2014/02/13 Planning Commission Minutesr �q ROHNERT PARK PLANNING COMMISSION MINUTES Thursday, February 13, 2014 The Planning Commission of the City of Rohnert Park met this date in a regular session commencing at 6:00 p.m. in the City Hall Council Chambers, 130 Avram Avenue, with Chairperson Giudice presiding. Call To Order Chairperson Giudice called the meeting of the regular session to order at approximately 6:00 p.m. with Chairperson Giudice leading the pledge. Roll Call Present: (4) Commissioners: Chairperson Giudice, Commissioner Adams, Commissioner Blanquie and Commissioner Haydon, were present. Commissioner. Commissioner Borba was excused. Technical Advisor, Norm Weisbrod was present. Declaration of Abstention Acknowledgement of Chairperson Giudice acknowledged the posting of the Agenda of this meeting in Public Noticing three (3) public places, per the requirements of the Brown Act. Approval of Minutes A motion was made by Commissioner Adams, seconded by Commissioner Blanquie to approve the January 16, 2014 minutes as corrected. The motion passed with a 4-0 vote. (AYES: Adams, Blanquie, Haydon, Giudice; NOES: 0, ABSENT: Borba). Unscheduled Public Appearances Conditional Use Permit Technical Advisor, Norm Weisbrod presented the staff report. Since October of 2012, the applicant has operated a tattoo parlor on Southwest Boulevard. In File No. PLUP2014-0001 addition to tattooing, the applicant also provides piercing services. Weisbrod reported that the applicant proposes moving to 170 Raley's Town Center for more Glen Luger/Bohemian exposure to foot and auto traffic. Raley's Town Center is in the C-R Regional Tattoo Commercial District. A tattoo parlor in the C-R District requires Conditional Use Approval. Weisbrod recommended approval as conditioned. Chairperson Giudice opened the public hearing. The applicant, Glen Luger was recognized and briefly spoke to the Commission. Chairperson Giudice closed the public hearing. A brief discussion was held. A motion was made by Commissioner Adams, seconded by Commissioner Blanquie to adopt Resolution No. 2014-06 approving Conditional Use Approval to Planning Commission Minutes January 23, 2014 allow a Tattoo Parlor at Raley's Town Center, subject to the findings and conditions of approval. The motion passed with a 4-0 vote (AYES: Adams, Blanquie, Haydon, Giudice; NOES: 0; ABSENT: Borba). Conditional Use Permit Technical Advisor Weisbrod presented the staff report. Recently, Mary's Pizza received Conditional Use approval for live entertainment on the patio during the File No. PL2014-0002 months of July, August, September and October of 2013. They are now requesting live entertainment on a permanent basis as follows: Cullen Williamson/Mary's Pizza Sunday through Thursday 5 p.m. to 8 p.m. Shack Friday and Saturday 5 P.M. to 11:00 P.M. Weisbrod reported that their supporting statement states they would like to have the live music on the patio from April through November. However, if the weather permitted they would probably have live music on a year around basis. Weisbrod recommended approval as conditioned. A brief discussion was held. Chairperson Giudice opened the public hearing. The applicant, Cullen Williamson was present and briefly spoke to the Commission. Commissioner Giudice closed the public hearing. A motion was made by Commissioner Adams, seconded by Commissioner Haydon to adopt Resolution 2014-05 approving Conditional Use Approval to allow Live Entertainment for Mary's Pizza Shack, amending Condition 3 (allow till closing). The motion passed with a 4-0 vote (AYES: Adams, Blanquie, Haydon, Giudice; NOES: 0; ABSENT: Borba). Items from the Planning Chairperson Giudice spoke of City Council and Planning Commission joint Commission meeting. Matters from Planning Staff Adjournment There being no further business, Chairperson Giudice adjourned the meeting at 6:20 p.m.
