A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK, CALIFORNIA, APPROVING ADMINISTRATIVE
PERMIT FOR SONOMA MOUNTAIN VILLAGE GREEN SUMMER CONCERT
SERIES

WHEREAS, the applicant, Morty Wiggins Second Octave Entertainment, filed Planning
Application No. PLAP-2014-0003 an Administrative Permit to allow outdoor music concerts to
take place in the courtyard at Sonoma Mountain Village in accordance with the City of Rohnert
Park Municipal Code;
WHEREAS, Planning Application No PLAP-2014-0003 was processed in the time and
manner prescribed by State and local law;
WHEREAS, on June 12, 2014, the Planning Commission reviewed Planning Application
No. PLAP-2014-0003 at which time interested persons had an opportunity to testify either in
support of or opposition to the project; and,
WHEREAS, at the June 12, 2014, Planning Commission meeting, upon considering all
testimony and arguments, if any, of all persons desiring to be heard, the Commission considered
all the facts relating to Planning Application No. PLAP-2014-0003;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Factors considered. The Planning Commission, in approving Planning
Application No. PLAP-2014-0003, makes the following factors, to wit:
A. That the developments general appearance is compatible with existing development and
enhances the surrounding neighborhood.
Criteria Satisfied. The area where the concerts will take place is at the south side of SMV
in an area surrounded on three sides by multi story buildings. The concerts will take
place in the evening hours when parking on the property will be available to concert
attendees. At this location, the concert stage will be over 1000 feet to any residential
structures.
B. That the development incorporates a variation from adjacent on-site and off-site
structures in height, bulk, and area; arrangement on the parcel; openings or breaks in
the fagade facing the street; and/or the line and pitch of the roof.
Criteria Satisfied. The proposal will use existing facilities at SMV including parking,
open areas and electrical power.
C. That the development will be located and oriented in such a manner so as to provide
pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate,
and avoids indiscriminate location and orientation.
Criteria Satisfied. The proposal is at a location that has excellent vehicular access,
pedestrian and bicycle access. The concerts will take place in a location that lessens the
impact on adjacent single-family and multi -family homes.
Section 3. Environmental Clearance. An Environmental Impact Report (SCH No.
20070521116) was prepared for the Sonoma Mountain Village Specific Plan. This EIR covered
outdoor activities on the site including sports events and other outdoor activities on the site.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PLAP-2014-0003 subject to the following conditions:
1. The Administrative Permit approval shall expire one year from the Planning
Commission approval date, unless prior to the expiration the use is initiated, or an
extension is requested and approved.
2. Music shall cease no later than 10:00 p.m.
3. The gates to the facility shall open no earlier than 6:00 p.m. and any material
advertising the event shall ask attendees to arrive no earlier than 6:00 p.m.
4. Periodic noise measurements shall be conducted during the concert events at the
mixing booth location. The noise measurements shall be recorded in a log. Noise
levels due to amplified sound events shall be limited to no more than 88 dBA Leq.
5. The applicant shall obtain an Amplified Sound Permit from the Public Safety
Department, prior to any event.
6. The applicant shall hire Public Safety officers with the number required determined
by the Public Safety Department.
7. The applicant shall obtain an Electrical Permit from the Development Services
Department.
8. Up to six (6) concerts may take place between the months of July and October,
2014.
9. All equipment for the concert may be placed on the site the day before a scheduled
concert and shall be removed the day after the concert.
10. At the completion of the 2014 concert season, this application shall be reviewed by
the Planning Commission and, if the Commission determines that the concert series
did not result on any detrimental impacts to Sonoma Mountain Village or the
surrounding residents, the Commission may renew the Administrative Permit for
2015.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
DULY AND REGULARLY ADOPTED on this 12th day of June, 2014 by the City of
Rohnert Park Planning Commission by the following vote:
