2012/04/26 Planning Commission MinutesROHNERT PARK PLANNING COMMISSION MINUTES Thursday, April 26, 2012 The Planning Commission of the City of Rohnert Park met this date in a regular session commencing at 6:00 p.m. in the City Hall Council Chambers, 130 Avram Avenue, with Chairperson Adams presiding. Call To Order Roll Call Declaration of Abstention Acknowledgement of Publíc Noticing Unscheduled Public Appearances Approval of Minutes Site Plan & Architectural Revìew Fíle No. PL2012-0075R RÍchard Sambucetti, Horges Architectural Group Chairperson Adams called the meeting of the regular session to order at approximately 6:00 p.m. with Chairperson Adams leading the pledge. Present: (4) Commissioners: Chairperson Adams, Vice-Chairperson Haydon, Commissioner Borba and Commissioner Giudice were present. Commissioner Armstrong was absent. Planning and Building Manager, Marilyn Ponton, Development Services Director, Darrin Jenkins and Secretary Suzie Azevedo were present. None. Chairperson Adams acknowledged the posting of the Agenda of this meeting in three (3) public places, per the requirements of the Brown Act. Upon motion by Commissioner Borba, seconded by Commissioner Adams the minutes of the January 26,2012 meeting were approved as presented. The motion passed with a 3-0 vote. Commissioner Giudice abstained. Due to lack of quorum of Commissioners present at the February 9,2012 and March 22,2012 meeting, the Commission deferred approval of the minutes to the next meeting. Planning and Building Manager, Marilyn Ponton, presented the staff report. She stated that in 2006 Site Plan and Architectural approval was given for a 5250 square foot commercial building located at6277 Commerce Boulevard (formerly Wendy's). That approval has been extended several times since the original entitlement and is presently valid. Ms. Ponton reported that the applicant, Starbucks, is proposing a variation from the original approval and is seeking approval for a 1700 square foot building with a drive{hru window. Ms. Ponton reviewed the architecturalfeatures as submitted, operational details and on-site improvements and recommended that the Planning Commission, by motion adopt Resolution No. 2012-11 approving Conditional Use Permit, Site Plan and Architectural Rtrview for the Starbucks restaurant with a drive-thru window, subject to the findings and conditions of approval. Chairperson Adams opened the public hearing. Terry Johnson, owner of the site, was recognized and briefly responded to Commission question. Also recognized was Andrew Z. of Starbucks. Chairperson Adams closed the public hearing. A motion was made by Commissioner Haydon, seconded by Commissioner Giudice to adopt Resolution No. 2012-11 approving Conditional Use Permit, Site Plan and Architectural Review for the Starbucks restaurant with a drive{hru window, subject to the findings and conditions of approval. The motion passed with a 4-0 vote. (Commissioner Armstrong was absent). Technical Advisor, Norm Weisbrod presented the staff report. The following matters relating to a five (5) story hotel and a fast food restaurant located on a net 4.58 acre site at the northwest corner of Redwood Drive and Golf Course Drive West are being proposed and considered: o Resolution No. 2012-06 recommending to the City Council approval of administrative corrections to the Wilfred/Dowdell Specific Plan; o Resolution No. 2012-07 recommending to the City Council approval of a Development Area Plan for Oxford Suites Hotel and McDonald's Restaurant in Village North of the Wilfred/Dowdell Specific Plan; o Resolution No. 2012-08, approval of the Conditional Use Permit for the Oxford Suites Hotel and McDonald's Restaurant. Mr. Weisbrod provided a power point presentation highlighting project specifics and the entitlement process for the North Village of the Wilfred/Dowdell Specific Plan site. A brief discussion was held. Commissioner Adams opened the public hearing. Key discussion points and comments included the following: o Condition No. 13 - A question arose regarding the language "meeting rooms shall be used only by hotelguests and not by the general public or outside groups." The commission inquired as to the non-availability of meeting rooms for local or civic organizations. ls this condition being imposed by the City and what is opinion of the Oxford Suites Hotel regarding this condition? Response: Meeting rooms and policy of Oxford Suites is not focused on rental to outside parties. lssues surrounding parking would arise should these meeting rooms be rented separately other than by hotel guests.o Condition No. 14 - Architectural enhancement of the east elevation of the McDonald's Restaurant. Discussion was held. o Condition No. 58 - The applicant shall demonstrate legal access for the site from the Home Depot property prior to issuance of a building permit for the Oxford Suites Hotel. Should the condition alleviate Oxford Suites responsibility and reflect McDonald's? A motion was made by Commissioner Borba, seconded by Commissioner Giudice to adopt Resolution No.2012-06 recommending to the City Council approval of administrative corrections to the Wilfred/Dowdell Specific Plan as presented. The motion passed with a 4-0 vote. (Commissioner Armstrong was absent) A motion was made by Commissioner Borba, seconded by Commissioner Giudice to adopt Resolution No. 2012-07 recommending to the City Council approval of a Development Area Plan for Oxford Suites Hotel and McDonald' Restaurant in Village North of the Wilfred/Dowdell Specific Plan with the following amendments: - Condition of Approval 5 - Add: The hours of operation for McDonalds Drive{hru are permitted up to 24 hours per day - Condition of Approval 13 - Remove language 'and not by the general public or outside groups." Add: and pool areas after the words "meeting rooms"- condition of Approval 14 - Replace existing with: McDonald's shall work with Development Services Department on the architectural enhancement of the Redwood Drive (East) elevation of the McDonalds Restaurant.- Condition of Approval 57 - Add "for offsite improvements" after the words post security.- Condition of Approval 58 - shall read: the applicant shall demonstrate legal access for the site from the Home Depot property prior to issuance of a building permit for the McDonald's Restaurant' - Condition of Approval 83 - remove the words'and volume" - Condition of Approval 131 - After the words "all shelving' add the word systems The motion passed with a 4-0 vote (Commissioner Armstrong was absent) A motion was made by Commissioner Haydon, seconded by Commissioner Giudice to adopt Resolution No. 2012-08 approval of the Conditional Use Permit for the Oxford Suites Hotel and McDonald's Restaurant with the following amendments: - Condition of Approval 5 - Add: The hours of operation for McDonalds Drive-thru are permitted up to 24 hours per day - Condition of Approval 13 - Remove language 'and not by the general public or outside groups."
