2015/01/08 Planning Commission ResolutionPLANNING COMMMISSION RESOLUTION NO. 2014-58 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND ARCHITECTURAL REVIEW FOR BOATHOUSE SUSHI GARDEN TERRACE EXPANSION (APN 143-391-077) (Fabian Graf for Boathouse Sushi) WHEREAS, the applicant, Fabian Graf for Boathouse Sushi, filed Planning Application No. PLSR2014-0011 for Site Plan and Architectural Review to allow a garden terrace expansion of Boathouse Sushi on property located at 6278 Redwood Drive (APN 143- 391-077), in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Applications No. PLSR2014-0011 was processed in the time and manner prescribed by State and local law; WHEREAS, on January 8, 2015, the Planning Commission reviewed Planning Application No. PLSR2014-0011 at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the January 8, 2015, Planning Commission meeting, upon considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PLSR2014-0011. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors Considered. The Planning Commission, in approving Planning Application No. PLSR2014-0011, makes the following factors, to wit: A. That the developments general appearance is compatible with existing development and enhances the surrounding neighborhood. Criteria Satisticd. The garden terrace will be compatible with the appearance of the existing restaurant building and will enhance the general appearance of the property. It will also be an improvement in the surrounding commercial area. B. That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the fagade facing the street; and/or the line and pitch of the roof. Criteria Satisfied. The garden terrace enclosure will be an attractive improvement from Redwood Drive and the surrounding properties. The recommended improvements in the landscaping will enhance the appearance of the parking area. C. That the development will be located and oriented in such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientation. Criteria Satisfied. Vehicular access to the restaurant is from Redwood Drive and Rohnert Park Expressway over an easement through the adjacent hotel property. All access points will not change and are more than adequate. There is also adequate pedestrian access from Redwood Drive and the adjacent hotel property. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act (CEQA), Article 19, Section 15301 (Existing Facilities Expansion of structures less than 2,500 square feet.). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLSR2014-0011 subject to the following conditions: 1. The Site Plan and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency. 3. Seating in the restaurant and garden terrace shall remain at 122 seats. 4. Any landscaping damaged during construction shall be replaced. 5. Prior to issuance of a Building Permit, the applicant shall submit for Development Services approval a revised landscape plan with the following details: • Landscaping of the areas north and east of the paved parking with a tree at every fourth parking space and a variety of shrubs and groundcover. • Landscaping in the paved area between parking stalls 17 and 18 as shown on Exhibit B. • If available, recycled water shall be used for the landscaped areas. 6. The monument sign shall not exceed eight (8) feet in height and shall be mounted on a masonry base or the support pole shall be enclosed by stone or other masonry, details subject to approval of the Development Services Department. 7. Prior to installation of any signs, the applicant shall apply for Sign Review approval. 8. Music or live entertainment shall not be provided in the outdoor area. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
