ROHNERT PARK PLANNING COMMISSION
MINUTES
Thursday, February 14, 2013
The Planning Commission of the City of Rohnert Park met this date in a regular session commencing at 6:00
p.m. in the City Hall Council Chambers, 130 Avram Avenue, with Chairperson Adams presiding.
Call To Order
Chairperson Adams called the meeting of the regular session to order at
approximately 6:00 p.m. with Chairperson Adams leading the pledge.
Roll Call
Present: (5) Commissioners: Chairperson Adams, Commissioner Borba
Commissioner Armstrong, Commissioner Giudice and Commissioner Haydon
were present. .
Planning and Building Manager, Marilyn Ponton and Secretary Suzie Azevedo
were present. .
Election of Officers to
Commissioner Haydon nominated Susan Adams to serve as Chairperson. The

Commissioner Haydon nominated Gerard Giudice to serve as Vice -Chairperson.
The nomination was seconded by Commissioner Armstrong and approved with a
5-0 vote.

Approval of Minutes
None. The minutes of the Planning Commission Meeting of January 24, 2013 will
be presented at the next meeting.
Conditional Use Permit
Planning and Building Manager, Marilyn Ponton, presented the staff report. She
stated that the applicant, Sheri Groszek, is requesting a conditional use permit to

operate a used car sales business at 5625 State Farm Drive. Ms. Ponton
reviewed the operational and site details of the proposed auto sales business and

recommended approval as conditioned.

A motion was made by Commissioner Borba, seconded by Commissioner
Giudice to adopt Resolution No. 2013-08 approving Conditional Use Permit for a
used car sales business at 5625 State Farm Drive, Suite 2. The motion passed
with a 5-0 vote.
Ms. Ponton presented the staff report. The existing building on the KRCB
property is located three (3) feet from the northerly property line of that site.
There is presently an application to develop the City owned property to the north
of KRCB with a 244 unit apartment complex (PL2012-039UP). The apartment
developer proposes constructing a six (6) foot high masonry wall along the
property line, shown in yellow in Exhibit C, separating the two properties. This will
result in the KRCB building having a three (3) setback from the wall making it
difficult to perform any maintenance on the northerly building wall. The apartment
developer has agreed to a lot line adjustment that will result in KRCB having an
eight (8) foot setback from the six (6) foot wall to provide them with an adequate
setback to perform maintenance on their building. A finding of general plan
consistency is required for the lot line adjustment.
Ms. Ponton briefly reviewed other site details and recommended that the
Commission adopt Resolution No. 2013-09 that the Planning Commission finds
that relocating the northerly property line of the KRCB property five (5) feet
northerly is consistent with the General Plan 2020.
A brief discussion was held between the Commission and staff.
A motion was made by Commissioner Borba, seconded by Commissioner Giudice
to adopt Resolution No. 2013-09, finding consistency with the General Plan 2020
for a lot line adjustment resulting in five (5) feet of property from lands of the City
of Rohnert Park being combined with property of Rural California Broadcasting
Corporation (KRCB). The motion passed with a 5-0 vote.
Ms. Ponton presented the staff report. There is a development application for a
244 unit apartment complex on the City property under the Stadium Area Master
Plan. The School District property located adjacent is developed with offices
and related uses. Some of the improvements on the School District property
extend into the adjacent City of Rohnert property, primarily a concrete patio, a
chain link fence and an electrical box. The developer of the apartment project is
agreeable to a lot line adjustment that would add five (5) feet to the School District
north property line and all of School District property improvements would be on
their own site. The developer will be constructing a six (6) foot high masonry wall
along the southerly property line of the development that will separate the School
District improvements from the apartment complex. This will insure the privacy of
the School District offices and the apartment residents. A finding of general plan
consistency is required for the lot line adjustment.
Ms. Ponton briefly reviewed other site details and recommended that the
Commission adopt Resolution No. 2013-10 that the Planning Commission finds
relocating the northerly property line of the KRCB property five (5) feet northerly is
consistent with the General Plan 2020.

Armstrong to adopt Resolution No. 2013-10, finding consistency with the General
Plan 2020 for a lot line adjustment resulting in five (5) feet of property from lands
of the City of Rohnert Park being combined with property of the Cotati-Rohnert
Park Unified School District. The motion passed with a 5-0 vote.

Ms. Ponton presented the staff report. A lot line adjustment is being proposed on

properties presently under City of Rohnert Park ownership. Parcel A contains the
City of Rohnert Park Animal Shelter. Parcel B is a portion of the former waste

water ponds presently abandoned. Parcel B under the Stadium Lands Master
Plan will be developed for high density residential. At the time Parcel B was used
City of Rohnert Park
as a waste water pond, there was a concrete structure constructed that was used
in directing the sewage in the storage ponds. The storage ponds are no longer
used but the concrete structure remains. Parcel B is indicated in the Stadium
Area Master Plan as high density residential. The concrete structure will be an
obstruction to the future development of the property. Under the proposed Parcel
Map, the lot line adjustment will transfer the structure to the adjacent Animal
Shelter site under the ownership of the City of Rohnert Park. The concrete
structure will then be the responsibility of the City. A finding of general plan
consistency is required for the lot line adjustment.
Ms. Ponton briefly reviewed other site details and recommended that the
Commission adopt Resolution No. 2013-11 finding consistency with the General
Plan 2020 for a lot line adjustment resulting in the transfer of an abandoned
concrete sewage drainage structure from a portion of the Stadium Land under the
control of the City of Rohnert Park to an adjacent property also under City of
Rohnert Park ownership housing the City of Rohnert Park Animal Shelter.
A motion was made by Commissioner Haydon, seconded by Commissioner
Armstrong to adopt Resolution No. 2013-11. The motion was passed with a 5-0
vote.
