2013/04/25 Planning Commission ResolutionPLANNING COMMMISSION RESOLUTION NO. 2013-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, FINDING CONSISTENCY WITH THE GENERAL PLAN 2020 FOR ACQUISITION OF RIGHT-OF-WAY FROM SONOMA MEDIA INVESTMENTS, LLC (PRESS DEMOCRAT) AND C.B. PROPERTIES FOR THE EXTENSION OF DOWDELL AVENUE TO BUSINESS PARK DRIVE (PORTION OF APN 143-040-111 AND 064) (City of Rohnert Park) WHEREAS, the City of Rohnert Park proposes entering into a Purchase Agreement with Sonoma Media Investments, LLC (Press Democrat) and C. B. Properties for acquisition of right- of-way for the northerly extension of Dowdell Avenue from its terminus just northerly of Martin Avenue to Business Park Drive. (Portion of APN 143-040-111 and 064), in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PL2013-015GP was processed in the time and manner prescribed by State and local law; WHEREAS, on April 25, 2013, the Planning Commission reviewed Planning Application No. PL2013-015GP during a public meeting at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the April 25, 2013, Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PL2013-015GP; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in finding that the acquisition of fight -of -way from Sonoma Media Investments, LLC (Press Democratic) and C. B. Properties for the Dowdell Avenue extension was consistent with the General Plan 2020, makes the following factors, to wit: TR -A Promote safe and efficient vehicular circulation throughout Rohnert Park. The extension of Dowdell Avenue with the construction of the apartment complex will provide adequate access to the complex by the residents of the apartment units and their guests. It will also insure that an acceptable Level of Service (LOS) will be maintained on surrounding streets after completion of the apartment complex. TR-NPromote safe, efficient and comfortable circulation for cyclists and pedestrians throughout Rohnert Park. The Stadium Area Master Plan provides for Class II bike lanes on the extension of Dowdell Avenue to Business Park Drive for the safety of cyclists using the street. It also provides for 6 foot wide sidewalks on Dowdell Avenue for pedestrian safety. Section 4. On June 10, 2008, the Rohnert Park City Council certified the Final EIR (SCH#2005042111) for the Stadium Area Master Plan. No further CEQA action is required for the right-of-way acquisition for the extension of Dowdell Avenue to State Farm Drive. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby recommend that the City Council find that the acquisition of right-of-way for the extension of Dowdell Avenue to Business Park Drive is consistent with the General Plan 2020: DULY AND REGULARLY ADOPTED on this 25th day of April, 2013 by the City of Rohnert Park Planning Commission by the following vote: AYES: 0 NOES: ABSENT: ABSTAIN: �BORBA GIUDICE HAYDON Susan Adams, Chairperson, Rohnert Park`Kannin.g Commission 4� Attest: "i- Susa Azevedo, Recordin ecretary
