A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK RECOMMENDING TO THE CITY COUNCIL THE
ADOPTION OF A RESOLUTION OF APPLICATION TO THE SONOMA
LOCAL AGENCY FORMATION COMMISSION FOR REORGANIZATION OF
NORTHWEST SPECIFIC PLAN AREA LOCATED SOUTH OF MILLBRAE
AVENUE, WEST OF DOWDELL AVENUE, NORTH OF BUSINESS PARK
DRIVE, AND EAST OF LANGNER AVENUE IN SONOMA COUNTY, CA
WHEREAS, the applicant, the City of Rohnert Park, filed Planning Application
No. PLAX2014-0001 proposing approval of a Specific Plan ("Specific Plan"), Prezoning,
and General Plan Amendments for the Northwest Specific Plan Area ("Project"), as well
as certification of an Environmental Impact Report ("EIR") for the Project, in accordance
with the City of Rohnert Park Municipal Code ("RPMC"); and
WHEREAS, the City of Rohnert Park adopted its General Plan in 2000; and
WHEREAS, the citizens of the City of Rohnert Park approved an Urban Growth
Boundary ("UGB") in 2000 which defines the limits of future development; and
WHEREAS, the City of Rohnert Park General Plan includes properties outside of
the current City limits and within the City's Sphere of Influence ("SOI") and UGB that
are intended to be annexed to the City upon preparation of Specific Plans for these
properties; and
WHEREAS, the approximately 100 acre area located south of Millbrae Avenue,
west of Dowdell Avenue, north of Business Park Drive, and east of Langner Avenue is
identified in the General Plan as the Northwest Specific Plan Area; and
WHEREAS, the City has prepared the Specific Plan for the Northwest Specific
Plan Area and a Final EIR for the proposed Specific Plan; and
WHEREAS, the Project anticipates that the Specific Plan area will be annexed to
the City and proposes to prezone the Specific Plan area "Specific Plan District (SP)" in
conformance with the City's General Plan; and
WHEREAS, California Government Code Section 56744 prohibits any
annexation that would result in the creation of an unincorporated island or islands
(unincorporated territory substantially surrounded by a city); and
WHEREAS, a reorganization is defined by California Government Code Section
56073 as a single proposal involving two or more changes of organization, such as
annexation and detachment; and
WHEREAS, pursuant to California State Law and the Rohnert Park Municipal
Code, public hearing notices were mailed to all property owners within an area exceeding
a 300 foot radius of the subject property, public hearing notice signs were posted on the
property, and a public hearing was published for a minimum of 10 days prior to the first
public hearing in the Community Voice; and
WHEREAS, on September 11, 2014, the Planning Commission held a public
hearing at which time interested persons had an opportunity to provide public testimony
either in support of or opposition to the Project; and
WHEREAS, the Planning Commission reviewed the Final EIR prepared for the
Project which includes annexation within its Project description, recommended its
certification by the City Council, and has otherwise carried out all requirements of the
California Environmental Quality Act ("CEQA").
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Rohnert Park makes the following findings, determinations, and
recommendations with respect to the proposed Project:
Section 1. The above recitations are true and correct, and material to this
Resolution.
Section 2. Environmental Clearance. An application to the Sonoma Local
Agency Formation Commission for reorganization of the territory depicted in Exhibit A
is in accordance with applicable provisions of CEQA, pursuant to the Final EIR for the
Project. The Planning Commission has recommended approval of the Final EIR, which
includes annexation within the Project description, as well as the adoption of CEQA
Findings, Statement of Overriding Considerations and the Mitigation Monitoring
Program, as described in Planning Commission Resolution No. 2014-32, approved on
September 11, 2014.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
recommend that the City Council of adopt a Resolution of Application to the Sonoma
Local Agency Formation Commission for Reorganization of Territory located south of
Millbrae Avenue, west of Dowdell Avenue, north of Business Park Drive, and east of
Langner Avenue.
BE IT FURTHER RESOLVED that in accordance with the policies of the
Sonoma Local Agency Formation Commission, the recommended title of this proposal is
"Rohnert Park Reorganization 14-1 involving Annexation to the City of Rohnert Park"
and the recommended short form designation is "Northwest Area Reorganization."
