2014/09/25 Planning Commission ResolutionPLANNING COMMMISSION RESOLUTION NO. 2014-38 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND ARCHITECTURAL REVIEW AND A SIGN PROGRAM FOR THE REMODEL AND SIGNAGE FOR 10 ENTERPRISE SHOPPING CENTER AT 10 ENTERPRISE DRIVE (APN 143-051-48) (AileenTurner of Korody Business Services for Hamilton Ave RWC LLC) WHEREAS, the applicant, Aileen Turner for Korody Business Services, filed Planning Application No. PLSR2014-0008 for Site Plan and Architectural Review to allow building facade improvements and modifications to landscaping and a Sign Program for the shopping center signage on property located at 10 Enterprise Drive (APN 143-051-48), in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PLSR2014-0008 was processed in the time and manner prescribed by State and local law; WHEREAS, on September 25, 2014, the Planning Commission reviewed Planning Application No. PLSR2014-0008 at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the September 25, 2014, Planning Commission meeting, upon considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PLSR2014-0008; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PLSR2014-0008, makes the following factors, to wit: A. That the developments general appearance is compatible with existing development and enhances the surrounding neighborhood. Criteria Satisfied. The 10 Enterprise Shopping Center is located on Enterprise Drive near the intersection with Commerce Boulevard. The shopping center and uses in the shopping center are permitted in the C-R Regional Commercial District. The proposed improvements to the building facade and landscaping and installation of a refuse enclosure will improve the appearance of the shopping center and bring it up to current standards and in conformance with Rohnert Park's Design Guidelines. The Sign Program will provide for consistent and attractive signage for the shopping center. B. That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the fagade facing the street; and/or the line and pitch of the roof. Criteria Satisfied. The proposed modification to the shopping center building and landscaping will improve the front fagade of the building and will result in a more attractive shopping center. The architecture of the building will stand out as an attractive visual element in this commercial complex. C That the development will be located and oriented in such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientation. Criteria Satisfied. The shopping center provides excellent access for pedestrians and cyclists. Bicycle parking facilities will be included on the site. Two driveways on Enterprise Drive provide excellent vehicle access to the shopping center. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act (CEQA), Article 19, Section 15301 (Existing Facilities Expansion). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLSR2014-0008 subject to the following conditions: The Site Plan and Architectural Review and the Sign program approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency requirements. 3. Any landscaping damaged during construction shall be replaced. 4. All exterior illumination shall consist of LED energy conserving light fixtures including the existing pole light. 5. The property shall be maintained in a weed free and litter free condition at all times. 6. Bicycle parking consisting of the inverted U design, shall be placed at a convenient location- in the shopping center. 7. There shall be no outside storage on the site. 8. The applicant may modify the windows in the corner vacant unit to make the unit more suitable to future tenants. 9. The face area of the proposed directional sign large at the easterly driveway entrance to the shopping center shall be reduced to ten (10) square feet. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
