A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK RECOMMENDING APPROVAL TO THE CITY COUNCIL
THE PRESS DEMOCRAT TENTATIVE PARCEL MAP TO ALLOW THE
SUBDIVISION OF PROPERTY LOCATED AT 5505 REDWOOD DRIVE (APN
143-040-112)
WHEREAS, on June 24, 2014, the applicant, Sonoma Media Investments submitted
an application for the Press Democrat Tentative Parcel Map located at 5505 Redwood Drive
(APN 143-040-112);
WHEREAS, Planning Application No. PLSD2014-0005 is a two lot minor
subdivision of a 12.7 acre parcel into a 8.9 acre parcel and a 3.8 acre;
WHEREAS, the City has assessed the potential environmental impacts associated
with the Project and has prepared a Mitigated Negative Declaration. The Planning
Commission has reviewed the Mitigated Negative Declaration prepared for the Project;
recommended its adoption by the City Council; and has otherwise carried out all requirements
for the Project pursuant to CEQA; and
WHEREAS, pursuant to California State Law and the RPMC, public hearing notices
were mailed to all property owners within an area encompassing a three hundred foot radius
of the subject property and a public hearing notice was published for a minimum of 10 days
prior to the first public hearing in the Community Voice; and
WHEREAS, on November 13, 2014, the Planning Commission held a public hearing
at which time interested persons had an opportunity to testify either in support or opposition to
the proposal; and
WHEREAS, the Planning Commission has reviewed and considered the information
contained in Planning Application No. PLSD2014-0005 for the proposed minor subdivision
for the property; and
NOW THEREFORE BE IT RESOLVED, the Planning Commission of the
City of Rohnert Park does determine as follows:
Section 1. The above recitations are true and correct.
Section 2. Findings. The Planning Commission, in recommending approval
of the Press Democrat Tentative Parcel Map, application PLSD2014-0005, to the City
Council, makes the following findings:
1. The proposed map is consistent with the General Plan and the Zoning Ordinance
or any other applicable provisions of this code.
Criteria Satisfied. The map is consistent with the proposed General Plan designations of
Industrial and Regional Commercial and with the proposed zoning of I -L Industrial and
C-R Regional Commercial.
2. The site is physically suitable for the type of development.
Criteria Satisfied. The site is physically suitable to support the proposed development.
The existing development provides adequate access, parking, open space and building
arrangement for the existing use of the site. Development of the 3.8 -acre parcel is not
proposed at this time but is of adequate size to support regional commercial development
3. The design of the subdivision or the proposed improvements will not cause
substantial environmental damage or substantially and avoidable injure fish or wildlife
or their habitat, absent a statement of overriding conditions.
Criteria Satisfied. The existing development on the property has not caused any
environmental damage or injury to fish or wildlife or their habitat. Future commercial
development will have to conform to the Mitigation Measures of the Mitigated Negative
Declaration.
4. The design of the subdivision or the type of improvements will not cause serious
public health problems.
Criteria Satisfied. The proposed subdivision will occur on property that is partially
developed in accordance with the I -L Industrial zoning. The existing development has
not caused any known public health problems. Development of the remainder of the
project site is not proposed at this time but will conform to the proposed C-R Regional
Commercial zoning requirements.
5. The design of the subdivision or the type of improvements will not conflict with
easements, acquired by the public at large, for access through or use of property with the
proposed subdivision, absent alternative, equivalent easements.
Criteria Satisfied. The Tentative parcel Map will be conditioned to require reciprocal
cross access easements through the two parcels to be created for use by the businesses
operating on the two properties.
Section 3. Environmental Clearance. In accordance with the California Environmental
Quality Act (CEQA), an Initial Study was prepared to determine whether the proposed
project would have a significant adverse effect on the environment. On the basis of that
study, it was determined that the project would not have a significant adverse effect on
the environment with implementation of mitigation measures, and a Mitigated Negative
Declaration (MND) was prepared. The MND was circulated for public review between
October 3, 2014 and October 24, 2014.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Planning
Commission does hereby recommend that the City Council adopt the findings
hereinabove; approve the Press Democrat Tentative Parcel Map, as shown in Exhibit 1
attached to this resolution, subject to the following Conditions of Approval:
1. Expiration of Approval — Pursuant to the City of Rohnert Park Municipal Code
Section 16.10.050, this approval shall expire twenty-four (24) months after the
date of approval unless prior to the expiration the applicant files a request for an
extension of time in accordance with Government Code Section 66452.6(a).
2. Substantial Conformance — The Final Parcel Map and all improvements shall
comply with the Press Democrat Tentative Parcel Map date stamped received by
the City of Rohnert Park on June 24, 2014.
3. Conformance with the Rohnert Park Municipal Code and Other Agency Plans —
Improvements shall comply with all applicable sections of the City of Rohnert
Park Municipal Code and any other applicable relevant plans of affected agencies.
4. Any exceptions or variances from these conditions will require the written
approval of the City Engineer or approval of the Subdivision Committee if
required by City Code.
5. Reconfiguration of the Parcel 2 parking is shown to offset loss of parking on
Parcel 1. The parking lot improvements will need to be completed prior to filing
the parcel map, or bonded and guaranteed under an improvement agreement.
6. The parking lot improvements will result in additional impervious surface. The new and
reconfigured improvements will require treatment of storm runoff.
7. An access easement in favor of Parcel 2 is shown over Parcel 1, providing a
connection to Redwood Drive.
8. The existing driveway entry off the perimeter driveway at the south end of the road will be
blocked by the proposed parking improvements. The driveway should be removed or tied
into the new driveway improvements.
9. At the time of filing the parcel map, a joint access and maintenance agreement should be
recorded between the properties, covering the use and maintenance of common
improvements.
10. Prior to filing the final map, the existing water system on Parcel 2 shall be modified as
required by Public Works to provide separate domestic, fire, and irrigation services near
the point of connection on Business Park Drive. Backflow prevention shall be relocated to
Business Park Drive, protecting the onsite fire service loop. The location of the water
meter should be shown.
11. Separation of the existing irrigation system between the parcels should be completed prior
to filing the parcel map. This will require a separate meter. As an alternate, the separation
could be covered in an agreement between the two parcels.
