2014/05/08 Planning Commission MinutesROHNERT PARK PLANNING COMMISSION MINUTES Thursday, May 8, 2014 The Planning Commission of the City of Rohnert Park met this date in a regular session commencing at 6:00 p.m. in the City Hall Council Chambers, 130 Avram Avenue, with Chairperson Giudice presiding. Call To Order Chairperson Giudice called the meeting of the regular session to order at approximately 6:00 p.m. with Vice -Chairperson Blanquie leading the pledge. Roll Call Present: (4) Commissioners: Commissioner Giudice, Commissioner Blanquie, Commissioner Borba, Commissioner Haydon were present. Commissioner Adams was excused. Interim Director of Development Services, Marilyn Ponton and Technical Advisor, Norm Weisbrod were present. — Declaration of — -- -.......... .............. None. Abstention Chairperson Giudice acknowledged the posting of the Agenda of this meeting in Acknowledgement of Public Noticing three (3) public places, per the requirements of the Brown Act. Approval of Minutes A motion was made by Commissioner Blanquie, seconded by Commissioner Borba to approve the April 24, 2014 minutes as corrected: Reflect Commission's consensus that the Planning Commission viewed the addition at 8020-8050 Beverly as new construction. The motion passed with a 4-0 vote. (AYES: Giudice, Blanquie, Ha don, Borba; NOES: 0; ABSENT: Adams). Unscheduled Public Appearances Site Plan & Architectural Norm Weisbrod presented the staff report. At the January 16, 2014 Planning Review Commission Meeting, the Commission approved a Conditional Use Permit for Flipside Bar and Burger to operate a microbrewery at their proposed restaurant File No. PLSR2014-0003 located at 5000 Roberts Lake Road. The applicant, Nino Rabbaa is now proposing expansion of the brewing process area on the west side of the building Nino Rabbaa/Invest near the main entrance to the restaurant. They will also be expanding the Hospitality Wine existing patio overlooking Roberts Lake. Mr. Weisbrod reviewed the operational Country and structural details of the proposal and recommended approval subject to conditions in Resolution 2014-22. The applicant, Nino Rabbaa, was recognized and briefly spoke to the Commission. A brief discussion was held by staff and the Commission - A motion was made by Commissioner Borba, seconded by Commissioner Blanquie to adopt Resolution No. 2014-22 approving Site Plan and Architectural Review to allow expansion of the microbrewer and patio area to the existing Planning Commission Minutes Mov 8, 2014 General Plan Consistency Finding File No. PLC12014-0001 City of Rohnert Park Old Business PLSR2014-0002 8020-8050 Beverly Items from the Planning Commission restaurant, subject to the findings and conditions of approval. The motion passed with a 4-0 vote. (AYES: Giudice, Blanquie, Haydon, Borba; NOES: 0; ABSENT: Adams). Marilyn Ponton presented the staff report. The Planning Commission is charged with the responsibility for ensuring that adopted plans are consistent with goals and policies of the adopted General Plan. The Planning Commission is being requested to review the attached draft Five -Year Capital Improvements Program FY 2014-15 through 2018-19 (CIP) to determine consistency with the General Plan. The CIP is proposed to be adopted by the City Council with the fiscal year 2014-2015 Budget. A motion was made by Commissioner Haydon, seconded by Commissioner Borba to adopt Planning Commission Resolution No. 2014-23 reporting to the City Council that the draft Five Year Capital Improvement Program Budget FY 2014- 15 through 2018-2019 is consistent with the Rohnert Park General Plan 2020. The motion passed with a 4-0 vote. (AYES: Giudice, Blanquie, Haydon, Borba; NOES: 0; ABSENT: Adams). Norm Weisbrod reported that at the April 24, 2014 Planning Commission meeting, the Commission considered Site Plan and Architectural Review for a proposal to construct two two-bedroom units over existing carports at Beverly Apartments. Because of an existing fire at this complex, the Commission recommended that a condition 7. be added to require that the two new units be provided with fire sprinklers. Staff consulted with Dan Adam, Fire Marshall, regarding the fire sprinklers. Mr. Adam classifies Beverly Apartments as a commercial type use. Under the 2013 Fire Code, additions, remodels, alterations or repairs that do not increase the gross floor area by more than 25% do not have to provide fire sprinklers. Under the Fire Code the City therefore cannot require that the units be provided with fire sprinklers. The consensus of the Commission was that Planning determines if commercial or residential (zoning is residential); take precaution due to history of fire incidents and require units to be sprinkled. The Commission also inquired about the absence of Dan Adam at the meeting. The Commission directed staff to obtain excerpts from the Fire Code applicable to this matter and request the Fire Marshall be in attendance to discuss.
