2013/02/14 Planning Commission Resolution (4)PLANNING COMMMISSION RESOLUTION NO. 2013.09 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK CALIFORNIA, FINDING CONSISTENCY WITH THE GENERAL PLAN 2O2O FOR A LOT LINE ADJUSTMENT RESULTING IN FIVE (5) FEET OF PROPERTY FROM LANDS OF THE CITY OF ROHNERT PARK BEING COMBINED WITH PROPERTY OF RURAL CALIFORNIA BROADCASTING CORPoRATION (KRCB) (PORTION OF APN 143-040-125 AND 143-040-118) (City of Rohnert Park and Rural California Broadcasting Corporation) \ryHEREAS, the City of Rohnert Park and the Rural California Broadcasting Corporation (KRCB) enter into a lot line adjustment resulting in five (5) feet of land under the ownership of the City of Rohnert Park being transferred to property owned by the Rural California Broadcasting Corporation (KRCB) (Portion of APN 143-040-125 and 143-040-118) in accordance with the City of Rohnert Park Municipal Code; \ryHEREAS, Planning Application No. PL2013-004GP was processed in the time and manner prescribed by State and local law; \ryHEREAS, on February 14,2013, the Planning Commission reviewed Planning Application No. PL20I3-004GP during a public meeting at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the February 14,2013, Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Planning Commission considered all the facts relating to Planning Application No. PL2013-004GP; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in finding that the Lot Line Adjustment between the City of Rohnert Park and the Rural California Broadcasting Corporation (KRCB) was consistent with the General Plan 2020 makes the following factors, to wit: A. GM-H Minimize the ímpacts-physícal, visual andfiscal-of growth and annexation on exísting homes and businesses. The construction of a six (6) high masonry wall three (3) feet from the north wall of the KRCB building would negatively impact the KRCB business by loss of access for maintaining the north wall of the building. The lot line adjustment will result in an eight (8) foot setback of the masonry wall resulting in adequate area for KRCB to maintain their building. Section 3. An Environmental Impact Report (EIR), SCH #2005042111, was certified for the Stadium Area Master Plan. The EIR included the existing KRCB facilities as part of the Stadium Area Master Plan and no further CEQA action is required for modification to the access easements. NOIV THEREFORE BE IT RESOLVED, that the Planning Commission does hereby find that relocating the north property line of the KRCB property five (5) feet northerly is consistent with the General Plan2020.
