2012/07/26 Planning Commission MinutesROHNERT PARK PLANNING COMMISSION MINUTES Thursday, July 26,2012 The Planning Commission of the City of Rohnert Park met this date in a regular session commencing at 6:00 p.m. in the City Hall Council Chambers, 130 Avram Avenue, with Chairperson Adams presiding. Call To Order Roll Call Declaration of Abstention Acknowledgement of Public Noticing Unscheduled Public Appearances Approval of Minutes Conditional Use Permit File No. PL2012-029UP Tony Johnson/Martial Arts Academy Chairperson Adams called the meeting of the regular session to order at approximately 6:00 p.m. with Chairperson Adams leading the pledge. Present: (4) Commissioners: Chairperson Adams, Commissioner Giudice, Commissioner Borba and Commissioner Armstrong were present. Commissioner Haydon was absent. TechnicalAdvisor, Norm Weisbrod and Secretary Suzie Azevedo were present. Chairperson Adams acknowledged the posting of the Agenda of this meeting in three (3) public places, per the requirements of the Brown Act. None. Upon motion by Commissioner Giudice, seconded by Commissioner Armstrong, the minutes of the June 14, 2012Planning Commission Meeting were approved as presented with a 4-0-1vote. (Commissioner Haydon was absent). Technical Staff Advisor, Norm Weisbrod, presented the staff report. The project property, 5979 Commerce Boulevard is currently zoned l-L/O and developed with a small shopping center known as Commerce Center. The applicant, Tony Johnson, is proposing a small martial arts studio, occupying 3 vacant tenant spaces in the center. Mr. Weisbrod reviewed the operational details of the proposed martial arts studio and discussed current and future parking throughout the center. Mr. Weisbrod recommended approval of the application as conditioned. A brief discussion was held by the Commission and staff. Chairperson Adams opened the public hearing. The applicant, Tony Johnson was recognized and briefly spoke to the Commission. Chairperson Adams closed the public hearing. Planning Commission Minutes 2012 Conditional Use Permit File No. PL2012-032UP Philip McLeanlMorth Bay Auto Sales Conditional Use Permit File No. PL2012-033UP Dana HyatUGolden Súaúe Overnight Delivery Service Matters from Commissíoners Matters from Planning Sfaff A motion was made by Commissioner Borba, seconded by Commissioner Armstrong to adopt Resolution No.2012-20 approving Conditional Use Permit for a martial arts studio at 5979 Commerce Boulevard subject to the findings and conditions of approval. The motion passed with a 4-0-1 vote. (Commissioner Haydon was absent). Norm Weisbrod presented the staff report. The project property, 5625 State Farm Drive, is currently developed with a 36400 square foot single story industrial building. The building is occupied by a wide range of tenants including industrial, office and retail uses. The applicant proposes to occupy a 28 by 28 foot office space within the building toward the rear of the site to run a part time used car sales business. Mr. Weisbrod reviewed the operational details as well as allotted parking spaces for the auto sales and recommended approval of the application subject to the findings and conditions of approval. Chairperson Adams opened the public hearing. Phil McLean, the applicant, was recognized and responded to Commission questions. Chairperson Adams closed the public hearing. A brief discussion was held by the Commission. A motion was made by Commissioner Borba, seconded by Commissioner Armstrong to adopt Resolution No.2012-21 approving a Conditional Use Permit for a used car sales business at 5625 State Farm Drive, Suite 46, as conditioned. The motion passed with a 4-0-1 vote. (Commissioner Haydon was absent) Mr. Weisbrod reported that applicant, Golden State Overnight is proposing a parcel delivery service operation at property located at240 Classic Court. Mr. Weisbrod gave a brief overview of the applicant's proposal and stated that based on the analysis and findings of the report, staff recommends that the Planning Commission, by motion, adopt Resolution No.2012-22 approving Conditional Use Permit to allow a parcel delivery service in the l-L District, subject to the findings and conditions. Chairperson Adams opened the public hearing. Patrick Stupes, the applicant, was recognized and spoke briefly to the Commission. Chairperson Adams closed the public hearing. A motion was made by Commissioner Borba, seconded by Commission Giudice, to adopt Resolution No.2012-22 approving Conditional Use Permit for a parcel delivery service business at240 Classic Court as conditioned. The motion passed with a 4-0-1 vote (Commissioner Haydon was absent). None. The August9,2012 meeting has been cancelled.
