF AN EXISTING OFFICE BUILDING INTO A DENTAL OFFICE 6230 STATE FARM DRIVE (APN 143-051-020) (Mohsen Ghoreishi Representing Anthony Lieu DMD) WHEREAS, the applicant, Mohsen Ghoreishi Representing Anthony Lieu DMD, filed Planning Application No. PLSR2015-0005 for Site Plan and Architectural Review to remodel an existing office into a dental office (APN 143- 051-020), in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Applications No. PLSR2015-0005 was processed in the time and manner prescribed by State and local law; WHEREAS, on December 10, 2015, the Planning Commission reviewed Planning Application No. PLSR2015-0005 at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the December 10, 2015, Planning Commission meeting, upon considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PLSR2015-0005. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors Considered. The Planning Commission, in approving Planning Application No. PLSR2015-0005, makes the following factors, to wit: A. That the developments general appearance is compatible with existing development and enhances the surrounding neighborhood. Criteria Satisfied. The remodel of the office building and rehabilitation of the landscaping will enhance the general appearance of the property. It will also be an improvement in the surrounding commercial and residential area. R That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the fagade facing the street; and/or the line and pitch of the roof. Criteria Satisfied. The remodeled office building will be an attractive improvement from the State Farm Drive and City Center Drive street frontages, surrounding properties and the public access to the City Library and Public Safety Building. The proposed improvements in the landscaping will enhance the appearance of the building and parking area. C. That the development will be located and oriented in such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientation. Criteria Satisfied. Vehicular access to the office building is from State Farm Drive and City Center Drive. That access will remain and is more than adequate. There is also adequate pedestrian and bicycle access from State Farm Drive and City Center Drive. The dental office will also be within walking distance to the SMART train station on Rohnert Park Expressway. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act (CEQA), Article 19, Section 15301 (Existing Facilities). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLSR2015-0005 subject to the following conditions: Planning: 1. The Site Plan and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency. 3. This approval is for the existing office building site only and does not include approval of a new office building on the adjacent parcel to the east of the subject property. 4. Any landscaping damaged during construction shall be replaced. 5. Prior to issuance of a Building Permit, the applicant shall submit for Development Services approval a revised landscape plan with the following details: • Indicate existing trees to be removed. • Replace the removed trees with 24 inch box Arbutus Marina or Trident Maple. • If available, recycled water shall be used for the landscaped areas. 6. Prior to installation of any signs, the applicant shall apply for Sign Review approval. 7. Tree root damage to the parking lot shall be repaired. 8. The inverted U bicycle stand shall be provided for bicycle parking. Engineering: The following conditions shall be conformed to prior to issuance of a Certificate of Occupancy. 9. Provide a walkway connection to the building front door for the four new parking spaces along the south side of the building. 10. The curb ramp at the south east corner of the building creates a pinch point between the building corner and the top of the ramp. The layout should be revised to provide a minimum 4` -wide flat sidewalk area between the building corner and the top of the ramp. 11. Parking Space 1 will block access to the trash enclosure. Shift the parking row to the south (also resolving the issue in (2) above) or relocate the enclosure to the center of the drive aisle between the parking rows (this will require relocating the existing drain inlet). 12. The trash enclosure may be on conflict with the existing transformer on City Hall Drive. Provide adequate separation as required by PG&E. 13. Adjust the' north end of the parking aisle to maintain the backing area for vehicles exiting Parking Space 1 on each lot. 14. Reconstruction of the parking lot, dependent on the square footage of new pavement, may trigger the need for storm runoff treatment via the landscaping. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
