2014/06/12 Planning Commission Resolution (2)PLANNING COMMMISSION RESOLUTION NO. 2014-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND ARCHITECTURAL REVIEW FOR THE REMODEL OF PARK PLAZA SHOPPING CENTER AT 6350 TO 6400 COMMERCE BOULEVARD (APN 143-051-32, 33, 68 & 69) (Bruce Wilson for Caltex Equities) WHEREAS, the applicant, Bruce Wilson for Caltex Equities, filed Planning Application No. PLSR2014-0005 for Site Plan and Architectural Review to allow building facade improvements and modifications to landscaping on property located at 6350 to 6400 Commerce Boulevard (APN 143-051-32, 33, 68 and 69), in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PLSR2014-0005 was processed in the time and manner prescribed by State and local law; WHEREAS, on June 12, 2014, the Planning Commission reviewed Planning Application No. PLSR2014-0005 at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the June 12, 2014, Planning Commission meeting, upon considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PLSR2014-0005; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PLSR2014-0005, makes the following factors, to wit: A. That the developments general appearance is compatible with existing development and enhances the surrounding neighborhood. Criteria Satisfied. The Park Plaza Shopping Center is located on Commerce Boulevard near the intersection with Rohnert Park Expressway. The shopping center and uses in the shopping center are permitted in the C-R Regional Commercial District. The proposed improvements to the building fagade and landscaping will improve the appearance of the shopping center and bring it up to current standards and in conformance with Rohnert Park's Design Guidelines. B. That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the fagade facing the street; and/or the line and pitch of the roof. Criteria Satisfied. The proposed modification to the shopping center building and landscaping will improve the front fagade of the building and will result in a more attractive shopping center. The architecture of the building will stand out as an attractive visual element in this commercial complex. C That the development will be located and oriented in such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientation. Criteria Satisfied. The shopping center provides excellent access for pedestrians and cyclists. Bicycle parking facilities will be included on the site. Driveways on Commerce Boulevard provide excellent vehicle access to the shopping center. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act (CEQA), Article 19, Section 15301 (Existing Facilities Expansion). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLSR2014-0005 subject to the following conditions: 1. The Site Plan and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency. 3. Any landscaping damaged during construction shall be replaced. 4. The existing Sign program for Park Plaza shopping center shall be revised to reflect the new design of the building fagade. 5. All exterior illumination shall consist of LED energy conserving fixtures. 6. The property shall be maintained in a weed free and litter free condition at all times. 7. Bicycle parking consisting of the inverted U design, shall be placed at convenient locations in the shopping center. 8. Prior to issuance of Building Permits for the facade modifications, the applicant shall submit to Development Services for review and approval details on improvements at the rear of the building for screening of the refuse and recycling containers that conform to the City standards and screening of any outdoor storage at the rear of the building. 9. There shall be no outside storage at the rear of the building at any time. 10. The east side of Buildings 2 and 3 shall be painted to match west and north building elevations. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
