A RESOLUTION OF THE PLA¡INING COMMISSION OF THE
CITY OF ROHNERT PARK CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT FOR A SMALL RECYCLING COLLECTION CENTER AT 6340
CoMMERCE BOULEVARD (APN r43-0s1-069)

\ryHEREAS, the applicant, Lucas J. Twdik, Nexcycle for Safeway Stores, filed Planning
Application No. PL20l2-001UP for a Conditional Use Permit to allow a small recycling
collection center on property located at6340 Commerce Boulevard (APN 143-051-069), in
accordance with the City of Rohnert Park Municipal Code;
IVHEREAS, Planning Application No. PL20l2-00lUP was processed in the time and
m¿¡nner prescribed by State and local law;
WHEREAS, public hearing notices were mailed to all property owners within a 300 foot
radius of the subject property and to all agencies and interested parties as required by California
State Planning Law, and a public hearing notice was published in the Community Voice for a
minimum of 10 days prior to the first public hearing;
IVHEREAS, on February 9,2012, the Planning Commission reviewed Planning
Application No. PL20l2-00lUP during a scheduled public meeting at which time interested
persons had an opportunity to testify either in support of or opposition to the project; and,
\ryHEREAS, at the February 9,2012, Planning Commission meeting upon hearing and
considering all testimony and arguments, if any, of all persons desiring to be heard, the Planning
Commission considered all the facts relating to Planning Application No. PL20I2-001UP;
NOIV, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLO\ilS:
, Section L. That the above recitations are true and correct.
Section 2. Factors considered. The Planning Commission, in approving Planning
Application No. PL20l2-00lUP makes the following factors, to wit:
A. That the proposed location of the condítional use ts in accord with the objectives of the
zoning ordínance and the purposes of the district in which the site is located.
Criteria Satisfied. The location of the Small Recycling Collection Facility is located in
accordance with the requirements of the ZoningOrdinance as they apply to a Small
Recycling Collection Facility.
B. That the proposed location of the conditionøl use and the condítions under whích ít
would be operated or maíntained will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the vicinity.
Criteria Satisfied. The Small Recycling Collection Facility is located on the shopping
center site in a manner that will not impede trafñc flow on the property and will not
impact parking for the various commercial businesses on the site. It is also in a location
that will not result in noise impacts to any residential units in the vicinity. The collection
container will be designed with graphics to provide an attractive appearance to the
surrounding area.
C. That the proposed conditional use will comply with each of the apptícable provisions of
thís Title.
Criteria Satisfied. The Small Recycling collection Facility complies with all of the
requirements of the ZomngOrdinance relating to the use specifically Chapter 17.07.020V
Recycling Facility.
Section 3. Environmental Clearance. The project is categorically exempt from the
California Environmental Quality Act (CEQA), Article 19, Section 15303 New Construction or
Conversion of Small Structures.
NOW THEREFORE BE IT RESOLVED' that the Planning Commission does hereby
approve Planning Application No. PL2012-001UP subject to the following conditions:
l. The Conditional Use Permit approval shall expire one year from the Planning
Commission approval date, unless prior to the expiration a building permit is issued and
construction is commenced and diligently pursued toward completion and the use is
initiated, or an extension is requested and approved.
2. An outdoor 32 gallon refuse container for public use shall be maintained adjacent to the
Recycling Facility duríng operatíonøl hours only.
3. The days of the week and hours that the recycling facility will be open to the public shall
be permanently posted on the recycling container.
5. The area around the recycling container shall be maintained in an orderly condition at all
times free of litter and debris.
6. A sign shall be posted on the recycling container instructing the public not to leave
recyclable containers on the premises when the recycling facility is not open.
7. The applicant shall comply with all applicable sections of the City of Rohnert Park
Municipal Code; including Subsection 17.07.020 V.2 concerning small collection
facilities.
8. The applicant shall secure all necessary permits from any affected agency (e.g. the
Califomia Department of Conservation) prior to commencement of this operation.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
